TitleI.ThePositionofYoungTrustee

Section1.NatureofthePosition
Oneundergraduatestudent,calledtheYoungTrustee,shallbeelectedeachyearasanomineeto
theBoardofTrusteestoserveatwoorthreeyearterm,thedurationofwhichwillalternate
yearly.AYoungTrusteemaynotservemorethanonetwoorthreeyearterm.TheYoung
Trusteemustresignattheendofthetwoorthreeyearterm.Forthefirstyearoftheterm,the
YoungTrusteewillbeanonvotingmemberoftheBoard.

Section2.EligibleCandidates
Firstyears,sophomores,juniors,andseniorsoftheundergraduatestudentbodyshallbeeligible
fortheYoungTrusteeposition.EligibleseniorsincludethosepersonsdesignatedasDecember
graduatesoftheseniorclass.ThecurrentDukeStudentGovernmentPresidentisnoteligibleto
runtobetheYoungTrustee.

Section3.ConflictofInterest
NoYoungTrusteemaybeanemployeeoftheUniversity(excludingworkstudy)oncetheterm
asYoungTrusteebegins.

Section4.DeadlineforElectionofYoungTrustee
ThenameoftheYoungTrusteemustbeplacedinnominationbeforetheBoardofTrustees
beforetheFebruaryBoardofTrusteesmeeting.

TheYoungTrusteeshouldmeetthefollowingcriteria,theinterpretationwhereofshallbeatthe
discretionoftheYoungTrusteeNominatingCommitteeandshallnotbegroundsforlitigation:
EvidenceanabilitytothinkbroadlyabouttheUniversity
BeabletocommunicatenotonlytheshorttermeffectsthattheBoardspolicieswillhaveon
students,butthelongtermeffectsaswell
Beabletoarticulateaworldviewaboutissueswithabreadthofunderstanding
Beabletospeakupinintimidatingsituationswhilerecognizingwhenandhowtodoso
DemonstratecommitmenttomakingDukeabetterplaceandhelpingfurtheritsmission
PossessanactiveinterestincontinuingtolearnabouttheUniversityandhowitworks
Offerevidencedemonstrating
their
goodcharacter.

Section6.OverviewofSelectionProcess
TheselectionprocessforYoungTrusteeshallproceedasfollows,subjecttotheotherprovisions
ofthisByLaw:
1. TheUniversitySecretaryor
their
designateandthecurrentDukeStudentGovernmentPresident
willsolicitapplicationsthroughtheOfficeoftheUniversitySecretarytoputtogethertheYoung
TrusteeNominatingCommittee(YTNC).
2. TheYTNCshallselecttwotofourYoungTrustee(YT)Finalists.

3. ThestudentbodyshallelectoneoftheYTFinaliststobeYoungTrustee.
4. TheYoungTrusteeshallbetheofficialnomineeofthestudentbodyforappointmenttothe
BoardofTrusteespursuanttorelevantBoardpolicies.

TitleII.TheYoungTrusteeNominatingCommitteeSelectionCommittee

Section1.SelectionoftheYoungTrusteeNominatingCommittee
TheUniversitySecretaryor
their
designateshallconductawellpublicizedapplicationand
interviewprocesstoselectthetwelvememberYoungTrusteeNominatingCommittee(YTNC).
TheUniversitySecretaryor
their
designateandtheDSGPresidentwillselectthemembersofthe
YTNC.AnyundergraduatemayapplytoserveontheYTNC.TheUniversitySecretaryandthe
DSGPresidentshallchooseasfewastenstudentstoconstitutetheYTNCandasmanyastwelve
members,andshallalsopreparearankedlistofalternates,consistingofapplicantstotheYTNC
whowouldbequalifiedtoservebutwerenotselected.TheUniversitySecretaryor
their
designateshallselectamentortoadvisetheYTNC.

Thementormusteitherbeamemberofthe
facultyoranadministratortotheuniversity.AtleastonememberoftheYTNCmusthavebeen,
orcurrentlybe,avotingmemberofaBoardofTrusteescommittee.Nomemberoforalternate
forYTNCmayapplyforYoungTrusteeinthatyearsselectionprocess.TheYTNCshallelecta
Chairfromwithinitsmembership.

Section2.AppointmentofAlternates
IfthemembershipoftheYoungTrusteeNominatingCommitteefallsbeloweightforanyreason,
alternatesshallautomaticallybeappointedtotheYTNC,intheorderthattheirnamesappearon
thelistpreparedbyTheUniversitySecretaryandtheDukeStudentGovernmentPresident,to
restorethemembershipoftheYTNCtoten.Ifthelistofalternatesisexhausted,theYTNCshall
choosevolunteersfromtheSenatetorestoreitsmembershiptoten.

Section3.Quorum
AquorumtotransactbusinessissevenmembersoftheYTNCortwothirdsoftheentire
membershipoftheYTNC,whicheverislesser.

interviewitself,mustbeapprovedbythementor.

UnderthedirectionoftheChair,theYTNCshallbymajorityvoteadoptmethodsofevaluation
andcommitteeoperatingproceduresinaccordancewiththoseoutlinedinthisByLaw.Such
methodsandproceduresshallinclude,butnotbelimitedto:
Anapplicationincludingquestionsandtheopportunityforacharacterreferencefromamember
oftheDukecommunity(faculty,staff,fellowstudent)
IdealqualificationsofYoungTrusteeFinalistsandNomineesincludingbutnotlimitedtothose
listedinTitleI,Section5
Thelengthandtermsoftheinterviewandquestioningperiodsforcandidates
ApredeterminedsetofquestionsincludingastandardizedquestionbatteryforallYT
semifinalistsandseveralspecificallytailoredforeachsemifinalist
Committeediscussionandvotingprocedureforeachround.

Section6:BiasTraining
Inordertopreventanyprevalenceofimplicitbias(basedonrace,gender,sexual
orientation/genderpreference,etc.),theYTNCChairwillorganizeaBiastrainingsessionwith
theOfficeofInstitutionalEquity.TheBiastrainingwilloccurbeforetheYTNCfirstreads
applications.

NomemberoftheYTNC,UniversitySecretaryor
their
designate,northeDSGPresidentor
their
designatemayformallyendorseacandidatethroughmeansofsocialmediaoractive
campaigning.Thisincludes,butisnotlimitedto,changingprofilepictures,postingonlineor
inpersoncampaignmaterials,anddoortodoorcanvassing.

Section8:UniversitySecretaryTraining
InordertoensurethattheYTNCiseducatedonthepurposeoftheYoungTrusteeposition,the
YTNCChairwillorganizeatrainingwiththeUniversitySecretaryortheirdesignateinthe
UniversitySecretarysoffice.ThistrainingwilloccurbeforetheYTNCfirstreadsapplications.

TitleIII.TheApplication,Interview,andElectionProcess

Section1.DisseminationofWrittenApplication
Awrittenapplication,approvedbymajorityvoteoftheYTNCpursuanttoSection6ofTitleII,
shallbedisseminatedtothestudentbodythroughtheOfficeoftheUniversitySecretarybefore
thelastdayoffallsemesterclasses.

Section2.InformationSession
Itisrecommended,butnotrequired,thattheChairoftheYTNCconductaninformationsession
inconjunctionwiththeDecemberBoardofTrusteesMeeting,oratanotherappropriatetime.
ThissessionshouldideallymaketheYTNCChair,acurrentYoungTrustee,andtheUniversity
Secretaryavailabletoprospectivecandidatesforquestionsanddiscussion.

Section3.DeadlineforWrittenApplication
Thedeadlineforsubmittingapplicationsshallbeset,andmaybeextendedforcause,bythe
YTNC.However,theSenateshallestablishadeadlinefortheYTNCtosubmitYoungTrustee
Finaliststheapplicationdeadlinemustbecoordinatedtoenablecompliance.

Section4.SelectionofSemifinalists
TheYTNCshallselectnofewerthaneightsemifinaliststobeinterviewedbythefullcommittee.
Inmakingthisselection,itshallobservethemethodsandproceduresadoptedpursuanttoTitle
II,Section6.Iftherearefewerthaneightapplicants,allshallbesemifinalists.Thenamesof
semifinalistsshallbepublished,andtheirapplicationsmadeavailabletostudentsonrequestto
thechairoftheYTNCandtheExecutiveVicePresidentofDukeStudentGovernment.

TheYTNCshallchoosenofewerthantwoandnomorethanfourofthesemifinaliststobecome
YoungTrusteeFinaliststhroughtheprocessdescribedinthissection.
EachsemifinalistshallbeinterviewedbytheYTNCsittingasafullcommittee.
TheYTNCshallthendeliberateonthesemifinalists,havingregardtobothwrittenapplications
andinterviews.
ThefullinterviewsshallbeaudiorecordedbytheChair,andnotredactedorotherwiseeditedin
anunfairorprejudicialmanner.Theseaudiorecordingsmustnotincludeanycommentaryfrom
membersoftheYTNCexceptfortheinterviewitself.Asemifinalistmayhaveaccessto
their
interviewrecordinguponformalrequesttotheChairoftheYTNCandtheExecutiveVice
PresidentofDukeStudentGovernment.NoindividualexceptforYTsemifinalistsmayrequest
accesstointerviewrecordings,andsemifinalistshaveaccessonlytotheirowninterview.These
recordingsmustbedeleted,destroyed,ormadeotherwiseinaccessibleimmediatelyafterthe
conclusionofvotingonthedayoftheYTelection.
Interviewsanddeliberationsshallremainclosedandconfidential.YTNCmembersmaynot
discloseinformationaboutinterviewquestions,individualcandidatesstanding,committee
deliberations,orvotingprocedures.
TheYTNCshalluseappropriateproceduresandvotingmethodsestablishedpursuanttoTitleII,
Section6toconductdeliberationsandselectatentativelistoffinalists.
Thelistoffinalistsmustbeapprovedbyatwothirdsvotetobecomeofficial.

Section6.GeneralRuleforDeliberations
Duringalldiscussions,committeemembersshallrefrainfromcharacterattacks,gossip,and
hearsay,butshallnotbepreventedfromdiscussingissuesrelevanttocandidatescharacter,
temperamentorqualifications.Thecandidateshouldbeconsideredbasedsolelyon
their
materialsandqualificationspresentedduringtheapplicationandinterviewprocess,without
takinganyoutsideknowledgeofthecandidateintoaccount.
TheChairshallhavetherighttorulelinesofdiscussionoutofordertherulingoftheChairmay
beoverturnedbyvoteofthefullcommittee.

Section7.CharacterReferences
Whensolicitingapplications,theYTNCmayrequestthatapplicantsprovideacharacter
referenceorletterofrecommendationforconsiderationbythecommitteeinfull.Thislettermay

bewrittenbyapeer,facultyorstaffmember,orothermemberoftheDukecommunity.No
memberoftheYTNC,UniversitySecretaryor
their
designate,mentor,andtheDSGPresidentor
their
designatemaywritealetterofreferenceorrecommendationforanapplicant.

Section8.ElectionoftheYoungTrustee
AnelectionshallbeheldtoelectoneofthefinalistsYoungTrustee.Theelectionshallbe
conductedpursuanttothegeneralrulesandproceduresoftheElectionByLawandassociated
legislation,butnowriteincandidatesshallbepermitted.AllDukeundergraduatestudentsshall
beeligibletovoteinthiselection.

TitleIV.ConflictsofInterestandRemoval

Section1.FormulationofGuidelines
BeforetheYoungTrusteeapplicationisdisseminatedtothestudentbody,theYTNCshall
formulateguidelinesforconflictsofinterestandrecusalspursuanttoTitleII,Section6.

Section2.InitialReview
Afterallapplicationsarereceived,themembersoftheYTNCshallexaminethelistofapplicants
andshalldisclosetothecommitteethepersonalandprofessionalrelationshipsthattheyhaveor
havehadwithapplicants,includingconflictsofinterestaswellasdeclaredacquaintancesthatdo
notimpairtheirobjectivity.Membersmayvoluntarilyrecusethemselvesfromaportionof
deliberationsandvoting,ormayresignfromthecommitteeiftheydeemitnecessary.

Section3.DisclosuretoApplicants
ThenamesofthemembersoftheYTNC,therelationshipstheydisclosed,andanyactions
voluntarilytakeninresponseshallbecommunicatedtotheapplicants.Withintwodaysofsuch
communication,anyapplicantmaypetitiontheYTNCtorecuseamemberforseriousconflictof
interest.TheYTNCshallthendiscussandvoteontheoptionofremovalunderSection4ofthis
Title.

Section1.RevisionofProcess
ThechairoftheYTNCisresponsibleforreviewingtheYoungTrusteeprocesseachyearandfor
solicitingfeedbackfrommembersoftheYTNC,YoungTrusteecandidates,andotherinterested
parties.AnyformalrecommendationsshallbesubmittedtotheDSGSenate,andamendmentsto
thisByLawmaybeenactedactedonlybythatbody.


Section2.Limitation
ThisByLawshallnotprecludethefutureelectionofadditionalmemberstotheBoardof
Trustees.

TitleVI.EnactmentandEffect

Section1.TimeofEffect
ThisByLawiseffectiveimmediatelyuponpassage.

Section2.RepealofConflictingLaws
ThepreviousYoungTrusteeByLawisherebyrepealed,andalllawsandusagescontrarytothis
ByLawareherebydeclarednullandvoid.

Section3.TransitionalProvision
ThevalidityofpreviouselectionsofYoungTrusteesshallbeinnowaycompromisedbythe
adoptionofthisByLaw.AllactionstakenpursuanttothepreviousYoungTrusteeByLawin
Fall2013shallretaintheirvalidity,andtheselectionprocessshallbecontinuedunderthis
ByLawfromthestagereachedbysuchactions.
