Article 212. Defnitions.
(a) “Commission” means the National Labor Relations Commission or any of its
diisions! as the case may be! as "roided #nder this Code.
(b) “$#rea#” means the $#rea# of Labor Relations and%or the Labor Relations
Diisions in the re&ional o'ces established #nder (D No. 1! in the
De"artment of Labor.
(c) “$oard” means the National Conciliation and )ediation $oard established
#nder *+ No. 12,.
(d) “Co#ncil” means the -ri"artite .ol#ntary Artibtration Adisory Co#ncil
established #nder *+ No. 12,! as amended.
(e) “*m"loyer” incl#des any "erson actin& in the interest of an em"loyer! directly
or indirectly. -he term shall not incl#de any labor or&ani/ation or any of its
o'cers or a&ents e0ce"t 1hen actin& as em"loyer.
(f) “*m"loyee” incl#des any "erson in the em"loy of an em"loyer. -he term
shall not be limited to the em"loyees of a "artic#lar em"loyer! #nless this
Code so e0"licitly states. 2t shall incl#de any indiid#al 1hose 1or3 has
ceased as a res#lt of or in connection 1ith any c#rrent labor dis"#te or
beca#se of any #nfair labor "ractice if he has not obtained any other
s#bstantially e4#ialent and re&#lar em"loyment.
(&) “Labor or&ani/ation” means any #nion or association of em"loyees 1hich
e0ists in 1hole or in "art for the "#r"ose of collectie bar&ainin& or of dealin&
1ith em"loyers concernin& terms and conditions of em"loyment.
(h) “Le&itimate labor or&ani/ation” means any labor or&ani/ation d#ly re&istered
1ith the De"artment of Labor and *m"loyment! and incl#des any branch or
local thereof.
(i) “Com"any #nion” means any labor or&ani/ation 1hose formation! f#nction or
administration has been assisted by any act defned as #nfair labor "ractice
by this Code.
(5) “$ar&ainin& re"resentatie” means a le&itimate labor or&ani/ation or any
o'cer or a&ent of s#ch or&ani/ation 1hether or not em"loyed by the
em"loyer.

(3) “6nfair labor "ractice” means any #nfair labor "ractice as e0"ressly defned
by this Code.
(l) “Labor dis"#te” incl#des any controersy or matter concernin& terms and
conditions of em"loyment or the association or re"resentation of "ersons in
ne&otiatin&! f0in&! maintainin&! chan&in&! or arran&in& the terms and
conditions of em"loyment! re&ardless of 1hether the dis"#tants stand in
"ro0imate relation of em"loyer and em"loyee.
(m) “)ana&erial em"loyee” is one 1ho is ested 1ith "o1ers or
"rero&aties to lay do1n and e0ec#te mana&ement "olicies and%or hire!
transfer! s#s"end! layo7! recall! dischar&e! assi&n! or disci"line em"loyees.
8#"erisory em"loyees are those 1ho! in the interest of the em"loyer!
e7ectiely recommend s#ch mana&erial actions if the e0ercise of s#ch
a#thority is not merely ro#tinary or clerical in nat#re b#t re4#ires the #se of
inde"endent 5#d&ment. All em"loyees not fallin& 1ithin any of the aboe
defnitions are considered ran39and9fle em"loyees for "#r"oses of this $oo3.
(n) “.ol#ntary Arbitrator” means any "erson accredited by the $oard as s#ch! or
any "erson named or desi&nated in the Collectie $ar&ainin& A&reement by
the "arties to act as their ol#ntary arbitrator! or one chosen! 1ith or 1itho#t
the assistance of the National Conciliation and )ediation $oard! "#rs#ant to
a selection "roced#re a&reed #"on in the Collectie $ar&ainin& A&reement!
or any o'cial that may be a#thori/ed by the 8ecretary of Labor and
*m"loyment to act as ol#ntary arbitrator #"on the 1ritten re4#est and
a&reement of the "arties to a labor dis"#te.
(o) “8tri3e” means any tem"orary sto""a&e of 1or3 by the concerted action of
em"loyees as a res#lt of an ind#strial or labor dis"#te.
(") “Loc3o#t” means the tem"orary ref#sal of an em"loyer to f#rnish 1or3 as a
res#lt of an ind#strial or labor dis"#te.
(4) “2nternal #nion dis"#te” incl#des all dis"#tes or &rieances arisin& from any
iolation of or disa&reement oer any "roision of the constit#tion and
byla1s of a #nion! incl#din& any iolation of the ri&hts and conditions of
#nion membershi" "roided for in this Code.
(r) “8tri3e brea3er” means any "erson 1ho obstr#cts! im"edes! or interferes
1ith by force! iolence! coercion! threats! or intimidation any "eacef#l
"ic3etin& by em"loyees d#rin& any labor controersy a7ectin& 1a&es! ho#rs
or conditions of 1or3 or in the e0ercise of the ri&ht of self9or&ani/ation or
collectie bar&ainin&.
(s) “8tri3e area” means the establishment! 1areho#ses! de"ots! "lants or
