Dear Mr. Giliberto:
Under provisions of the New York state Freedom of Information law, I hereby request
to inspect and copy as needed certain documents maintained by the Department of Public
Service. I make this request on behalf of the Democrat and Chronicle, the USA Today
Network, the Gannett Co. and myself.
Specifically, we request copies of records of service outages reported to the department
for 2013, 2014, 2015 and to date in 2016, if available, by cable television utilities Time
Warner Cable, Cablevision and Charter Communications.
If possible, these records should show location and duration of each outage and indicate
whether television service or Internet service or both were lost during each outage.
If raw data are available that recorded each outage and each portion of the service
territory affected, then that would be ideal. If that is not available, then the prepared
reports or summaries that have the greatest degree of geographic and temporal detail
would be our next preference.
Please provide the records in electronic form in accord with the law. If the cost of
preparing or transferring the documents exceeds $25, please notify me before proceeding.
If arrangements must be made to transfer large amounts of data, please contact me.
As you know, the state FOI law requires an agency to respond within five business days
of receipt of a request. If you deny the request, please indicate which part of Section 87
of the Public Officer's Law you are relying on and provide an explanation of why you
believe the document falls under the exemption cited as a basis for denying the request.
