Re: Patent Information of Monsanto's Cotton Insect Protection Technologies
Dear Sir,
This is in reply to your request for further infommtion regarding Monsanto's proposal to
bring its leading cotton technologies to Pakistan and about Monsanto's proprietary rights
which we propose to license to the Government of Pakistan.
Monsanto is offering to bring sonic of its leading cotton technologies to Pakistan,
together with technical and business know-how and regulatory data that will enable
Pakistani cotton growers to use and make the most of these valuable technologies.
Additionally, experience has demonstrated that having a robust stewardship plan is
essential to enable fanners to realize the benefits these technologies, and Monsanto is
offering to assist the Goveniment of Pakistan in implementing appropriate stewardship
programs.
As an initial step, we arc proposing a partnership to bring our leading insect resistance
technologies to Pakistan. Our two key insect-resistant cotton technologies include our
first generation event MON531 technology, which is marketed as Bollgard technology,
and our second generation event MONI 5895 technology, which is marketed as Bollgard
technology. For Bollgard, Monsanto has a robust patent estate in many parts of the
world, but we do not have patents in Pakistan covering this event. We do, however,
possess technical and business know-how that will manic tiakistani cotton growers to use
and make the most of Bollgard technology. We also have proprietary rights in the
scientific regulatory studies required for registration of Bollgard in Pakistan.
Bollgard II represents a substantial improvement over Bollgard. It has two genes
conferring insect resistance, providing improved insect resistance and making the
technology sustainable. Bollgard II is patent protected in Pakistan as well as in many
other countries. As with Bollgard, Monsanto also has proprietary rights pertaining to its
regulatory data package and other technical and business know how relating to Bollgard

We believe it will be important for Pakistan to transition quickly to Bollgard II


technology as other countries have done, in order to sustain the long-term benefits of this
technology for Pakistani growers. Monsanto can enable this transition by helping
Pakistan to make the best use Bollgard technology by registering the event and working
with Pakistani research institutes to address gene expression challenges and make
Bollgard available in high quality local varieties, until Bollgard II varieties are available.
We will also enable Pakistani growers to access Bollgard II technology by obtaining
regulatory approval for Bollgard II, licensing the technology for use in varieties to the
Government of Pakistan and helping Pakistani research institutes by introgressing this
event into, their leading varieties. Additionally, using our knowledge and experience with
these technologies around the world, Monsanto will work with the Pakistani government
to determine the appropriate stewardship programs for the sustainable use of these
technologies.
