RE: Letter of Support for the Fair Chance to Compete for Jobs Act
of 2015
Dear Honorable Senator Booker and Congressman Cummings,
Please accept this letter of support as the endorsement by the National Black
Prosecutors Association (“NBPA”) of the Fair Chance to Compete for Jobs
Act of 2015 (also known as, “Ban the Box Bill” or “Ban the Box
Campaign”)
Founded in 1983, NBPA is a national organization comprised of local, state,
and federal prosecutors, dedicated to the advancement of African Americans
in the prosecution field. As a premier professional law enforcement
organization, we are committed to the pursuit of justice for all people. As
such, we recognize the need to remove barriers to employment for
individuals with criminal records in order for them to have a fair chance at
securing employment and, consequently, becoming productive members of
society.
Consistent with our commitment to justice, we join you in your call for equal
federal employment opportunities for individuals who have a criminal record
and the other Fair Chance to Compete for Jobs Act provisions. As
prosecutors, we recognize the importance of not only prosecuting individuals
to the fullest extent of the law to protect the people of this great nation, which
is our paramount duty, but also the finality of the judicial process. Once an
individual has completed his sentence and paid his debt to society, it is
important to remove barriers, particularly those related to employment, that
continue to punish the individual beyond the scope of their original judgment

nation, Barack Obama, and United States Attormey General Loretta Lynch
have repeatedly declared, we must be smart on crime in order to maintain our
criminal justice system going forward. This is but one way to do so in that it
stands to remove one obstacle for individuals with criminal records who
desire to return to the work force and decrease their likelihood of recidivism
because of the responsibilities and privileges that come with gainful
employment. Further, the removal of an employment barrier and the
resulting increase in gainful employment will add to the nation’s tax base
through employment taxes which is a benefit to the entire nation. Thus,
NBPA hears your cries for justice as set forth in the Fair Chance to Compete
for Jobs Act of 2015 and endorses your efforts.
