PETITIONERS OPPOSITION TO RESPONDENTS MOTION TO DISMISS

THE PETITION FOR CONTEMPT

COMES NOW Petitioner William John Joseph Hoge in opposition to

Respondents Motion to Dismiss Petitioners Petition for Contempt. In opposing
the motion Mr. Hoge states as follows:

FACTS

The instant peace order was issued with proper regard for Petitioners due
process rights. He was advised of the time and place for the de novo trial before this
Court on 27 August, 2014. Neither any agent of the State nor any private party
prevented him from attending the hearing. He simply chose not to do so.
Respondent alleges that Mr. Hoge lied to this Court in obtaining the instant
peace order. Respondents opportunity to offer his own evidence and cross examine
Mr. Hoge came during the de novo trial, but he did not bother to attend and exercise

his rights. That opportunity has passed. Indeed, more that ten days have passed,
so Respondent is now time-barred from moving to alter or amend the Courts
judgment (Md. Rule 2-534). Respondent further alleges that Mr. Hoge lied to this
Court to obtain a peace order and extension against Respondent in 2013. The Court
has already found for Mr. Hoge on the merits in that matter, and Respondent offers
no reason to reverse its findings. The Court should treat its findings in both cases
as settled.
Respondents August, 2014, motion to dismiss the peace order based on
improper venue was acted upon by this Court. It was denied.
Mr. Hoge has sought the instant peace order solely because of his desire to be
left alone by Respondent.
As described in the petitions for contempt filed on 24 November and
8December, 2014, Respondent has continued to contact Mr. Hoge in violation of
this Courts order. Additionally, Respondent has contacted Mr. Hoge by mail; a
letter over Respondents signature (dated January 15, 2014 and postmarked JAN
12 15) was received by Mr. Hoge on 14 January, 2015. Exhibit A.

CONCLUSION

WHEREFORE, Mr. Hoge asks the Court to DENY Respondents Motion to

Dismiss the Petition for Contempt and for such other relief as the Court may deem
just and proper.
