It has come to my attention that we have been running over budget in our Zoning Enforcement Officer line item.

Recently I reduced the Assistant Zoning Enforcement Officer's hours to zero.

As the ZED resource works to SUppOIt your respective commissions, I am asking that you review and sign off on the time cards submitted. Procedurally, this should happen prior to submitting same to our Accounting Department for payment. We need to get a better handle on time spent on behalf of your commissions and, where feasible, make some adjustments without sacrificing service to our residents.

Please keep track of the various efforts and duties performed for P&Z and IWWC and note any trends, This information will help as we formulate our budget for the coming fiscal year,

As you are aware, the Town of Burlington ("10'Wll") is conducting an investigation regarding potential timecard inaccuracies involving KmI Nilsen. I write to request your cooperation and participation in the investigation.

During the course of the ongoing investigation, Mr Nilsen informed the Town that he had a specific arrangement with you about how he completed his weekly timecards. I would like to meet with you to discussMr: Nilsen's statements in more detail.

I understand that you and First Selectman Bergstrom exchanged several e-mails regarding this matter Yom responses, however, do not provide adequate detail that allows the Town to move forward with the investigation 01 to protect its interests I trust that you can appreciate the seriousness ofthis situation. INDEPENDENT ACCOUNTANT'S REPORT ON APPLYING AGREED-UPON PROCEDURES

We have performed the procedures enumerated below, which were agreed to by Muschell and Simoncelli, LLP solely to assist. you with respect to the specified employee time record discrepancies of the Towns of New Hartford, Burlington and North Canaan for the period September 12, 2008 through January 28, 2010., The towns of New Hartford, Burlington, and North Canaan are responsible for the employee's payroll records" This agreed-upon procedures engagement was conducted in accordance with attestation standards established by the American Institute of Certified Public Accountants. The sufficiency of these procedures is solely the responsibility of those parties specified in the report Consequently, we make no representation regarding the sufficiency of the procedures described below either for the purpose for which this report has been requested or for any other purpose.

OUR PROCEDURES AND FINDINGS ARE AS FOLLOWS:

1.. We have documented the time records identified by the town of New Hartford as discrepancies, and determined whether overlapping hours can be identified, In addition, we reviewed the identified discrepancies for a lack of allowance for commuting time,

2. For each identified discrepancy that has been observed, we documented the time discrepancy in fractions of hours" Instances where a commute has not been accounted for was assigned a discrepancy of ,,50 hours, which is intended to estimate time from a desk at one location to a desk at the second location

3. We lndicatedthe nature of the discrepancy as either overlapping work hours or not accounting for commuting time between work locations.

4., We quantified an estimate, in dollars, of the time discrepancies, using a rate of $29 per hour, plus the employer's share of Social Security/Medicare taxes, which is 7,65% ot the first $107,000 of payroll. The $29 per hour rate has been provided to us by the Town of New Hartford as a fair estimate of the actual hourly rates paid by the various Towns to the employee

Sept, 2008 - January, 2010

General Assumptions;

1 When uncertain, the employee was given the benefit of the doubt, If AM and PM could not be determined from the timecard, the information was presented for the employee's benefit to eliminate any possible conflicts, or reduce the amount of conflicted time,

2 If the time worked could not be determined (paid based on # hours, with no actual time in a nd out documented), the date was not identified as a discrepancy,

ex: 1/6/09 in New Hartford

3 transportation time between locations was estimated to be 1/2 hour

4 If traveling between locations (leaving one location to work at another, then returning to the original location), it was counted as 2 trips,

5 When able to be identified, camp time off was not included so that the employee was available to work in another location

6 Employee was not allowed to work for Town "B" while "working" at Town "All A trip was included if time was allocated to another town In other words, if the employee billed another town for 1/2 hour while at original town, a trip to the town being billed was reported as an unaccounted trip"

If the employee returned to the original town, a return trip was calculated

Conclusion:

Our procedures were performed for the time period encompassing 36 New Hartford and Burlington two-week pay periods, which represent a maximum of 360 working days, less holidays and paid vacation, Of the days subjected to our procedures, 214 days had at least one discrepancy" We have provided the da iJy detail for your review Below is a summa ry of the identified discrepancies, quantified in hours,
