The plaintiff Latheefa Ali claims that an agreement was made between she and the
defendant Ahmed Ismail stating that the house that belong to Latheefa Ali would be
Ahmed Ismails property if he agrees to take care and look after Latheefa Ali and her
family until her death, and that the defendant has not acted according to the
agreement but has still taken over the house and is gaining money out of it.
Plaintiff claims that Ahmed Ismail owes Latheefa Ali 25000/- for each month as a
rent for every month that he has used and is using the house that belongs to the
plaintiff when he has not taken care of Latheefa Ali or her family for the past 29
years.
HELD: plaintiff could not prove that the defendant had breached the contarct ( the
fact that he has not taken care of Latheefa Ali or her family for the past 29 years.)
hence upholds the decision of the civil court which was ruled in favour of the
defendant.
