President Obama released the final budget proposal of his
Administration on February 9th. With most Americans
focused on the 2016 Presidential Elections, the budget was
released will very little fanfare from the beltway press corps.
However, the budget details the Presidents pursuit of legacy
issues, and has drawn the opposition of majority lawmakers
in the House and the Senate. Many potentially contentious
issues were settled in the budget deal and the debt limit
agreements struck late in the first session of the 114th
Congress. However, new battle lines are drawn in this
budget proposal that will give the President and Congress
plenty to spar over in this lame duck session.
With the passing of Supreme Court Justice Antonin Scalia, new fronts have developed in the
ongoing Battle of the Beltway. Much of the attention in DC beyond the election will focus upon
President Obamas nominee to sit on the high court, and rightfully so. However, hidden in plain

sight will be the ongoing skirmishes over the federal budget, and the path forward for many of
the Presidents agenda. While much political capital will be spent on both sides on the
Presidential election and the nominee to replace Scalia, it remains to be seen how much either
side is able to put into another round of budget wrangling. Last years late hour deals were
able to avert another government shutdown. But the toll may be that there is not enough left
in the tank for lawmakers to work out compromise in 2016. However, with an election
looming, and nobody in Washington looking to take the blame for shutting down the
government before voters have their final say, maybe the fuel for that compromise will be
found in the fight.

Month in Review
LEGISLATION
Public Law:
The President signed HR 644, the, Trade Facilitation and Trade Enforcement Act of 2015
into law on February 24th. The legislation is intended to streamline trade and improve
enforcement of US trade laws.

In the Senate:
The Senate voted to approve the conference report on HR 644, the Trade and Facilitation
and Trade Enforcement Act of 2015 on February 11th. This legislation was sent to
President Obama for approval on February 22nd.

In the House:
The House Transportation Committee marked up HR 4441, the Aviation Innovation,
Reform, & Reauthorization Act on February 11th. If passed, this legistlation would
reauthorize much of the Federal Aviation Adminstration, while also creating a private notfor-profit entity to control the national air traffic system. HR 4441 would also provide for
new guidelines for how the FAA certifies aircrafts fitness for the national aerospace system. This
legislation now awaits consideration on the House floor.
The House of Representatives passed HR 3293, the Scientific Research in the National
Interest Act of 2015, which directs the National Science Foundation to award federal
funding for basic research and education in the science through a new research grant only if
the NSF makes a written determination that the grant advnaces the state of science in the
United States, and meets certain other criteria.

On February 1, the House of Representatives passed HR 4168, the Small Business Capital
Formation Enhancement Act of 2015. If signed into law, this act is intended to instruct the
Securities and Exchange Commission to review the current status of problems and programs
relating to small business capital formation, and to review findings and recommendations to
improve small businesss access to capital sources.

The Department of the Navy published a Notice of Intent to Grant Exclusive License on
February 9th, to NCP Coatings, Inc., to practice in the field of use of manufacture and sale
of single-component moisture-curable coatings for commercial marine, architectural,
industrial OEM, automotive refinish, aerospace, and amusement park structural
applications to metallic surfaces which require abrasion and oil/grease resistance in the United States,
the Government-owned inventions described in U.S. Patent No. 9,139,753: Single-Component MoistureCurable Coatings Based on N-Substituted Urea Polymers with Extended Chains and Terminal

regarding the Navys possible sale of Twenty (20) each Joint Helmet Mounted Cueing System

The Federal Aviation Administration has published a Final Rule with regards to
Harmonization of Airworthiness Standards-Fire Extinguishers and Class B and F Cargo
Compartments effective February 16, 2016. This amendment eliminates certain regulatory
differences between the airworthiness standards of the FAA and the European Aviation
Safety Agency (EASA), without affecting current industry design practices. These changes ensure an
acceptable level of safety for these types of cargo compartments by standardizing certain requirements

The Federal Aviation Administration has published a Final Rule with regards to Standard
Instrument Approach Procedures, and Takeoff Minimums and Obstacle Departure
Procedures effective February 19, 2016. The actions are needed because of the adoption of
new or revised criteria, or because of changes occurring in the National Airspace System,
such as the commissioning of new navigational facilities, adding new obstacles, or changing air traffic
requirements. These changes are designed to provide safe and efficient use of the navigable airspace
and to promote safe flight operations under instrument flight rules at the affected airports. For more

The Small Business Administration has published a Final Rule modifying 36 employee-based
small business size standards for industries and sub-industries outside of the North
American Industry Classification System. Effective February 26th, The SBA rule increases 30
size standards for industries and three for sub industries, while decreasing size standards from 500
employees to 250 for three industries. Additionally, the rule eliminates the Offshore Marine Air

The US Department of State published a Notice of Membership for the Defense Trade
Advisory Group. The Bureau of Political-Military Affairs is interested in applications from
subject matter experts from the United States defense industry, relevant trade and labor
associations, academic, and foundation personnel. The purpose of the DTAG is to provide
the Bureau of Political-Military Affairs with a formal channel for regular consultation and coordination
with U.S. private sector defense exporters and defense trade organizations on issues involving U.S. laws,
policies, and regulations for munitions exports. The DTAG advises the Bureau on its support for and
regulation of defense trade to help ensure that impediments to legitimate exports are reduced while the
foreign policy and national security interests of the United States continue to be protected and
advanced in accordance with the Arms Export Control Act (AECA), as amended. Major topics addressed
by the DTAG include (a) policy issues on commercial defense trade and technology transfer; (b)
regulatory and licensing procedures applicable to defense articles, services, and technical data; (c)
technical issues involving the U.S. Munitions List (USML); and (d) questions relating to actions designed

The House Small Business Committee held a hearing on February 2nd, SBA Managment
Reivew: Oversight of the SBA's Entrepreneurial Development Offices, to examine current
policies and management practices within the SBA. The Committee heard testimony from
Tameka Montgomery, Associate Administrator, Office of Entrepreneurial Development; US

The House Committee on Science and Technology held a hearing on February 3rd, Charting

Looking Ahead
LEGISLATIONWith the beginning of the second session of the 114th Congress, House members and
Senators will shift focus to preparing the Fiscal Year 2017 budget, continue working on
authorization measures including those for DoD, NASA, and NOAA, and will begin preparing

The Department of Commerces International Trade Administration has published a notice
that it is organizing a Transportation Technologies, Equipment & Systems Trade Mission on
September 26-30, 2016 in Ankara, Izmir, and Istanbul, Turkey. The U.S.-Turkey
Transportation Industry Trade Mission is intended to include representatives from a variety
of U.S. transportation industry hi-tech equipment, systems and technology suppliers and service
providers. The mission will introduce these suppliers to Turkish business partners, industry
representatives, and to the Turkish municipal/government officials to learn about and benefit from
various transportation project opportunities in the country. The Government of Turkey has committed
to new investments in this industry to keep up with future demand which is expected to reach targets in
2023, the centennial of the Turkish Republic. Government of Turkey spells out investments totaling
almost $250 billion including $50 billion in aviation and aviation infrastructure. Trade mission
participants will have the opportunity to interact extensively with Commercial Service (CS) Turkey
specialists as well as USEAC offices to discuss industry developments, opportunities, and sales strategies.

Appropriations Status
House and Senate appropriators have begun to examine funding needs of the federal
government for Fiscal Year 2017. Hearings in the House and Senate will continue to identify needs and
priorities over the coming months as committee members and staff begin to prepare the agencies

NASA Reauthorization- Chairman Steve Palazzo introduced HR 2039, the National
Aeronautics and Space Administration Authorization Act for 2016 and 2017 on April 28th.
This is the second reauthorization act introduced by the House Space Subcommittee
Chairman, and follows HR 810, which passed the House, was introduced in the Senate, and

referred to the Senate Committee on Commerce, Science and Transportation. HR 810 was crafted to
provide authorization for FY2015. Neither bill has been brought to the Senate floor for debate nor vote.

Space Leadership-The House of Representatives is currently considering HR 2093, the
Space Leadership Preservation Act of 2015 which was introduced on April 29th. This
legislation was referred to the House Committee on Science, Space, and Technology. The
House Science Committee held a hearing to examine this proposal on February 25, 2016.
The purpose of this legislation is to provide long-term continuity to the nations national space program
by changing the term of the NASA Administrator to ten years, thus spanning across administrations, and
by creating a board with oversight responsibilities of NASAs space missions. No action took place on

National Academies/GAO studies:


The National Academies Air Force Studies Board is currently performing an examination of
Owning the Technical Baseline for Acquisition Programs in the U.S. Air Force. This study will
Identify the strategic value to the U.S. Air Force in properly controlling, as well as the risk of
not controlling, the technical baselines of its programs; investigate how others (e.g.,
services, government agencies, and commercial industry) control technical baselines and provide an
assessment on the most promising mechanisms for potential application within the U.S. Air Force;

investments that could be made (a) to improve the capabilities that have a high impact on the increased
science and technology return - thereby increasing the value of CubeSats to the science community and (b) to enable the science communities' use of CubeSats; and identify a set of sample priority science
goals that describe near-term science opportunities-- such as providing continuity of key measurements
to mitigate potential gaps in measurements of key parameters-- and that can be accomplished given the

The National Academies Space Studies Board is currently conducting a study, NASA
Science Mission Extensions: Scientific Value, Policies, and Review Process. The SSB report
will provide recommended guidelines for future NASA decision-making about such mission
extensions. In conducting this study, the committee could address the following questions:
Historically, what have been the scientific benefits of mission extensions? How important are these
benefits (for example, benefits that might only accrue during the extended mission phase but not
earlier)?; What is the current SMD Senior Review process for extending missions--for example, how are
reviews chartered and conducted, by whom, and using what criteria? What should be division
dependent and what should be uniform across the Directorate?; The NASA Authorization Act of 2005
requires biennial Senior Reviews for each mission extension. Is this biennial time period optimal for all
divisions? Would a longer or shorter time period between reviews be advantageous in some cases?;
Does the balance currently struck between starting new missions and extending operating missions
provide the best science return within NASA's budget? That is, how much of an acceleration of new
mission initiation could realistically be achieved by reallocating resources from mission extensions to
new programs, compared to the corresponding scientific loss from terminated or diminished mission
extensions? Are there innovative cost reduction approaches that could increase the science costeffectiveness of extended missions? Are there any general principles that might be applied across the
board or to all of the missions for an individual science theme or a particular class? Are there alternative
mission management approaches (e.g., transfer to an outside technical or educational institution for
training or other purposes) that could reduce mission costs during extended operations and continue to

and evaluation of NASAs Technology Roadmaps. This study will include a comparison of the
list of technologies in the 2015 draft of NASAs space technology roadmaps to the list of
technologies in the revised technology area breakdown structure that appears in the 2012
NRC report, "NASA Space Technology Roadmaps and Priorities: Restoring NASA's Technological Edge and
Paving the Way for a New Era in Space. The committee will identify the technologies that appear in the
2015 roadmaps that do not appear in the 2012 report and assess these new technologies using the same
prioritization criteria that were used to prioritize the technologies listed in the 2012 report. It will also
determine which of the new technologies should be added to (1) the list of 83 high-priority technologies
presented in the 2012 report and (2) the list of 16 highest priority technologies that also appear in the
2012 report. In addition the committee will recommend a methodology for conducting independent
reviews of future updates to NASAs space technology roadmaps, which are expected to occur every
four years. The recommended methodology should take into account the extent of the changes
expected to be implemented in the roadmaps from one generation to the next and the amount of time
since the initial comprehensive independent review of the roadmaps, which took place during the study

communities for an integrated and sustainable approach to the conduct of the U.S. governments
civilian space-based Earth-system science programs. The surveys prioritization of research activities
will be based on the committees consideration of identified science priorities; broad national
operational observation priorities as identified in U.S. government policy, law, and international

agreements (for example, the 2014 National Plan for Civil Earth Observation) and the relevant
appropriation and authorization acts governing NASA, NOAA, and USGS; cost and technical readiness;
the likely emergence of new technologies; the role of supporting activities such as in situ measurements;
computational infrastructure for modeling, data assimilation, and data management; and opportunities

The Federal Aviation Administration has published a Notice of Proposed Rulemaking for
Stage 5 Airplane Noise Standards. This proposal would establish a new noise standard for
certain subsonic jet airplanes and subsonic transport category large airplanes. This noise
standard, known as Stage 5, would apply to any person submitting an application for a new
airplane type design with a maximum certificated takeoff weight of 121,254 pounds (55,000 kg) or more
on or after December 31, 2017; or with maximum certificated takeoff weight of less than 121,254
pounds (55,000 kg) on or after December 31, 2020. This change would reduce the noise produced by
new airplanes and harmonize the noise certification standards for those airplanes certificated in the
United States with the new International Civil Aviation Organization noise standard in Annex 16, Chapter

The Department of Defense has published a Notice of Request for Public Comments
Regarding an Proposed Rule Change. DoD is proposing to amend the Defense Federal
Acquisition Regulation Supplement (DFARS) to improve the effectiveness of independent
research and development investments by the defense industrial base that are reimbursed
as allowable costs. Currently, contractors are required to (1) report Independent Research and
Development (IR&D) projects to the Defense Technical Information Center (DTIC) using the DTIC's online IR&D database and (2) update these inputs at least annually and when the project is completed. This
rule merely changes the web address for submission of this report and requires major contractors to
include in the report the name of the Government employee with which a technical interchange was
held prior to initiation of the IR&D effort and the date of such interchange. To receive consideration,

requesting comments on the Second Draft Environmental Assessment for the Kodiak
Launch Complex Launch Pad 3 (Second Draft EA). After taking into consideration the
nature of public comments received on the Draft EA, the FAA is providing the public with an opportunity
to review and comment on updates and clarification information that have since been added to the EA
