Respondent Dustin Green (‘Green’) is an adult individual residing at 1819 Bonnie Blue, Middletown, Pennsylvania 17057. 4. Itis alleged upon information and belief that Green is a registered member of the Republican Party. 5. Green has cross-filed Democratic and Republican petitions to become a candidate on both the Democratic and Republican ballots for the position of School Board Director of the MASD. 6. A true and correct copy of Green's nominating petition to be a Democratic candidate for School Board Director of MASD is attached hereto as Exhibit A. 7. The Circulators Affidavit on Green's Democratic petition shows that Green, a registered Republican, circulated his petition for the Democratic nomination and signed the Circulator’s Affidavit. 8. The circulator of a nominating petition must be of the same party as the party's nomination being sought. The Affidavit of Circulator contained on the petition states that the circulator attests that “he or she is a qualified elector duly registered and enrolled as a member of the political party referred to in this petition original). In other words, the circulator of Green's Democratic Petition must be a (emphasis in member of the Democratic Party. 9. Respondent Green is a registered Republican and is thus not enrolled as a member of the political party referred to in his petition for the Democratic nomination as School Board Director. 10. Respondent Green was not qualified to circulate his petition for the Democratic nomination and falsely stated on his affidavit that he was so qualified.11. — This error on Green's nominating petition constitutes a material defect. 12. Pefitioner Richards respectfully requests that Green's nomination petition for the Democratic ballot be set aside and that Green's name not appear on the Democratic ballot in the May 2015 primary. 13. Petitioner Richards further requests that pursuant to 25 P.S. § 2937 that respondent Green be directed to reimburse petitioner for the fee incurred in the filing of this petition.
