November 3, 2015 Hamad Abdullatif Al-Falah Chairman & Managing Director Kuwait Airways Corporation 400 Kelby Street Fort Lee, New Jersey 07024 Re: Kuwait Airways Corporation - Contract Carrier Class Lease Agreement, IFK International Airport, dated December 15, 2000 To Mr. Al-Falah: The Port Authority of New York and New Jersey (the “Port Authority”) and JEK Intemational Air Terminal LLC (JFKIAT") are aware that the United States Department of Transportation (“USDOT”), has determined that Kuwait Airways Corporation (“Kuwait Airways”) is violating federal anti-discrimination laws by failing to allow Israeli citizens to fly on Kuwait Airways between the U.S. (including at John F. Kennedy Intemational Airport, “JFK”) and third countries where Israeli passengers are allowed to disembark based upon the laws of that country. In a letter dated October 22, 2015, USDOT ordered Kuwait Airways to immediately cease and desist from discriminating against Israeli passengers. The Port Authority, as JFK airport operator, and JFKIAT, as operator of Terminal 4 at JFK, remind Kuwait Airways that its lease at JFK requires Kuwait Airways to operate in accordance with federal and state laws, and states that no individual on the grounds of race, color, ereed, national origin, sex, age, disability, or marital status shall be excluded from participation in, denied the benefits of, or otherwise subjected to discrimination in the use of Terminal 4. ‘The Port Authority and JFKIAT expect that Kuwait Airways will fully comply with these lease obligations.
