In regards to the tragic death Ms. Dawn Brancheau on Feb 24, 2010: I was at the 12:30 pm "Believe" killer whale show on February 24th with my family and I am dismayed over reports that continue in the news media by SeaWorld staff (primarily those of SeaWorld's Animal Care Curator Chuck Tompkins) that there was no indication that the Killer Whales were behaving abnormally prior to Ms Br~ncheau's tragic death. While this may be true of the few minutes immediately preceding the attack during the "Dining with Shamu" segment, problems were evident during the "Believe" killer whale show approximately 30-45 minutes prior. I am not an animal expert, but my observations were that the whales were not behaving as anticipated. I would have to imagine that SeaWorld tapes its performances and/or has provided you with access to its security footage which would clearly show that the whales were not behaving as expected. During the final segment of the show in which the whales are supposed to "splash" the crowd, after only two splashes from the whale'B tail, (unsure if this was the whale known as Tilikum), another whale entered the main pool and the two of the whales aet-off at a high rate of speed, chasing

~- each other aggressively While staff manually operated the pool's gates to separate the whales. In hindsight, it appears there was a problem with the gate (gate to the far right, facing the stage) because all other portions of the show appeared to be automated. Even after being given a "cool down" period of 5-10 minutes prior to resuming the "splash" portion of the show ... the show ended abruptly after the whale continued to not participate. From a layman's view, it appeared that the whales were agitated, uncooperative and focused on things other than performing. Shortly thereafter Ms. Brancheau was killed during the "Dining with Shamu" segment.

I provided this statement to Seaworld on 02-28-2010 via their online e-mail form asking that this information be forwarded to interested parties. The response that I received from them did not indicate that this information would be passed along. I am unsure what, if any, role these behaviors mayor may not have had leading to the tragic death. I would hope that SeaWorld's pOlicies would dictate certain behaviors and restrictions when faced with uncooperative "performers" and I believe that Ms. Brancheau's death could have been avoided if tighter restrictions were in-place, and followed, when faced with this abnormal behavior.
