Scope of work includes welding inside the Tunnel Boring Machine's
structural shell. The TBM shell is situated outside the excavation, lying
on a concrete slab. Inside the TBM shell is a confined space. The TBM
shell is approximately 30 feet in diameter and 15 feet in height. The
workers were accessing the work area by crawling through a small gap
between the ground and concrete slab.
All work inside the TBM shell to stop and not continue until a hazard
assessment has been conducted by a qualified person and written confined
space procedures are in place.
Discussed proper access & egress, rescue procedures, ventilation and
personal protective equipment.

Scope of work on site includes the works yard & lay down area for the
tunnel segments and the north tunnel portal area. The works yard area
includes the Gantry crane, the grouting mixing area, compressor building
and equipment storage area.
The Gantry crane is mounted on rails and is used to transport tunnel
segments onto the multi-service vehicle(MSV) to feed the tunnel
construction. The manufacture of the Gantry crane, CIMOLAI TECHNOLOGY
S.P.A. will be on site to certify the rated capacity of the crane and Kova
Engineering will be the engineers on record.
In the north portal area, the Tunnel Boring Machine is being constructed.
The last section of the TBM's structural shell was located outside the
excavation on a concrete slab. Workers were welding inside the shell
without confined space procedures, proper access and no rescue procedures.
All work inside the TBM shell to stop and not continue until a hazard
assessment has been conducted by a qualified person and written confined
space procedures are in place.
Discussed proper ladder use, traffic control issues, proper access &
egress to all work areas, fall protection & guardrails, and first-aid and
rescue procedures.

INSPECTION NOTES
I attended this worksite March 14, 2014.
I attended this site as a result of an incident reporting a worker was struck with a hose that became dislodged from a vacuum
truck.
At this worksite EVER GREEN RAPID TRANSIT (EGRT) was identified as the prime contractor where SNC-LAVALIN BUILDERS
INC (SSJV) is coordinating the project's safety. BADGER DAYLIGHTING LIMITED PARTNERSHIP was identified as a contractor
hired to perform slurry clean up in the tunneling area.
I met with a representatives for EGRT and Badger Daylighting who provided details of the incident. They related that during the
process of setting up the PeterBuild carrier SN #1NPSX7TX5DD188852, lic. plate #EV0540, Unit #818,(hydro-vac), the 10 meter,
6 inch diameter hose became caught on the excavation shoring anchor. In an attempt to dislodge the hose a worker standing a the
bottom of the tunnel shaft was struck with the hose as it disconnected from the coupler, as a result the worker was transported to
the hospital with undetermined injuries.
This firm is in the process of completing and accident investigation. The investigation must be forwarded to the attention of Mario
Mena, Occupational Safety Officer, WorksafeBC, at fax # 604-232-1558 or e-mailed to mario.mena@worksafebc.com without
undue delay.
This employer may also be subject to further enforcement action arising out of orders cited in this inspection report or in
subsequent inspection reports that relate to he incident referred to this inspection report. Reference the following OSH Regulation.
A s per (WCA 173.(1).(c) did not involve injury to a worker, or involved only minor injury not requiring medical treatment, but had a
potential for causing serious injury to a worker.

Following the incident, an inspection of the equipment took place and was documented in IR #201416375021A issued to this
contractor including applicable orders.
The items discussed with the constractor included but they were not limited to the following:

-Operation according to Safe Work Practices
-Manufacturer's Instructions and Information
-Conformity to standards
-Restraining devices

I attended this worksite March 14, 2014.
I attended this site as a result of an incident reporting a worker was struck with a hose that became dislodged from a vacuum
truck.
At this worksite EVER GREEN RAPID TRANSIT (EGRT) was identified as the prime contractor where SNC-LAVALIN BUILDERS
INC (SSJV) is coordinating the project's safety. BADGER DAYLIGHTING LIMITED PARTNERSHIP was identified as a contractor
hired to perform slurry clean up in the tunneling area.
I met with a representatives for EGRT and Badger Daylighting who provided details of the incident. They related that during the
process of setting up the equipment (hydro-vac), the 10 meter, 6 inch diameter hose became caught on the excavation shoring
anchor. In an attempt to dislodge the hose a worker standing a the bottom of the tunnel shaft was struck with the hose as it
disconnected from the coupler, as a result the worker was transported to the hospital with undetermined injuries.
This firm is in the process of completing and accident investigation. The investigation must be forwarded to the attention of Mario
Mena, Occupational Safety Officer, WorksafeBC, at fax # 604-232-1558 or e-mailed to mario.mena@worksafebc.com without
undue delay.
This employer may also be subject to further enforcement action arising out of orders cited in this inspection report or in
subsequent inspection reports that relate to he incident referred to this inspection report. Reference the following OSH Regulation.
(WCA 173.(1).(c) did not involve injury to a worker, or involved only minor injury not requiring medical treatment, but had a
potential for causing serious injury to a worker.

Following the incident, an inspection of the equipment took place and the items discussed included but they were not limited to the
following:
-Equipment Maintenance and Daily Inspections
The employer advised that inspections are being done daily however no documentation was available on site for review. The
employer advised that drivers are required to perform the equipment's inspections before leaving the yard. This information was
verified by this office rin a meeting held at this employer's Head Quarters.
-Operation according to Safe Work Practices
The employer advised that as part of the procedures at any worksite and evaluation of the site is perform (risk assessment) to
ensure the use of the equipment is done in a safe manner. In this case the employer advised that the assessment performed did
not reflect the adequate use o of the equipment with respect to the length of hose being used and it's attachment. The operator in
this case did not exercised the identification of the hazards associated to connecting dig tubes as explained in the company
procedures.
-Manufacturer's Instructions and Information
The manufacturers instructions for the safe operation of the equipment was not available at the site or in the vehicle. In a meeting
held with the employer I advised the employer of this requirements and instructed to ensure the equipment is provided with the

-The 10 meters and 6 inch diameter flex hose being used was not adequately attached using clamps as suppose to duct tape.
-As recommended that an appropriate lifting device was not used to raise and lower dig tubes/hoses when exceeding for
excavations exceeding 20 feet or more.
This is in contravention of the Occupational Health and Safety Regulation Section 4.3(1)(b)(i).
The employer must ensure that each tool, machine and piece of equipment in the workplace is capable of safely performing the
functions for which it is used and is selected, used and operated in accordance with the manufacturer's instructions, if available.
Measures to Ensure Compliance:
Pursuant to section 194 (1) of the Workers Compensation Act, the employer must prepare a Notice of Compliance report. In
accordance with section 194 (2), this report must detail what has been done to comply with the order, and where compliance has

Inspection was initiated to review the surface provisions and systems for the tunneling operations using a pressure balanced
tunnel boring machine (TBM) for the Evergreen Light Rapid Transit system in Port Moody. A joint inspection included a safety and
hygiene Board officer during the inspection. Refer to the associated inspection report from the OSO, Mark Valastin for additional
compliance issues and orders.
Review of the emergency rescue plans has determined that the employer has proceeded to embed the TBM approximately 60
metres into the hillside on an initial advance to allow for the remaining 4 gantry sections to be positioned and made operational for
the continuance of the tunneling operations. The employer representatives have reported that they have planned for and
scheduled 15 workers for the rescue worker training provided through a local provider but did not have any trained rescue workers
available on shift at the time of the inspection. The initial advance to embed the TBM has essentially been completed without the
provisions and availability of the required rescue workers over the two shifts used to complete this work. Subsequently, the order
issued in this Inspection Report directs the employer to stop any further tunneling, excavation or advance of the tunnel operations
until the rescue personnel have been appointed, instructed, trained and appropriately equipped to render emergency rescue
services and all rescue workers have completed a drill of the rescue procedures to ensure an effective response capability.
Continuance of assembly and maintenance of the equipment as well as all associated work is permitted under the control and
limitations stated in the order.
Review of the tag board (i.e. brass board) indicated a number of deficiencies as indicated in the order. These deficiencies seemed
to be associated with or directly connected to inadequate supervisory review of the tag in systems as required. Ineffective
management of the tag in board was evident due to absence of timely checks and administration of the tag in rules. The tag board
also did not distinguish, make provision for or otherwise identify the underground supervisor, the above ground person or the
assigned rescue workers on shift.
The installation of the portal fan reportedly did not include an appropriate testing of the duct velocities provided by the equipment
specified in the ventilation proposal/plan. This plan is still being reviewed by the Board at this time. During the initial advance of the
tunnel to embed the TBM, there have been no duct velocity measurements at appropriate points to ensure the ventilation is
working to the design specifications and is continuing to operate to the parameters of the ventilation plan. Air measurements
following unspecified procedures were reported and documented through various points of the cross sectional area of the tunnel.
These readings indicated a range of flows between 150-400 feet per minute but with no interpretation of the data or explanation for
the fluctuations in these readings. The employer has been directed to provide this officer as a requirement of the application for
acceptance for the ventilation plan, a testing strategy for the testing of the non-conforming ventilation design required by
regulation. This strategy must include identification of all testing points and locations and the frequency of testing. Testing
procedures shall be prepared in writing to direct all qualified workers in the effective testing of the ventilation system and the
recording of the test results in the underground record to maintain a consistent recording of results of testing. These test results
must be reviewed and assessed by a qualified person in order to maintain and inspect the systems adequately.
Atmospheric sampling was indicated in the underground record however the recording of time was inconsistent in the record. Each
shift was not covered as there was only one qualified person testing the atmosphere during his assigned shift. Automated bump
testing and calibration was reportedly being done daily. There were no unusual test results reported to date in spite of a number of
air flow measurements appearing to present high readings on some of the records. These record anomalies were pointed out to
the tester and will require review and instruction to correct them. Plans for the sampling frequency during the tunneling operations
did not ensure start of shift sampling and sampling every 4 hours when internal combustion engines are being run in the tunnel.
The employer was directed to ensure that these sampling requirements are covered in the sampling strategy procedures for the
atmospheric testing.
The underground record was not being signed off and did not contain all required information and direction through an

underground supervisor. There was no provision for the record to include documentation, communication or direction of the
supervisors between shifts. Incident reporting or other reports such as drills for rescue proficiency were not provided for. A review
of the record is indicated with corrective actions as required to ensure a complete underground record is maintained.
The grout mixing and pumping station was also included in the inspection. Workers indicated MSDS were available in the office
however there was no instruction or direction provided to the operator, related to the precautions for handling, using, storing or
responding to spills related to the controlled products or hazardous products, with consideration to the information provided in the
MSDS. A label on the insulated tank in the spill containment area is also required. Large containers of carbon dioxide were also
located in the settling pond area that is used in water treatment. These containers have implications for emergency response in
the event of a leak that will require review and effective instruction to workers in proximity to the stored containers. Conditions
inside the water treatment shed should be inspected and assessed for potential unsafe conditions in the enclosed space
considering the use of carbon dioxide in the shed.

procedures, are available for rescue operations when workers are underground on shift. Specifically, the employer has been
operating the tunnel boring machine (TBM) and has pushed the tunnel from the north portal approximately 60 metres over the
last 3-4 weeks without ensuring the availability of rescue workers during the shifts involving mining. Workers are reportedly
scheduled for training on or about May 5-7. At the time of inspection workers were accessing the tunnel involved in the assembly
of the trailing gantry sections on the TBM, with no active boring/drilling going on.
This is in contravention of the Occupational Health and Safety Regulation Section 22.51(1)(b).
The employer must ensure that at least 5 workers holding certificates of competence in underground mine rescue valid in BC, or
other similar certification acceptable to the Board, who are trained in and capable of carrying out the established emergency
procedures, are available for rescue operations when more than 10 workers are underground on shift.
Measures to Ensure Compliance:
Additionally, the employers attention is directed to sections 22.51(1)(a+c) for the rescue worker requirements for smaller shift
numbers of workers.
The employer shall ensure no further operation of the tunnel boring equipment is permitted for the excavation of soils or the
advance of the tunnel forward until the required number of rescue workers have been instructed, trained, equipped as required in
the appropriate emergency rescue equipment and have completed/performed a drill of the emergency response procedures as
required.
Work associated with the assemble and maintenance of the tunnel boring equipment that requires entry into the tunnel will be
permitted to continue with the following controls, limitations and conditions:
1) all ignition sources, including welding and burning operations and the operation of internal combustion engines must be
effectively controlled to prevent fire through required fire suppression equipment or fire extinguishing equipment immediately at
hand to the work involving the risk of fire.
2) all hot work operations, involving the use of welding or burning equipment must have a fire watch system in place to check for
and respond to ignition sources and the potential for fire, during and for an appropriate period after the completion of any hot
work.
3) regular inspections of all work shall be maintained to ensure workers are not exposed to any developing conditions in the
tunnel that could hinder there egress from the tunnel in the event of an emergency situation, and
4) underground supervisors shall monitor and co-ordinate all underground work activities to ensure worker access and egress to
the tunnel is not compromised due to the work activities being performed in the tunnel.
Prior to allowing any further drilling/advance of the TBM, the Board officer shall review the steps taken to comply with the above
order to determine compliance and if appropriate shall cancel the order to allow work to continue.
Pursuant to section 194 (1) of the Workers Compensation Act, the employer must prepare a Notice of Compliance report. In
accordance with section 194 (2), this report must detail what has been done to comply with the order, and where compliance has
not been achieved by the time the report has been submitted, include a plan of what will be done to comply and when
compliance will be achieved. Please submit the report no later than May 2, 2014 .

Duct air velocities are not being measured at least once a week and/or any deficiencies are not being corrected. The existing
portal fan has been reportedly operated without any measurements of the duct velocities to ensure the fan performance and the
operational specifications for the ventilation system. Additionally, the only air flows being measured are the flows through the
cross sectional area of the tunnel, however the recorded readings ranged between 150-400 feet per minute at various locations
without interpretation of the data or established procedures to direct the testing strategies.
This is in contravention of the Occupational Health and Safety Regulation Section 22.25(1).
Duct air velocities must be measured at least once a week and any deficiencies must be corrected.
Measures to Ensure Compliance:
The employer shall provide a written testing strategy for the testing of duct velocities to ensure equivalent testing of the ventilation
system employed for the exchange of air in the tunnel. The fan specifications shall be assessed by a qualified person to ensure
that the tunnel ventilation system is meeting the initial ventilation plan submitted to the Board. This assessment shall be
forwarded to the Board officer without undue delay.

INSPECTION NOTES
A joint safety and hygiene inspection was initiated for the underground workings involving a tunnel boring machine (TBM) at this
work site. The TBM has advanced approximately 400 yards from the north portal installing a concrete-lined tunnel casing as the
TBM advances.
An electronic pass system has been installed to replace the standard tag/brass board for monitoring access to the tunnel. Air
monitoring is in place as required with no remarkable atmospheric conditions reported to date. TBM was not operating at the
time of the inspection as running ground has been detected in front of the TBM cutter head that will require a non-standard
approach to advance further. Plans and preparations for work methods to deal with this condition are underway. The employer is
advised that these conditions and the plans/work methods must be forwarded to the Board as per section 22.4 - New or unusual
situations.
Ventilation was operating and monitored as required. The auxillary fan on the TBM extracting air from the face had a discharge
duct connected with a short flex duct to allow the duct section to jog out towards the tunnel wall for access along a walkway. The
flex duct was kinking sharply due to excessive length in the flex duct section. This may alter the air flow if the flex duct collapsed
further. The flex duct should be shortened to prevent kinking. The employer is nearing completion of the plans for fan reversibility
acceptance with the additional details required by the Board engineer having been sent and awaiting response/acceptance.
Workers were maintaining the waste materials belt with lockout reported in place. Reviewed the requirements for lockout in detail
including the need to ensure all energy isolating devices are locked out as per written procedures, available to all workers who are
required to work on the machinery or equipment and the lockout is tested to ensure effective lockout of equipment and machinery
prior to workers entering "the bite".
A single restraint wire on a pneumatic bolt gun that was not being used at the time was observed detached. This was pointed out
to the safety manager and was corrected immediately. Effective means of restraint on hose or pipe connections was discussed
and suggested as a topic of a toolbox meeting.
Retroreflective tapes on hard hats was also discussed to ensure visibility of workers underground.
Operation of the boom lift mounted on the mobile car was observed.
Work areas were generally found clear and accessible. Numerous hazards such as confined spaces and fall protection areas were
posted with signs. Drills for tunnel evacuation and rescue have continued as required to maintain readiness of the rescue teams.
There were no violations of the Occupational Health and Safety Regulation or the Workers' Compensation Act noted at the time of
the inspection.

INSPECTION NOTES
No further enforcement action will be taken at this time as a result of any orders issued in this Inspection Report. Further
enforcement action may be considered if the orders relate to an incident under investigation by WorkSafeBC or other
circumstances warrant.
On December 03, 2014, Occupational Safety Officer, Brian Tuccori and I visited this workplace to investigate alleged unsafe
conditions related to the use and condition of a Rail Gantry Crane.
On December 02, 2014, a worker invoked their rights under Occupational Health and Safety Regulation (OHS) 3.12 and informed
their immediate supervisor that they refused to operate a Rail Gantry Crane due to alleged unsafe conditions related to an
end-stop travel limit switch that was non-operational and consequently, was removed by this employer. The worker advised, they
had reasonable cause to believe that the absence of the end-stop travel limit switch created an undue hazard to the health and
safety of workers.
At the time of our arrival at the workplace, the Rail Gantry Crane was observed being operated. This employer, SNC-LAVLIN
CONSTRUCTORS (WESTERN) INC. were preparing to initiate a general safety meeting that was attended by all workers present.
The Gantry Crane operator also attended the safety meeting and consequently, the Gantry Crane stopped operating.
Officer Tuccori and I conducted a meeting with a Plant Manager, Project Safety Manager and crane operators of this employer
and a Union Representative to investigate the alleged unsafe acts/conditions related to the Gantry Crane. The following
information was ascertained/observed:
A CIMOLAI Rail Gantry Crane, Model RGC30, Serial # 1311RGC028 was erected at the workplace and a
representative(Technical Director) of the manufacturer, CIMOLAI TECHNOLOGY SPA provided a Declaration of Conformity,
signed on January 22, 2014.
The Gantry Crane was inspected by KOVA ENGINEERING (BRITISH COLUMBIA) LTD. on January 21, 2014 (File #V23127). A
load test was performed at 110 % capacity and 125 % capacity to ensure beam deflection was within the manufacturers
specifications
The Engineering Certification, issued by KOVA ENGINEERING (BRITISH COLUMBIA) LTD. advised the Gantry Crane was
recommended for service.
Three designated crane operators operate the Gantry Crane on a daily basis. Three shifts typically occur within a 24 hour period.
Several Gantry Crane Daily Pre-Use Inspections, conducted by the crane operators for the Gantry Crane over a selected period of
time, were made available by this employer for review. Records of inspection related to the end-stop travel limit switch are as
follows;
- On October 14, 2014, a Gantry Crane Daily Inspection List for the day shift noted, "Gantry Not Operational, Brake issues, needs
attention."
- On October 16, 2014, during an afternoon shift, a Gantry Crane Daily Inspection List noted, "Brakes on the bridge are not
operational."
- On November 14, 2014 during a day shift (6 am - 6 pm) an operator identified an issue with an upper end stop travel switch as it
was not activating the braking mechanism of the bridge when traveling in a north or south direction. Gantry Crane Daily Inspection
List for day shift noted, "Crane is not operational, bridge not working.Electrician was requested at 06:20 hrs."
The employer advised, on November 14, 2014, the crane operator requested an electrician inspect the end-stop travel limit switch
and attempt to correct the problem. The electrician determined that the end-stop travel limit switch was not functioning properly.
The Gantry Crane bridge travels atop the beams in a north-south configuration and is prevented from falling from the beams via

an end-stop that is situated at the end of the beams. The end-stop travel limit switch automatically engages the brakes and
reduces the speed and stops the Gantry Crane before it can contact the end-stops. An electrician responded to the request and
the end-stop travel limit switch was removed, dried and reinstalled. The end-stop travel limit switch then functioned as normal for a
period of time.
NOTE:
No records of the repair were available at the workplace to confirm maintenance was performed on the Gantry Crane end-stop
travel limit switch.
Order #2 refers
- On November 15, 2014, during a day shift (6 am - 6 pm) a Gantry Crane Daily Inspection List for day shift noted, "Crane is not
100 % operational on early hours". Cold weather is bypassing safety features for the bridge."
- On November 17, 2014, during a night shift (6 pm - 6 am) a Gantry Crane Daily Inspection List noted, "Saturday night 3 times
bridge limit switch went down. This seems to happen when really cold out. is operating ok, no glitches but this is unsafe to operate.
If it continues will tag out. Have brought it to electricians attention."
- On November 18, 2014, during a day shift ( 6 am - 6 pm) a Gantry Crane Daily Inspection List noted, "Crane is operational, no
problems so far, believe the weather conditions make the crane non-operational (Bridge with no brakes), this issue has to be
addressed before the weather gets worse."
- On Dec 01, 2014, during a day shift (6 am - 6 pm) a Gantry Crane Daily Inspection List noted, "Crane is not operational the fact
that the crane doesn't have any brakes."
- On Dec 02, 2014, during an afternoon shift, a Gantry Crane Daily Inspection List noted, "Crane is not operational due to the fact
that limit switch has been removed and the bridge is not stopping. Safety Department has been advised, Union,
Foreman,Company and WorkSafeBC".
In the comments section of the inspection record. the crane operator noted the crane was not operated due to safety concerns.
Note:
The employer confirmed the upper end-stop travel limit switch was removed by an Electrician on December 01, 2014 and the
manufacturer of the Gantry Crane was contacted.
Again, no records of inspection or repair was available at the workplace to confirm maintenance was performed on the Gantry
Crane upper end-stop travel limit switch.
Order #2 refers
On December 03, 2014, Occupational Safety Officer Tuccori and I, were advised the upper end-stop travel limit switch on the
CIMOLAI 30 t Gantry Crane were non functional and were removed. During our partial site inspection of the workplace, the Gantry
Crane was observed being used and operated without the upper end-stop travel limit switch safety devices being operational.
Information and photographs were provided for review, that indicated the Gantry Crane had sustained visible damage and
deformation that may affect the safe operation of the crane.
An upper end-stop travel limit switch, that prevents the bridge of the Gantry Crane colliding with end-stops on the beams, was not
working on a consistent basis and due to the intermittent problems with the electrical safety device, the bridge collided with the

end stops.
Photographs indicated there was physical evidence of damage and/or deformation present to the upper end-stop located on the
beam in the north east corner of the Gantry Crane.
Additionally, an approximated 3/8 inch gap was present within a bolted structural steel connection located in the north west upper
corner of the structural framework.
Crane operators advised the bridge created an audible scratching noise when the bridge was under load and traveling in a
north-south configuration. Scratches on the painted inner surfaces of the beams were observed.
Furthermore, information was provided to WorkSafeBC that alleged the Gantry Crane was involved in an incident whereby, the
Gantry Crane was shock loaded.
Important:
Due to the aforementioned, WorkSafeBC instructed a Project Safety Manager of this employer, to ensure the Gantry Crane is not
used unless a professional engineer has certified the rated capacity of the crane in accordance with the applicable design or
safety standard specified in section 14.2. The employer agreed.
As per Order #1
The employer contacted KOVA ENGINEERING (BRITISH COLUMBIA) LTD to arrange for the gantry Crane to be inspected and
re-certified.
On Friday December 05, 2014 and Tuesday December 09, 2014, representatives of KOVA ENGINEERING (BRITISH
COLUMBIA) LTD visited the project and inspected the Gantry Crane
.
On December 05, 2014, electricians of this employer installed a new upper end-stop travel limit switch on the gantry Crane.
On December 09, 2014, this employer provided to WorkSafeBC certified documentation issued by KOVA ENGINEERING
(BRITISH COLUMBIA) LTD (Ref#V26796) that advised the Gantry Crane is recommended for service.
WorkSafeBC reviewed the certified documentation and the documentation was accepted.
On Tuesday December 09, 2014, I sent an email to this employer advising the documentation was reviewed by WorkSafeBC and
accepted. Furthermore, the Gantry Crane had been determined, by a professional engineer, to be safe for use and was able to
return to normal service.
As the employer implemented corrective actions prior to the issuance of this Inspection Report, the employer is deemed to have
complied with the order.

This employer was unable to provide any other records of periodic inspections conducted of the Gantry Crane at the workplace.
During the initial start-up period and operation of the Gantry Crane, the employer advised, several maintenance issues related to
the operation of the Gantry Crane occurred requiring electricians to repair and perform repairs and/or maintenance on the Gantry
Crane.
Safe performance issues related to the intermittent operation and function of an upper end-stop travel limit switch required
electricians to perform repairs that required the electronic safety device eventually being completely removed from the Gantry
Crane.
A maintenance worker of this employer welded steel plates on an upper end-stop in an attempt to repair the end-stop of the
Gantry Crane.
The aforementioned repair work tasks, performed on the Gantry Crane, were not documented and consequently, no records of
repair and/or maintenance for the Gantry Crane were available for review at the workplace.
This employer failed to ensure records of inspection and maintenance, meeting the requirements of Part 4 (General Conditions),
were kept by the equipment operator and other persons inspecting and maintaining the Gantry Crane.

Pre-use inspection
Any defects found during inspection or use of a crane or hoist must be recorded in the inspection and maintenance record system
and be reported immediately to the supervisor, who must determine the course of action to be taken.
If a defect affects the safe operation of the crane or hoist, the equipment must not be used until the defect has been remedied.
Workplace Conduct
"improper activity or behaviour" includes
(a) the attempted or actual exercise by a worker towards another worker of any physical force so as to cause injury, and includes
any threatening statement or behaviour which gives the worker reasonable cause to believe he or she is at risk of injury, and
(b) horseplay, practical jokes, unnecessary running or jumping or similar conduct.
Note: Worker means a worker as defined under the Workers Compensation Act, and includes a supervisor or other representative
of the employer (see Part 3, Division 1, section 106).

(1) A worker must not be subject to discriminatory action as defined in section 150 of Part 3 of the Workers Compensation Act
because the worker has acted in compliance with section 3.12 or with an order made by an officer.
(2) Temporary assignment to alternative work at no loss in pay to the worker until the matter in section 3.12 is resolved is deemed
not to constitute discriminatory action.

Note:
The employer was directed to ensure they conduct an investigation regarding the crane operators refusal of unsafe work. The
employer must ensure the manufacturer is involved in the investigation process to determine the cause of the failure of the
end-stop travel limit switch.
The employer agreed to review the site procedures for reporting unsafe acts and/or conditions observed at the workplace with
workers during a general safety meeting. Additionally, the employer agreed to review this employers rules and policies regarding
bullying and harassment with workers at the project.
Copies of the certified documentation issued by KOVA ENGINEERING (BRITISH COLUMBIA) LTD regarding the re-certification
of the Gantry Crane and confirming this employers compliance with Order #1, has been electronically attached to this document
for review and be entered into this firms history file at WorkSafeBC.

supervised an inspection of, and supervised any necessary repairs to, the equipment, and certified the equipment as safe for use
at the manufacturer's rated capacity for the equipment or as provided by section 14.16 if the manufacturer's rated capacity is not
available.
This is in contravention of the Occupational Health and Safety Regulation Section 14.16.1(2).
If a crane or hoist has been subject to a misadventure, it must be removed from service until a professional engineer has
(a) supervised an inspection of, and supervised any necessary repairs to, the equipment, and
(b) certified the equipment as safe for use at the manufacturer's rated capacity for the equipment or as provided by section 14.16

Occupational Safety Officer Mark Valastin and I conducted a general safety inspection of this employer's tunnel boring works yard
facility, north portal (tunnel entrance) area and associated equipment / machinery. We were accompanied on this inspection by the
employer's Safety Manager, Gantry Crane Operator (worker representative) and various Managers at numerous locations (yard,
plant, office).
The following safety violations were observed and subsequent Orders are issued on this inspection report:
1) Combination Crane Unit - Maintenance Multi-Service Vehicle (MSV)
- The Atlas, Type: 85.2 - A3 articulating boom crane (Serial # 100583) mounted on a Grue, Type: 85 Maintenance Multi-Service
Vehicle (MSV) carrier was purchased/supplied from Europe approximately one year ago. The crane manufacturers documentation
does not confirm the machine meets the North American Standards (ANSI/ASME). The employer's Safety Manager was supplied
Portions of the ASME B30.22-2005, Articulating Boom Cranes Standard for review.
SNC-Lavalin Constructors (Western) Inc. is ordered to STOP USE of this Atlas, Type: 85.2 - A3 articulating boom crane (Serial #
100583) mounted on the Maintenance Multi-Service Vehicle (MSV) until the Board is satisfied that this crane is safe and complies
with the Workers Compensation Act, Regulation, Standards and this order is cancelled by the Board
- The crane boom length is greater than 25 feet based on manufacturer's specifications, therefore the person operating this crane
must must possess a valid operator's certificate administered through the British Columbia Association for Crane Safety
("BCACS"). The employer's Safety Manager was supplied with Guideline G14.34 "Operator Certification" for review.
- The employer could not produce documentation confirming the combination crane (crane and carrier) were tested for stability to
confirm if the the crane manufacturer's load chart is applicable, safe to use in all operating quadrants (360 degree) or if a custom
load chart is required. The employer's Safety Manager was supplied with Guideline G4.8 "Stability Testing" for review.
- The Atlas, Type: 85.2 - A3 articulating boom crane has a manufacture supplied "man-basket" attachment that can be installed on
the boom tip. The lift of a person in a work platform suspended from or attached to a crane is defined by OHS Regulation as a
critical lift. The employer's representatives confirmed that in the past year, workers have been performing critical lifts without
required critical lift planning, including written pre-lift meetings being developed and documented. The employer's Safety Manager
was supplied with a draft, Crane Supported Work Platform Critical Lift Plan for review.
2) Non Certified - Davit Arm Hoist Support Structure
A non-certified, non-identified "shop built", 30" x 30" x 2" HSS - davit arm type hoist structure has been installed (Hilti bolted) onto
a concrete lock block with a 1/2 Ton "chain hoist" attached and holding the weight of a de-watering pump in the north portal area.
3) Transverse Conveyor - Conveyor Belt Mud Deflector Installation
Four pieces of 36" X 16' - "deflector" conveyor belting have been installed (chained) onto the, elevated, outer discharge walkway of
the "transverse conveyor", located at the "mud pit". The employer could not confirm the installation of this material is in
accordance with the manufacturer's instructions or as specified (certified) by a professional engineer.
4) Temporary Hazmat Storage Area Roof Structure
A temporary 12' x 20' tube steel roof structure located in the middle of the Hazmat storage area, on the west side of the office

building appears to be incapable of withstanding the stresses being imposed on it. Evidence is given but not limited to:
- the four metal legs being out of plum (splayed out)
- the back, metal, vertical structure being temporarily braced in the middle by a single, vertical 2" X 4" wood stud and shims
- the front, metal vertical structure being obviously out of level (sagging).

The following was discussed with Safety Manager, Gantry Crane Operator (worker representative) and various Managers at
numerous locations (yard, plant, technical) during this inspection:
1) Self Propelled Elevating Work Platform Annual and Daily Inspections
A Genie S-65 self-propelled elevating work platform was parked, not in use in the south west corner or the yard facility. A
inspection of the machine confirmed the annual inspection is not current, expired on February 6, 2015. The Safety Manager stated
the machine has not been used in the past month, has been parked and will remain out of service until the annual inspection is
completed and professional engineer certified documentation confirms the machine is safe for service . In addition, written and
documented daily pre-use inspection requirements were reviewed.
2) Gantry Crane Service Class Defined
As required by WSBC OHS Regulation and Standards for Gantry Cranes, this employer will define the "service class" for their
Cimolai RGC30 (30 Ton) gantry crane and confirm they are inspecting the machine in accordance with that service class. It was
confirmed this gantry crane was inspected and certified as safe for service by Kova Engineering with in the last month, therefore
well within the required inspection criteria of every service class, at this time.
3) Lock-Out Procedures
Regardless if tools are hard wired or plugged into electrical power, lock out procedures are required and available (posted). Small
tools include the drill press, table saw, lathe, hose fitting machine, etc.
4) Welding Ventilation
Permanent indoor welding location(s) must have local exhaust ventilation installed and used.

Pursuant to section 190(1) of the Workers Compensation Act, SNC-Lavalin Constructors (Western) Inc. is ordered to stop use of
this Atlas, Type: 85.2 - A3 articulating boom crane (Serial # 100583) mounted on the Maintenance Multi-Service Vehicle (MSV).
Pursuant to 190(4) of the Workers Compensation Act the Atlas, Type: 85.2 - A3 articulating boom crane (Serial # 100583)
mounted on the Maintenance Multi-Service Vehicle (MSV) subject to this order must not be used until the Board is satisfied that
this crane is safe and complies with the Workers Compensation Act and the regulations and this order is cancelled by the Board.

been operated at this workplace for approximately one year, by numerous workers that do not have a valid operator's certificate
issued by a person acceptable to the Board.
This is in contravention of the Occupational Health and Safety Regulation Section 14.34.1(a).
On and after July 1, 2007, a mobile crane, tower crane or boom truck must be operated only
a) by a person with a valid operator's certificate issued by a person acceptable to the Board, and

This crane can only be returned to service, operated by a person with a valid operator's certificate issued by a person acceptable
to WorkSafeBC (Board).
Operators of mobile cranes, tower cranes, and boom trucks must possess a valid operator's certificate. Crane operator
certification is administered through the British Columbia Association for Crane Safety ("BCACS"), in conjunction with the Fulford
Harbour Group Ltd. ("FHG"), and the Industry Training Association ("ITA").
Section 14.34.1 applies to operators of all mobile cranes, boom trucks, and tower cranes with a rated capacity equal to or greater
than five tons or with a boom length of 25 feet or greater based on manufacturer's specifications.

The rated capacity of a machine or piece of equipment must be certified by a professional engineer if in the opinion of the Board,
the provision of such certification is deemed necessary.
Measures to Ensure Compliance:
Prior to returning this crane to service, the employer must provide professional engineer certified documentation confirming the
combination crane has been tested for Stability. That Stability document must confirm the crane is safe to use with either the
crane manufacturer's load chart or refer to a custom load chart that has been issued and certified by a professional engineer.
The crane manufacturer cannot provide a load chart(s) that considers the stability of the combined crane and carrier or the ability
of the carrier to support the crane. The load chart provided by the crane manufacturer is the maximum that could be expected
from that equipment but it may have to be reduced if the carrier to which it is mounted is incapable of supporting the crane
loaded to the crane manufacturer's indicated capacity.
The crane can only be tested for stability after the crane has been mounted to the carrier.
The load chart for the combined crane and carrier needs to show the capacity that is the lower of that determined from the
stability testing and the capacity that was provided by the boom manufacturer. The load chart needs to show the capacity relative
to the portion of the swing circle to which it applies in a work area diagram (360 of swing).
ASME B30.22 Articulating Boom Cranes requires that a unit test, not a type test, is performed for each combination unit as
described in SAE J765 Stanadard for Stability Testing.

of that crane, hoist or other piece of powered lifting equipment,
(c) a tandem lift involving the simultaneous use of more than two cranes, hoists or other pieces of powered lifting equipment,
(d) a lift of a person in a work platform suspended from or attached to a crane or hoist,
(e) a lift in which the centre of gravity of the load changes during the lift,
(f) a lift in which the length of one or more sling legs changes during a lift,
(g) a lift by a crane, boom truck or hoist, supported on a floating base, that exceeds 90% of rated capacity for the lifting system,
(h) a lift of a load over or between energized high voltage electrical conductors, or
