Greetings,
It has been learnt that a baby female elephant has been traded by Munna of Pattikalyana, Panipat in Haryana to Yusuf Ali of Delhi, ownership read with microchip; both are illegal and forge documents. On July 5, 2014 Ms. Preeti Simoes, Creative Director, Comedy Nights with Kapil, Bunglow No. 6, Ichapurti Mahada, Andheri West, Mumbai approached Naresh Kadian and informed that baby female elephant was badly beaten by her custodian with iron ankush, which is banned by the Jaipur Bench of Rajasthan High Court on PIL moved by Naresh Kadian. Ms. Preeti Simoes along with Varun Gulati and Anushree Pardeshi witness the said elephant abuse then Preeti Simoes went to the Yamuna River Bridge, where she found another male elephant tied with spiked / thorn bits, which is also prohibited under section 8 of the Prevention of Cruelty to Draught and Pack Animals Rules, 1965 (AWBI letter dated July 1, 2014 attached here with for ready reference).
Where as there are five elephants stationed at Yamuna River Bridge in Delhi, baby female along with two another female claimed by Yusuf Ali, male elephant claimed by Yakub Ali and another female claimed by Abdul Hassan of Delhi and all these five elephants are being badly abused by their custodians, no proper shed, feeding, treatment and care, hence the said custodians of five elephants are violated the section 3 and 11(1)(a) of the Prevention of Cruelty to Animals Act, 1960 read with Delhi Police Act, 1978, and also Section 42 of the Wildlife Protection Act, 1972, which states that owners must have adequate facilities for housing, maintenance and upkeep of animals, where as microchip is essential under section 38-H of the Wildlife Protection Act, 1972 and elephant trading also banned in India, it would be pertinent to mention here that male elephant can be dangerous to the public life and property during musth period, where as the Prevention of Cruelty to Draught and Pack Animals Rules, 1965 made out under section 38 of the Prevention of Cruelty to Animals Act, 1960. It is further stated that all said five elephants are being shifted with out any transit permit from Delhi to other places for profit and personnel gain by their abuser custodians.
Hence UN affiliated OIPA www.oipa.org chapter in India requested you to please lodge FIR against all elephant custodians, confiscate these abused elephants after cancelling private ownership for further rehabilitation.
It is also intimated that Hon’ble Supreme Court of India upheld the animal rights, in the recent judgements, passed in the Jallikattu matter and elephant has been declared as a National Heritage animal of India, protected under scheduled one of the Wildlife Protection Act, 1972, where as Yusuf Ali managed forge documents and microchip for baby female elephant.
