CITY OF MORRIS ORDINANCE NO. _3176 APPROVING AN AMENDMENT TO THE CITY OF MORRIS ‘TAX INCREMENT FINANCING REDEVELOPMENT PLAN AND PROJECTS WHEREAS, the City of Morris by its duly elected Mayor and City Council heretofore adopted a Redevelopment Plan and Projects, designated a Redevelopment Project Area; and adopted Tax Increment Financing pursuant to Illinois Revised Statutes Chapter 24, Division 11- 744-1, et. Seq. (now 65 ILCS 5/11-74.4-1) (the “TIF Act”) known as the City of Morris Tax Increment Financing Redevelopment Project Area, TIF District 1; and WHEREAS, the City of Morris, Grundy County, Illinois desires to amend the Redevelopment Plan and Projects for its TIF District pursuant to the Tax Increment Allocation Redevelopment Act, 65 ILCS 5/11-74.4 et. seq., as amended; and WHEREAS, subsequent to the formation of the TIF District the City has entered into Redevelopment Agreements to assist in the private redevelopment of properties within the Redevelopment Project Area for the benefit of the citizens of the City; and WHEREAS, the City has also developed public projects within the Redevelopment Project Area for the benefit of the citizens of the City; and WHEREAS, the City may enter into Intergovernmental Agreements with or make capital contributions to taxing districts which levy taxes within the TIF District pursuant to the TIF Act; and WHEREAS, the City has entered into agreements for the administration of the Redevelopment Plan and Projects; and WHEREAS, subsequent to the creation of the TIF District, the City may also create other TIF District which are contiguous to TIF District 1 and it is contemplated in each of these ‘TIF Districts that eligible redevelopment costs in those TIF Districts may be paid or reimbursed from increment generated within TIF District 1 and increment generated within those individual Districts may be used to pay or reimburse eligible costs of TIF District 1; WHEREAS, the City wishes to ratify, confirm and incorporate all private redevelopment agreements, public projects, intergovernmental agreements, and other eligible redevelopment projects and costs into the TIF Plan and Projects for TIF District 1 and, to the extent required by the Act, to amend and incorporate them in the TIF Plan and Projects of the TIF District. WHEREAS, the City wishes to add additional projects and costs to Exhibit C of the Redevelopment Plan and Projects by adding the items in Exhibit 1 attached hereto; and WHEREAS, the proposed amendment does not alter the exterior boundary of the Redevelopment Project Area; affect the general land uses established pursuant to the Redevelopment Plan; or change the nature of the Redevelopment Projects; and WHEREAS, the proposed Amendment is consistent with the Plan and Projects and has been reviewed by the City Council and the Council is generally informed of these Projects, NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF MORRIS, GRUNDY COUNTY, ILLINOIS: 1. The recitals set in the preamble to this Ordinance are hereby incorporated by reference as if fully set forth herein. 2. The Redevelopment Plan and Projects are hereby amended to include all private redevelopment agreements, public projects, contributions to other taxing districts, administrative agreements, and all other eligible redevelopment costs entered into or undertaken heretofore as permitted under the TIF Act and, further, all such agreements, projects and costs are hereby ratified. 3. The Redevelopment Plan and Projects is hereby amended to provide that eligible redevelopment project costs in any existing or future TIF Districts which are or may become contiguous to TIF District 1 may be paid or reimbursed from increment generated within TIF District 1 and increment generated within those individual TIF Districts may be used to pay or reimburse eligible costs of TIF District 1; 4. The City may enter into Intergovernmental Agreements with taxing districts which levy taxes within the TIF District pursuant to the TIF Act. The Redevelopment Plan is hereby Amended to provide for these eligible redevelopment project costs as permitted under the TIF Act. 5. This Ordinance shall be in full force and effect from and after its passage and approval as provided by law and shall take affect immediately upon its passage due to the urgency of amending the Tax Increment Redevelopment Plan and Projects, 6. Exhibit C of the Redevelopment Plan and Projects previously adopted and amended with regard to Tax Increment Financing District is hereby amended to include the items set forth in Exhibit 1 attached hereto. 7. All ordinances and parts of ordinances in conflict herewith are repealed. ADOPTED by the City Council of the City of Mortis, Illinois, on the 2: day of October A.D., 1999, and deposited and filed in the Office of the City Clerk of said City on that date.
