Arizona Judge rejects bid to nix death penalty for jodi. May 30 , 2014 an Arizona judge had

judge sherry Stephens dismissed claims made by attorneys that the case was compromised

Baze V. Rees . Ralph Baze and Thomas Bowling were sentenced to death in Kentucky and
argued that executing them by lethal injection would violate the eighth Amendment
prohibition of cruel and unusual punishment. The case had nationwide implications because
the specific cocktail used for lethal injections in Kentucky. When the supreme court granted
certiorari there was an effective moratorium on executions in the united states.

Hall V. Florida the case fleshed out standards first announced by the court Atkins v. Virginia
which left the determination of what constitutes intellectual disability to the states. In Hall
the court narrowed the discretion under which U.S states can designate an individual
convicted of murder as too intellectually incapacitated to be executed. The court adopted the
term intellectually disabled to replace mentally retarted which has been used in prior
opinions.

Morgan V. Illinois court considered challenges to the selection of jurors who would
automatically vote to impose the death penalty on a defendant convicted of a capital offense
in Morgan v. Illinois in 1992 . The majority held that a defendant facing the death penalty
may challenge for cause a prospective juror who would automatically vote to impose the
death penalty in every case. Just as a juror who is unalterably opposed to the imposition of
the death penalty in every case.

The night of March 2, 1986 walton and his two codefendants entered a bar in Tucson, Arizona ,
set on finding someone at random to Rob, Kidnap and leave stranded in the desrt. The person
they chose was Thomas Powell an off duty Marine. The three robbed Powell at gunpoint and
forced him into his car. Then they drove him out into the desert . Jury convicted walton of
first degree murder under Arizonas alternate definitions of the crime, either premeditated
murder or felony murder. Reviewing the death sentence independently it found that the death
sentence was appropriate on these facts.

The case involved the shooting of 20 year old Babrel Poore in Jefferson County In Kentucky .
Kevin Stanford committed the murder on January 7, 1981 when he was 17 years old.
Stanford and his accomplice repeatedly raped and sodomized poore during and after their
commison of a robbery at a gas station.After Stanfords arrest a Kentucky juvenile court
conducted hearings to determine whether he should be transferred for trial as an adult. He
was sentenced to death and 45 years.
