Dear Mr. Rossi:
I am writing in my capacity as executive director of the Pennsylvania Freedom on
Information Coalition (PaFOIC), a Pennsylvania not-for-profit organization that seeks
to preserve and improve access to all aspects of government. While we cannot help
every citizen seeking records of Pennsylvania government, we will weigh in when
appropriate.
Recently, we learned that Austin Nolen has requested a copy of the arrest report
filed with the Court in connection with the arrest of
in August 2014.
It is our understanding that Mr. Nolen has requested this record from Marc Gaillard,
head of the Criminal Section of the Office of Judicial Records, and Marc Flood, the
Deputy Court Administrator for Procurement. To date, Mr. Nolen has either been
denied access to the record or not received any response to his request. While we
do not represent Mr. Nolen, we are deeply concerned about his inability to obtain
timely access to the arrest report he has requested.
Arrest reports filed with the court are judicial records accessible to the public under
longstanding common law and constitutional principles. Denial of access to those
reports and other judicial records is a fundamental deprivation of citizens rights.
We respectfully request that the Court provide Mr. Nolen and other citizens timely
and meaningful access to records that have been filed with it or explain the Courts
failure to do so.
