1.0

HSE Management System and HSE Management Plan

1.1.1

Contractor shall have a developed HSE management system covering all activities under the
Contract that is compatible with Companys HSE management system as described in CP-122.

1.1.2

As part of Contractors HSE management system, Contractor shall develop a Contract HSE
management plan describing the specific actions, programs and procedures that will be
implemented by Contractor to manage hazards associated with the execution of the Services
under the Contract. The HSE management plan shall be developed in accordance with the
Contract HSE Management Procedure PR-1171, Part II.

1.1.3

The Contract HSE management plan shall cover all Contract phases from mobilisation through
execution, demobilisation and Site restoration.

1.1.4

The requirements specified in this Section C9 apply regardless of the status of an activity (e.g.
standing by or demobilised).

1.1.5

Contractor shall ensure that any person, admitted to the Site by Contractor or SubContractor
shall comply with the relevant HSE Specifications herein.

2.0

Hazards and Effects Management Process (HEMP)

2.1.1

Company has reviewed the content of the Services to be provided under the Contract and has
identified the following activities and hazards that, as a minimum, should be considered by
Contractor when developing the Contract HSE management plan:

Contractor shall prepare and implement a comprehensive HEMP as part of the HSE
management plan prior to Commencement of the Services as per PR-1171 Part II.

3.0

HSE Training

3.1.1

Contractor shall provide, as a minimum, HSE training for Contractor Personnel in accordance
with the minimum HSE training requirements as listed in Appendix 1 of this Section C9.

3.1.2

Contractor shall at all times maintain an up-to-date list of all Personnel employed under the
Contract, and details of the training courses they have attended, including the attendance date.

3.1.3

All Contractor Personnel shall have completed the training listed in Appendix 1 before
commencement of the Services, unless stated otherwise in Appendix 1 or unless otherwise
approved by the Contract Holder in writing.

4.0

HSE Commencement Certificate

4.1.1

Contractor shall not commence the Services until Company has issued the HSE commencement
certificate as per PR-1171 Contract HSE Management Part II, Appendix 1.

5.0

Performance Monitoring and Reporting

5.1.1

Contractor shall monitor HSE performance as per the agreed Contract HSE management plan
and shall complete and submit the Health and Safety Statistics - Monthly Return as per PR1171 Contract HSE Management Part II (http://sww2.pdo.shell.om/cehd/default.aspx).

5.1.2

The Contractor Chief Executive Officer (CEO) shall submit an HSE Letter of Assurance (LOA)
every year before 1 February to Company. The LOA is a confirmation from the CEO, with or
without qualifications, that the current implementation status and integrity of the Contractor
HSE management system meets the Contract requirements. Only one LOA per Contractor is
required covering all contracts with Company that are operational on 1 January of that year.
Company will issue the format and submission details for the LOA yearly in December.

6.0

HSE Incidents

6.1.1

Contractor shall report to Company and shall investigate all work-related HSE incidents, and
comply with the requirements as outlined in Companys Incident Notification, Reporting and
Follow-up Procedure, PR-1418.

7.0

Site Restoration

7.1.1

Upon completion of the Services, Contractor shall satisfactorily restore the Site, including any
areas of Company concession area and any premises thereon, used by Contractor to perform
the Services.

7.1.2

Company shall certify satisfactory Site restoration by issuing a site restoration certificate
(included in PR-1171 Contract HSE Management Part II).

8.0

HSE Non-Compliance Penalties

8.1.1

Repeated failure by Contractor to comply with the Contract HSE obligations may result in the
removal from Site of the relevant Contractors supervisory and/or managerial Personnel.

8.1.2

In the event that Company considers that Contractor has failed to comply with the latest
approved Contract HSE management plan, or other Contract HSE requirements, then Company
shall issue Contractor with an HSE default notice.

8.1.3

An HSE default notice is any written notification issued by Company detailing specific aspects of
the Services that do not comply with either the latest approved Contract HSE management plan
or other Contract HSE requirements.

8.1.4

For each HSE default notification an amount of USD 1300 will become due to Company.

8.1.5

For the purposes of this penalty clause:


a) Where an HSE default notice contains several incidences of default, each incident shall be
considered as a separate HSE default notice.
b) Where HSE default persists for a period longer than twenty-four (24) hours, or any other
period as stated in the HSE default notice, then the applicable penalty shall be repeated for
each subsequent twenty-four (24) hour or other specified period that the default continues.

8.1.6

Where repeated HSE default notices are served by Company relating to the same HSE default
then the following remedies are available to Company:HSE Default

Increased supervision by Company of Contractor at the cost of

9.0

Safety Training Observation Programme (STOP)

9.1.1

Contractor shall fully implement a safety training observation programme, or Company


approved equivalent, in accordance with Companys Specification SP-1259 STOP.

10.0

Applicable Documents

10.1.1

Contractor shall adhere to the documents listed below.

10.1.2

Contractor shall ensure it has access to these documents and any updates thereto. Contractor
shall request Company to provide (access to) these documents if this is not the case.

10.1.3

Contractor will monitor updates to these documents and inform Company of such updates.

10.1.4

In the event that Company decides to implement any update to the documents listed below,
Company will issue an Instruction to Contractor.

10.1.5

Contractor shall ensure that hardcopies or electronic copies of the documents listed below are
readily available to all staff for which they are relevant, including on the Site, and that all staff
for which they are relevant are fully familiar with their content.
