We hope that you will find the information
contained in here useful and we welcome any
feedback.
As a District Council, we are always trying to
find ways to communicate and engage with
our members and this newsletter is meant to
be just another tool in our toolbox. It is in no
means a substitute for coming to your local
meetings and we encourage you to attend as
many as you can so you can be an informed
member.
We plan to feature summaries of Business
Reports, events and meetings, information
on classes, banners or political activity. If you
are on Facebook or Twitter you can find us
there too, just search for IUPATDC3, or at

Merging our Locals is important for


several reasons: costs savings,
improved member services and in
alignment with our goal of full
affiliation at the District Council.
Per the Constitution of the IUPAT a
Bylaws Committee was set and met,
Bylaws were presented for a vote and
failed to pass. A new Bylaws
Committee was appointed and the new
set of Bylaws will be up for vote in May.
Look for an update from BMST Doree
soon.

Were still struggling for drywall finishers


and the Painters wont be far behind. Its a
very bad day when a contractor tells me they
arent bidding jobs because they dont think
there is enough manpower available to man
them all. I think its safe to say that if you
know anyone that is in the trade, now is a
good time to talk to them about the Painters

Union. Not many people just jump right in,


there is a lot of info to know and understand
about working under a Collective Bargaining
Agreement. Not to mention the Health &
Welfare benefits we provide and the Pension
that new people looking to get in have a ton
of questions about, especially the differences
between a Pension and a 401k. So again, if
you know anyone give them my cell phone
number (816-215-5519) or have them call the
Hall (816-358-2440) so we can answer those
questions and ease any concerns a new guy
or gal may have so to get our membership
growing. Please dont be worried about your
job when it comes to recruiting, there is
enough work to go around! Some of the best
contractors we have are saying that they
may double in size in the next 2 years so
there is nothing to worry about- do your job
and youll have a job.

Lastly - OSHA 10 Certification!! Why is it
when our contractors hire a painter or
drywall finisher off the bench that he or she
doesnt already have an OSHA 10 card in
their pocket? More and more job are
requiring this safety training, this is also one
of the best areas to fight the non-union. So
how can we go out and beat up on them
when our own members dont even have it?
We are teaching the class more than monthly
and if you dont have OSHA 10, youre
literally putting our contractors in jeopardy.

Work for Glaziers in the future looks very


promising. Glazing was the #2 fastest
growing industries according to the
Washington Post. Here soon were going to
be looking for a lot of hands and it would be a
great time to get in. Right now the average
age in Local 558 is around 43 years old. We
need to get some young people in here to
learn from the Glaziers who have been
around. Hours have been picking up for Local
558, which is in turn helping our Health and
Welfare fund, as well as our Local Pension
fund. If anyone has questions about the
apprenticeship please feel free to call me at

There is a lot going on with both, the District
Council and all the Locals. Make sure to come
to your local meeting and get involved.

meetings.
Also we need to make
sure to keep our Dues
paid up. Weve made it
much easier to pay. Just
remember, WE DO NOT

calendars, our District Council Picnic has
been scheduled for September 19th, 2015 at
Longview Lake. The STAR prizes will also be
given away at the picnic. Bring the whole
family!

So far this year, one of the contractors


belonging to 820 have voted on a contract
with a .30 increase retroactive to April 1,
2015.The increase has been allocated to the
pension this year.
Local 820 is also attending a Royals game on
June 6 and if you are interested in attending
contact President Rick Allen or Frank

We have a grievance with Gill Studios that
we are taking to arbitration. It involves an
employee that just came back from being on
workers compensation that has been moved
to a lower classification in the bargaining
unit. This is a violation of the CBA and would
set a precedence of any employee being
reassigned to a lower classification coming
back from work comp.

some Topeka painters and it should last
several months.
Construction is really starting to pick up in
Kansas even with the disastrous policies of
Governor Brownback. We will continue to
fight for our share of the marketplace.

We have completed our move to the new


building and have our old building up for sale.
The new building was purchased with a grant
from the International Union of $250,000.
There is space for training classes as well as
administrative offices and a place on site for
an instructor to stay.

This year saw the establishment of Local


2014 in Kansas. In an effort to be better
stewards of our members funds we merged
Locals 76, 96 and 1179 into Local 2014. We
have spent the first quarter taking care of
some housekeeping issues with the election
of new officers, and locating a new meeting
space in Wichita. Congratulations to the new
officers and members of the Local.
The KU and K State campuses are promising
a crazy amount of work starting this year and
seem to keep adding multi-million dollar jobs
monthly. Washburn University isnt far
behind with 2 fifty-million dollar jobs, and

We have several contracts that expire at the


end of June and July this year. We have
started the process of getting the
notifications sent to the Federal Mediation
and Conciliation Service and the Contractors
of our intent to enter into negotiations. The
last several years when we were negotiating
these agreements that are about to expire,
the economy was in pretty bad shape with
the recession and high unemployment.
Entering into negotiations with the economy
much stronger now than before will be much
better for both sides.
We have had several grievances so far this
year with one that we are having to take to
arbitration. Taking cases to arbitration is a
last resort as we prefer to settle the dispute
through the grievance process but there are
times when both sides cant reach an
agreement on the issue. This case involves an
employee that came back from work comp
and was removed from their classification.
This is a clear violation of the CBA in our
opinion and we cannot let it happen.
To go a little farther about work comp, states
across the country have been chipping away
at workers rights and work comp is just one
of the areas that is being hit drastically.
If anyone is unfamiliar with their contract,
please read it. If anyone has questions on
their CBA, please let us know. Every one of us
have to follow the contract the same as the
contractor. The District Council has more
than 30 contracts spread across all of our
trades. If we dont understand what is in the
contract were working under, or
misinterpret what the contract says we risk
losing in one way or another.

With the merger of the 3 Locals in Kansas, we


have been working on getting the Locals that
no longer exist closed out, their bank
accounts transferred and LM and 990 filings
completed. They are now Local 2015.
We have had Labor/Management meetings
with the Paint Contractors, the Glazing
Contractors, Jackson County and Gill
Studios. Labor/ Management meetings help
to communicate any issues between either
side to help find a resolution to the issue.
These meetings are not negotiations or a
platform to discuss grievances. It is more a
time to bring up problems or potential
problems within the Industry and the
workplace. If you have ideas on some of
issues that might be beneficial to bring up,
please let us know.
The District Council 3 Picnic is set for
September 19 at Longview Lake Shelter 2.
This year the STAR Event and the Council
Picnic have combined. If you have the ability
to participate in STAR and have not qualified
yet, you have until June 30 to get 10 hours of
training to become eligible for the new truck.

Work has continued to increase in all crafts.


We are actively recruiting for all trades and
look to be busy for several years. We have
active campaigns against Switzer Brothers
Painting, Jim Plunkett Inc, Midwest Glass,
Imperial Construction, and M&M Painting.
We are working on several others including:
Summit Interiors, Trifecta Glass, In and Out
Painting, and Dahmer Construction. We are
also working closely with public and private
entities to help our contractors secure more
work. When we can start to unite all workers
with better pay and conditions, then we will
have chance to succeed. Please stay active in
your fight to be the best in the business. A
great man once said, When one stays neutral
while others are oppressed, they have chosen
the side of the oppressor. Stay Safe!

The STAR deadline for qualifications is


rapidly approaching. You must complete 10
hours of training before July 1st in order to
qualify for the STAR Banquet. The Banquet
will be held this year in conjunction with the
District Council 3 Picnic on Saturday,
September 19, 2015 at Longview Lake
Shelter 2. There are several classes still
available throughout April, May and
June. Please check out our website at

register for any classes on the schedule. If
there is a different class that we offer that
you are interested in but do not see on the
schedule, send an email or call the office to
discuss getting it scheduled.
We conducted our first Corrosion Forum on
February 25, 2015 at the Training Center.
This event allowed industrial paint
contractors, corrosion experts, industrial
vendors and end users to all participate and
communicate with one another in an expo
style format. It was held simultaneously with
our CAS Exam so participants could view the
actual superior training produced by this
classification. The Forum was wonderfully
attended and a great success. Thank you for
all those who helped out.
There have been a lot of changes to the
Training Fund over the past year. We have
completely merged every training fund
within the District Council 3 jurisdiction
which was a five (5) year process. We have
developed and adopted brand new
Standards of Apprenticeship, Rules and
Regulations, curriculum and a Trust
document. These were created by the
cooperation between our International,
District Council 3, the Builders Association,
the Training Fund Trustees and the
Department of Labor to govern every trade,
in every area that we represent. These
documents help provide protection for our
work classifications while upholding greater
accountability. The new curriculum or LMS
(Learning Management System) helps keep
our apprentices on the cutting edge of
technologies needed to compete in todays
working environment.
The LMCI or Labor Management
Cooperation Initiative is the entity of the
International that helps create better
relationships between the contractors and
the union. Over the past several years we

have reached out for help in further


developing our outlying areas. Through a
grant process created for just such issues, we
were awarded $250,000 in October
2014. We used those monies to purchase a
new business office and training center in
Springfield, Missouri. It has been a
wonderful blessing to our organization and
will continue to help attract new contractors
able to employ new members in every trade
we represent. It will also help to safety train
our existing Journeypersons and
Apprentices.

After November 2014 we anticipated rough


sessions in both Jefferson City and in Topeka,
unfortunately we were right.
In Kansas this session we have seen multiple
attempts to undermine workers safety and
workers comp. The public employees,
specifically, teachers have been under
assault since day 1.
Imagine, having one of our school districts
being forced to close because the state has
chosen to change funding in the middle of a
school year. Well you dont have to imagine,
because of the funding choices made by
Governor Brownback and the legislature we
have multiple school districts closing early in
Western Kansas. Multiple school districts.
Nationally Propublica released a recent study
of the orchestrated attacks on Workers
Comp across the country. Here are some of
the highlights from the study:

Since 2003, legislators in 33 states


have passed workers comp laws
that reduce benefits or make it
more difficult for those with certain
injuries and diseases to qualify for
them. Florida has cut benefits to its
most severely disabled workers by
65 percent since 1994.
Many states have not only shrunk
the payments to injured workers,
theyve also cut them off after an
arbitrary time limit even if
workers havent recovered.
Employers and insurers
increasingly control medical
decisions, such as whether an
injured worker needs surgery. In 37
states, workers cant pick their own

doctor or are restricted to a list


provided by their employers.

In California, insurers can now


reopen old cases and deny medical
care based on the opinions of
doctors who never see the patient
and dont even have to be licensed
in the state. Joel Ramirez, who was
paralyzed in a warehouse accident,
had his home health aide taken
away, leaving him to sit in his own
feces for up to eight hours.

The scope of the changes, and the extent to


which taxpayers are paying the costs of
workplace accidents, has attracted almost no
national attention, in part because the
federal government stopped monitoring
state workers comp laws more than a
decade ago. Check out what your injuries are

In Missouri we are facing an all-out assault on
working families.

Over 25 pieces of legislation attacking
working families. How many jobs bills have
been crafted you might ask, the answer is
none.
Its almost as if these legislators are following
the same marching orders, oh wait, they are.
There is an organization called the American
Legislative Exchange Council (ALEC)
founded in secrecy by big corporations and
multi-millionaires and run by Lobbyists.
ALEC drafts model legislation and has
member legislators introduce those bills in
state capitals across the country. On multiple
occasions we have seen the same bill, with
the same typo introduced, and in Missouri
one ALEC legislator introduced model
legislation without even putting in the state
name.
These are just some of the fronts we are
working on at the District Council, as well as
increasing the ways in which we
communicate with our members.

Paying Your Dues


We have made it easy for you to call in and pay your
dues. Just call Linda or Sheri at the office at 816-3582440. There is a 2.75% fee to pay by credit card. You are
always welcome to stop by the hall or mail us a check.
Have you gotten your picture taken yet for our new
cards? If you havent and getting to the hall is too
inconvenient, please take a passport style picture in
front of a plain background, and email a copy to our
administrator, Linda Noble at lnoble@iupatdc3.com
with your name, and
Local number.
Keeping your DUES current is YOUR responsibility.
Please keep in mind that our District Council must abide
by the rules according to the IUPAT Constitution, Secs
116 & 117: and our own District Council Bylaws, (Under
revision). From Sec 116: (b) Any member indebted for
three (3) months dues or an amount equal to three (3)
months dues shall stand suspended, neither a vote of
the Local Union nor a hearing being required to suspend
the member. Dues shall include regular, administrative,
and working dues. Sec 117 further states: (a) A
suspended member, failing to become reinstated within
three (3) months from the date of his or her suspension,
shall be dropped from the roll; to again become a
member of the International Union he or she must pay
the full fee(s) applicable to new member/candidates of
the Union to which he or she makes application. (b) The
dropped member shall also pay to the Local Union that
suspended him or her all dues, assessments, fines and
other indebtedness he or she owed said Local Union at
time of suspension. This shall be paid regardless of any
dispensation made in the Administrative Processing Fee
of the District Council/Local Union initiating him or her.
