ORAL ORDER: Having reviewed the parties' submissions regarding the sole disputed provision of the

protective order (D.I. 60, 61, 62 and Exhs.), IT IS HEREBY ORDERED that the Court will adopt Defendant's
version of paragraph 4.4 and DENIES Plaintiff's request for an order to permit it to use Defendant's
highly confidential information in related proceedings pending in Germany. The Court understands that
both German law and U.S. law (see 28 U.S.C. Sec. 1782) provide other, appropriate mechanisms for
Plaintiff to seek the relief it is requesting. Given the sensitivity to Defendant of the information Plaintiff
seeks to use in Germany, and given that Plaintiff may have opportunities to present the evidence at
issue to the German proceeding even after Plaintiff files a brief in Germany due June 30, it is reasonable
to require Plaintiff to pursue the other mechanisms for the relief it is seeking. The Court will enter the
parties' proposed protective order (D.I. 62 Exh. C), including Defendant's version of the disputed
provision. The teleconference scheduled for July 1, 2014 is CANCELLED. ORDERED by Judge Leonard P.
