AUTHORITY AND CERTIFICATION:

I am commissioned by the chief of the Washington State Patrol as a Washington State Patrol Trooper, authorized to enforce all laws in the State of Washington. I have received Standardized Field Sobriety Testing (SFST) training from the Washington State Patrol. I have been trained and certified as a Drug Recognition Expert. Each test was conducted per my training. I have received BAC training and am certified to operate the BAC Datamaster COM. The breath test was conducted in accordance with my training.

INITIAL OBSERVATIONNEHICLE IN MOTION:

On May 2,2010, I was performing routine traffic law enforcement duties from 1900 hours to 0500 hours in Kitsap County while operating a fully marked patrol vehicle with emergency lights and siren.

At 0158 hours, I monitored the Kitsap County Sheriff's Department Radio Frequency that a Port Orchard Police Department Officer was requesting assistance with a DUI investigation and a phone call. I called Port Orchard Officer Wofford #715 who advised me he was requesting the Washington State Patrol to investigate a possible DUI and the suspect was the Port Orchard Mayor. I responded to the scene from the Silverdale area and while en route I notified my Supervisor of the pending contact with a public official. .

Upon arrival at 0216 hours, I contacted Officer Wofford #715 who advised me he was called to the area for a suspicious vehicle blocking in a newspaper delivery vehicle. When he contacted the vehicle (a 2010 Mini Cooper California License 6KAC574) he recognized the driver as the Mayor of Port Orchard, Lawrence F. Coppola. While speaking to Mayor Coppola, Officer Wofford detected the odor of intoxicants and suspected Mayor Coppola was intoxicated. Officer Wofford deferred the investigation to the Washington State Patrol.

PERSONAL CONTACT:

I contacted Mayor Coppola and observed he had watery bloodshot eyes and droopy eyelids. I immediately read Mayor Coppola his Constitutional Rights and Waiver from a Washington State Patrol Constitutional Rights Card due to his detainment prior to my arrival. I advised him I was going to ask him to perform some tests to ensure he was ok to be driving that night and he had the Right to refuse those tests. When asked if he had any physical limitations or injuries which would prevent him from performing those tests he replied he did not. As Mayor Coppola spoke I could smell the strong odor of intoxicants coming from his breath.

PRE-ARREST SCREENING:

Horizontal Gaze Nystagmus: During this test, Mayor Coppola turned his head several times as the test was started. I instructed him to hold his head with his hands to assist with keeping his head straight. I observed a lack of smooth pursuit, nystagmus at maximum deviation, nystagmus prior to 45 degrees (approximately 30 degrees), and vertical nystagmus. Throughout the test Mayor Coppola swayed in all directions.

Walk and Turn Test: During the instructional phase of the test, Mayor Coppola stepped off the line from the starting position several times and attempted to start the test twice before being instructed to do so. The walking portion of the test showed Mayor Coppola step off the line on step 2 and 4 while stopping on all steps. Mayor Coppola stopped on step 9 and asked which way to turn and stumbled while picking up both feet to turn left. The second half of the test showed Mayor Coppola miss heel to toe step 2, step off the line on step 4, step backwards nearly falling on step 5 while raising his arms for balance, and steps 8 and 9 were off the line.

All other tests were terminated due to a high level of intoxication and for safety.

I determined Mayor Coppola was extremely intoxicated and not able to operate a motor vehicle safely.

ARREST OF THE DEFENDANT:

At 0234 hours, I advised Mayor Coppola he was under arrest for DUI, placed him in handcuffs, and searched his person prior to placing him in the rear area of my patrol vehicle. Mayor Coppola asked if I could transport him home, allow him to drive home with me following, or walk home from the scene. He continued to say he believed he should not have been arrested "A hundred yards" from his house.

Mayor Coppola requested to have an attorney.

ARREST PROCESSING:

Mayor Coppola was transported to the Kitsap County Jail for processing. Upon arrival I Was able to locate a phone number for his attorney, Gary Chrey 360-876-4455, and called the attorney for him. At 0259 hours, Mr. Chrey was allowed to speak to Mayor Coppola alone for several moments and he requested to be present for the processing.

Mr. Chrey arrived at the jail and I continued with the processing. At 0338 hours, I read Mayor Coppola his Constitutionai Rights and Waiver from a Washington State DUI Arrest Report. When asked if he understood his Right's, Mayor Coppola stated "Yes I do." At 0341 hours, I read Mayor Coppola the Implied Consent Warning for Breath and when asked if he would give the samples of breath Mr. Chrey requested to consult with his Client. After a short consult, Mayor Coppola stated he would give the samples of breath.

Mr. Chrey advised Mayor Coppola would be exercising his Right to remain silent for questions.

Breath/Blood testing:

The defendant did not have anything to eat, drink, smoke, or vomit during the observation period. The BAC thermometer was within the required range of 34 degrees C+/- .. 2 degrees C. The RFI antenna was present, and the breath tube was warm/hot and flexible to the touch. The external standard was within the required range of .072 to .088.

When asked to do so, Mayor Coppola gave two samples of breath with a reading of .124 and .126 at 0413 hours and 0417 hours respectively.

RELEASE: Mayor Coppola was issued Citation C0772065 for DUI and released to Mr. Chrey pending the assigned court date.
