I.

MEMORANDUM OF POINTS AND AUTHORITIES STATEMENT OF THE FACTS.

3 On May 5, 2010, Plaintiffs filed their Complaint and a Summons was issued for service

4 on Defendant Christopher Greco ("Greco"). An Amended Complaint was filed on May 12,

5 2010. Since the filing of the Complaint, Plaintiff s counsel has been attempting to effectuate

6 service on Greco without success.

7 In trying to locate Greco there have been attempts at multiple locations with no success.

8 See Affidavits of Due Diligence, attached hereto as Exhibits 1-2. Clearly, Plaintiffs have

9 exercised due diligence to locate the Greco and has found no information that would lead to his

10 whereabouts. Therefore, Plaintiffs have submitted this Application for Order for Service by

11 Publication and Enlarging Time for Service.

II.

LEGAL ARGUMENT.

NRCP 4 allows for service by publication and for an enlargement of time to effectuate

Pursuant to 4( e)( 1 )(ii), this Court has the authority to enter an Order allowing the

Plaintiffs to serve Greco via publication. Also, pursuant to NRCP 4(i), this Court has the authority to enlarge the time to effectuate service. As demonstrated below, the Plaintiffs have satisfied the requirements of NRCP 4, and thus the Court should enter an Order allowing an

enlargement of time for service of Greco by publication.

A.

PURSUANT TO NRCP 4(E)(1)(II), SERVICE BY PUBLICATION IS PROPER.

This Court should Order service by publication upon Greco. N.R.C.P. 4(e)(I)(ii) permits

service by publication in

... any action which relates to, or the subject of which is, real or personal property in this state in which such person defendant or corporation defendant has or claims a lien or interest, actual or contingent, therein, or in which the relief demanded consists wholly or in part of excluding such person or corporation from any interest therein, and the said defendant resides out of state or has departed from the state, or cannot after due diligence be found within the state, or by concealment seeks to avoid the service of summons, the judge or justice may make an order that the service be made by the publication of summons; said service by publication shall be made in the same manner as now provided in all cases of service by publication.

1 In this case, the attached Affidavits of Due Diligence support Plaintiffs' Application for

2 service by publication. Plaintiffs have exercised due diligence in attempting to locate Greco

3 including, but not limited to accessing the assessor's records, the secretary of state records, local

4 telephone directories in area's where Greco has been known to reside, United States post office

5 records and other national databases, all to no avail. Accordingly, service by publication of the

6 Summons and Amended Complaint in this instance is not only proper, but necessary in order to

7 notify Greco of this lawsuit.

B.

LEAVE OF COURT TO EXTEND TIME FOR SERVICE BY PUBLICATION.

10 Plaintiffs respectfully request a 90 day extension of time in which to effectuate service by

11 publication on Defendant Greco. Plaintiffs' Complaint was filed with the Court on May 5, 2010

12 and pursuant to N.R.C.P. 4(i), service of the Summons and Complaint must be effectuated 120

days thereafter, on or before S eptem ber 2, 201 O. The Nevada Supreme Court has set forth the

criteria to evaluate in considering a Motion to Extend Time for Service in Scrimer v. Eighth

Judicial District Court, 116 Nev. 507, 998 P .2d 1190 (2000). Specifically, the Court provided

that a district court should consider the following factors with no single factor controlling the

determination: (1) difficulties in locating the defendant, (2) the defendant's efforts at evading service or concealment of improper service until after the 120 day period has lapsed, (3) the

19 plaintiffs diligence in attempting to serve the defendant, (4) difficulties encountered by counsel,

20 (5) the running of the applicable statute of limitations, (6) the parties' good faith attempts to

21 settle the litigation during the 120 day period, (7) the lapse of time between the end of the 120

22 day period and the actual service of process on the defendant, (8) the prejudice to the defendant

23 caused by the plaintiffs delay in serving process, (9) the defendant's knowledge of the existence

24 of the lawsuit, and (10) any extensions of time for service granted by the district court. The

25 Supreme Court has further reiterated its well settled position that "good public policy dictates

26 that cases be adjudicated on their merits." Scrimer, 116 Nev. At 516, 998 P.2d at 1196.

27 Here, the above factors support granting Plaintiffs' request for an extension of time.

28 First, Plaintiffs have encountered substantial difficulty locating Greco. Plaintiffs do not have a

1 social security number for Greco nor does he reside at any of the addresses identified by

2 Plaintiffs as possible residences or places of business. Consequently, Plaintiffs have had

3 substantial difficulty locating Greco. Second, one would hope that the Defendant is not trying to

4 evade service. However, given his history with the Plaintiffs and statements he has made to

5 others, it is possible he has gone into hiding. Third, as demonstrated by the Affidavits of Due

6 Diligence attached hereto, within less than week after filing the instant Complaint, the Plaintiffs

7 provided a process server with the documentation to be served on Greco. That process server

8 took considerable steps to try and locate Greco without success. As such, Plaintiffs have

9 diligently attempted to effectuate service. Fourth, the difficulties in locating Greco were

10 exacerbated the lack of any other information specifically personal to Greco. Fifth, the statute of

11 limitations has not run nor have there been any settlement discussions during the 120 day period.

12 There will be no prejudice to Greco caused by the delay in effectuating service. Finally, no other

extensions of service have been granted by the Court.

Accordingly, Plaintiffs submit to the Court that the Scrimer factors have all been satisfied and none of the parties to this action will be prejudiced by an extension of the time to allow Plaintiffs to effectuate service by publication. Furthermore, the Affidavits of Due Diligence attached hereto prove that personal service of the Summons and Complaint cannot be effectuated

upon the Greco, and therefore, an extension of time is necessary.

1 III. CONCLUSION.

2 Given that the information regarding Greco has been insufficient to effectuate personal

3 service, service by publication is proper and, therefore, good cause exists for an enlargement of

4 time for publication. Plaintiffs respectfully request that the Court order service of the Summons

5 and Complaint on Greco by publication and that the Court extend Plaintiffs' time for service for

6 a period of 90 days.
