MCHENRY COUNTY GRAND JURY FOREMAN AND GRAND JURY MEMBERS.

REPORT OF PROCEEDINGS had in the hearing
of the above-entitled cause before the Honorable

SHARON L PRATHER, Judge of said court, on the 16th day of December, 2009, in the McHenry County Government Center, Woodstock, Illinois. APPEARANCES: MS. SHARON ANN MERONI, Petitioner; MR. LOUIS A. BIANCHI, State's Attorney of McHenry County, by: MR. JEFFREY A. BORA, Assistant state's Attorney, appeared for the People.

THE COURT: MR. BORA: your Honor. THE COURT: MS. MERONI:

you?

seeking the court's guidance in a matter that has come to our attention. It is our understanding that it is still it's within this court's discretion to grant the motion of the petitioner to appear as a special investigator as well as a witness before the grand jury in incidents which she has explained in that

motion.

However, prior to that motion being

disposed of she appeared at our office and did tender to us what we believe to be 17 packets of information to tender to the grand jury. At this time, the motion not having being decided, however, these packets being confidential and not addressed to the state, the state is uncomfortable with keeping them in our possession or

tendering them to the grand jury until the court has reached a decision on the motion. THE COURT: state is asking to hold those

4 5

packets until such time as the court has ruled on the pending matter? MR. BORA: that would be MS. MERONI: But do you mind -- but they -- I That would be fine, your Honor,

if

met with the state's attorney's office yesterday and they said that they don't have an objection, they just need permission. And I also learned about

emergency motions to reconsider and I wrote one up and I went down to the office and asked how to give

it to you this morning and

30

she didn't know if I

should just hand it to you or if you would like me to do it through this form and I -- to basically reconsider that this matter is indeed an emergency. THE COURT: Ma'am, the court previously ruled

that the matter is not an emergency MS. MERONI: THE COURT:

and that ruling would stand if

that's what you're asking the court to reconsider. MS. MERONI: Well, I came across new information Upon leaving the

that I didn't know at the time.

courtroom I found out that,

in fact,

there is an

election that begins on January 9th in the state of Illinois and so it's an impermissible barrier as my court date to return here for redress on this is January 13th. THE COURT: Ma'am, you have to file a written

motion setting forth facts if you want the court to consider it. MS. MERONI: THE COURT: MS. MERONI: THE COURT: I have it right here. Do you have a written motion? Yes, ma'am. Have you tendered a copy of that

motion to the state? MS. MERONI: may. THE COURT: MS. MERONI: MR. BORA: You may. There you go. Your Honor, we would acknowledge No, I would like to do that if I

receipt of an emergency motion to reconsider. THE COURT: Have a seat, ma'am, and when I have

an opportunity I will read your motion and address it. MS. MERONI: Thank you.

24

And also when I was speaking with the

state's attorneys yesterday he said that it might be useful if I showed you guys what was in those packets and I would be happy to do that. THE COURT: Would the state please tender a copy

of the packet to the court. MR. BORA: Absolutely, your Honor.

We are tendering to you a packet entitled jury foreperson through grand juror number 8. MS. MERONI: But I have a copy for you too if

you want it this way. THE COURT: MS. MERONI: THE COURT: MS. MERONI: THE COURT: MR. BORA: THE COURT: your copies. MS. MERONI: confused. Okay, thank you very much. I'm You have copies? Mm-hmm. Same thing as what is in here? Mm-hmm. State, is that acceptable? That would be acceptable, your Honor.
Ma'am, you can tender to the court
