Welcome to the February Edition of the Law Bulletin.

President Pranab Mukherjee has approved

conferment of 112 Padma Awards. This years
Padma awards list comprises 10 Padma Vibhushan,
19 Padma Bhushan and 83 Padma Shri Awardees.
Among these awardees 9 are women and 10
persons from the category of foreigners, NRIs,
PIOs (include one posthumous) and 4 Posthumous
awardees.
Padma Vibhushan awardees include Yamini
Krishnamurti, Rajinikanth, Girija Devi, Ramoji Rao,
Dr. Viswanathan Shanta, Shri Shri Ravi Shankar,
Jagmohan, Dr. Vasudev Kalkunte Aatre, Avinash
Dixit and Dhirubhai Ambani(posthumous).
Some of the Padma Bhushan awardees include
Anupam Kher, Udit Narayan, Vinod Rai, Saina
Nehwal, Sania Mirza, Swami Dayanand
Saraswati(posthumous), Pallonji Shapoorji Mistry.
Prominent among the Padma Shri awardees are
Ajay Devgan, Priyanka Chopra, S S Raja Mouli,
Madhur Bhandarkar, Saeed Jaffrey (posthumous).
President Pranab Mukherjee has conferred the
countrys highest peacetime gallantry award Ashok
Chakra to Lance Naik Mohan Nath Goswami
posthumously, two Kirti chakras and 8 Shaurya
chakra awards.
Kirti Chakras were conferred on Subedar
Mahendra Singh and Sepoy Jagdish Chand
(Posthumous).
Shaurya Chakras were conferred on Colonel
Santosh Mahadik (Posthumous), Major Praphul
Kumar Bhardwaj, Major Sandip Yadav, Major
Anurag Kumar, Lieutenant Harjinder Singh, Naik
Satish Kumar (Posthumous), Naik Kheem Singh
Mehra, Sepoy Dharma Ram (Posthumous).

The 67th Republic Day was celebrated with the French

president Francois Hollande as the Chief Guest. The
gallantry and Padma awards were announced.
Presidents rule has been imposed in the state of
Arunachal Pradesh.
The Make-in-India week celebration in Mumbai was
marred by a fire on 14th February. The rescue
operation helped 7000 people to escape unhurt after
being evacuated within 10 minutes.
The 61st Britannia Filmfare Awards were given out
with the movie Bajirao Mastani winning 8 awards
including Ranveer Singh(Best Actor), Best Film, Sanjay
Leela Bhansali (Best Director), Priyanka Chopra(Best
Supporting Actress), Shreya Ghoshal (Best Singer),
Sham Kaushal(Best Action), Birju Maharaj(Best
Choreography) and Best Production Design.

67th Republic Day Celebrated

National
Presidents Rule imposed in Arunachal Pradesh
A political crisis erupted in Arunachal Pradesh after 21
out of 47 ruling Congress legislators in the 60-member
house rebelled along with 11 BJP and 2 independent
legislators and extended support to Kalikho Pul to form
new government. Arunachal Pradesh Governor Jyoti
Prasad Rajkhowa also had advanced the date of the
convening of the assembly session in order to check the
majority of ruling government in the assembly. The
state assembly failed to comply with the provisions of
Article 174 (sessions of the state legislature,
prorogation and dissolution) of the Constitution. As per
the provisions of Article 174, the session of state
assembly was to be held by 21st January 2016, six
months after the last sitting. But the state assembly
failed to comply with this provision which may lead to
constitutional
breakdown.
So
the
governor
recommended Presidents Rule in Arunachal Pradesh
under Article 356 (1) of the Constitution.
Rajesh Tacho, chief whip of the Congress Legislature
Party in the Arunachal Pradesh Assembly had
challenged in the Supreme Court the imposition of
Presidents rule alleging that Article 356 had been
misused by the Centre and the Governor to topple the
democratically elected Congress government. The
petition wanted the Centre and the Governor to
furnish records of the events culminating in the
proclamation of Presidents rule. The Supreme Court
ordered the Arunachal Pradesh Governor to respond
why he recommended Presidents rule. However, the
Supreme Court recalled the order within a few days
saying it made a mistake by not realising that
Governors have complete immunity and are not
answerable to courts for acts done in their official
capacity as per article 361(1) of the Constitution.
Start-up India, Stand-up India action plan launched
PM Modi has unveiled the Start-up India, Stand-up
India action plan to boost startup ventures in the
country. The main aim of action plan is to give impetus
to innovation and encourage the talent among young
people and remove onerous government regulations
and red tape.

India celebrated its 67th Republic day on 26th

January 2016 by displaying its cultural diversity,
economic progress and military might at Rajpath,
New Delhi. President Pranab Mukherjee unfurled
the national flag and took salute of the parade.
French President Francois Hollande was chief
guest of the Republic Day function.
The Parade was led by Lieutenant General Rajan
Ravindran. Women empowerment was visible as
women contingent of CRPF participated in the
parade. Apart from this, women officers
contingents of Indian Navy, Air Force and Coast
Guard also participated as 2nd in command. For
the first time in the history of Republic Day
parade, foreign contingent participated. It was the
76-member contingent - 35th Infantry Regiment
of the French Army led by Lt Col Paul Bury.
During the parade, diverse cultural and social
traditions, military prowess and achievements in
different fields were showcased. Indian Armys
missile firing capability, Mobile Autonomous
Launcher of the BrahMos Missile System, Infantry
Combat Vehicle BMP II Sarath, T-90 Bhishma tank
were also displayed. Indian airforce also showed
its might with C-17 Globemaster, 5 Jaguar Deep
penetration strike aircraft, 3 Sukhoi Su-30, 5 MiG
29 and other fighter choppers during fly past at
Rajpath. Armys dog squad from the Remount
Veterinary Corps also took part in the parade after
a gap of 26 years.
Another first in the history of the parade, the
tableau of ex-servicemen of Army veterans was
displayed. The tableaux from 6 Central Ministries
and 17 states and departments also displayed the
varied historical, cultural and architectural
heritage of the country.
New bird species named Himalayan Forest
Thrush discovered in India
Scientists have discovered a new bird species
named Himalayan Forest Thrush in northeastern
India and adjacent parts of China. It has been
given scientific name Zoothera salimalii after
ornithologist and naturalist Salim Ali who has
made significant contributions to ornithology in
India.

Outbreak of the Zika virus

Dogged determination of over 150 soldiers helped

by two canines, Dot and Misha, besides earth
penetrating radars and special ice cutting equipment
helped rescue Lance Naik Hanamanthappa Koppad,
who was buried under tonnes of ice at 19,500 feet
on the Siachen Glacier. On February 3, an 800x400ft
ice wall broke off and covered an army post in
northern glacier in Siachen, the world's highest
battlefield. The rescue teams had the arduous task of
breaking through 25-30 ft of blue ice, which is harder
than concrete, and had to chip it away inch by inch.
The bodies of nine soldiers were extricated from
their icy grave. Lance Naik Hanamanthappa Koppad
was pulled out of the debris and immediately
resuscitated by the doctors at the site. He was
treated with warm intravenous fluids, humidified
warm oxygen and passive external rewarming and
later moved to the Army and Research Hospital,
where he succumbed within a few days.

The World Health Organisation (WHO) has declared an

international public health emergency over the
explosive spread of the mosquito-borne Zika virus. It
was announced after WHOs emergency meeting of
independent experts headed by WHO Director-General
Margaret Chan. The meeting was convened in Geneva,
Switzerland to assess the outbreak of the virus which is
linked to birth defects in the Americas.
On another note, Hyderabad-based vaccines
manufacturer Bharat Biotech has announced a
breakthrough in developing the worlds first Zika
vaccine by developing two candidates. In this regard,
the pharmaceutical company has submitted two
vaccine candidates, one each of inactivated and
recombinant type to the Government. These two
candidates are in an advanced stage of development
and could be ready soon after pre-clinical studies
conclude in the next five months. The company already
has filed patents for both candidates in July 2015 and is
looking to start animal tests soon after getting
regulatory approvals for conducting clinical trials.

India hosts International Fleet Review

Indias Eastern Naval Command hosted the navies of
approximately 52 countries from 4th to 8th February
2016 for the International Fleet Review. More than
100 naval vessels participated in the review, which
involves a ceremonial inspection to showcase naval
readiness among other activities. Warships and
sailors from the Indian, U.S., Russian, Chinese,
Japanese, Australian, and South Korean navies,
among others, participated. The International fleet
review was held in the Bay of Bengal, off the coastal
city of Visakhapatnam in Andhra Pradesh. Indian
Prime Minister Narendra Modi, President Pranab
Mukherjee, and Chief of Naval Staff R.K. Dhowan
were in attendance.

France declares economic emergency
French President Francois Hollande has declared a
state of economic emergency to redefine Frances
economic and social model. Under the ambit of
emergency, government has proposed series of
economic measures to boost long-stagnant
economic
growth
and
reduce
chronic
unemployment.

Scientists discover gravitational waves

Scientists for the first time have discovered
Gravitational Waves (GW) that were hypothesised by
Albert Einstein in 1916. These waves were detected by
the scientists working at two LIGO (Laser
Interferometer
Gravitational-wave
Observatory)
facilities in United States.
The LIGO experiment has 4km long L-shaped tunnels
and uses lasers to measures changes in the distance
between two ends. When the GW enters into LIGO, it
stretches space and direction, and disperses space in
another direction i.e. these waves disturb the light
emitted lasers. Scientists by measuring the interference
(disturbances) of lasers light map the disturbed space
which has been compressed or stretched. Gravitational
waves are ripples in the curvature of space time which
propagate as waves, travelling outward from the source
at the speed of light. Predicted in 1916 by Albert
Einstein on the basis of his Theory of General Relativity.
Gravitational waves transport energy as gravitational
radiation and pass through matter without interacting
with it.

Spotlight: Hidayatullah National Law University, Raipur

"Dharma Sansthapanartham(for the sake of establishing the primacy
of the laws of eternal values) is the motto of Hidayatullah National Law
University, Raipur, established by the Government of Chattisgarh in
2003. HNLU is a Residential University. HNLU has been included in the
list of the Universities maintained by the University Grants Commission
under Section 2(f) of the UGC Act, 1956 and has been declared fit to
receive Central assistance.
Admission to the B.A.LL.B.(Hons.) Program is made strictly on the basis
