‘WHEREAS, reports on the delivery of official ballots, accountable forms and
other election paraphernalia indicate that there will be delays in the arrival thereof at
the polling centers in time for the opening of polls on October 25, 2010;
WHEREAS, the delay will affect the conduct of voting, counting and canvassing;
NOW, THEREFORE, the Commission on Elections, by virtue of its powers
vested in it by the Constitution, the Omnibus Election Code and other election laws,
RESOLVED, as it hereby RESOLVES to promulgate the following guidelines in cases of
delay in the delivery of official ballots and other election forms/paraphernalia on
election day, October 25, 2010:
SECTION 1. Assessment. — The Election Officer, the city/municipal treasurer
and the Board of Election Tellers (BETS) shall determine the time of arrival of the
officials ballots, accountable forms and other election paraphernalia at the polling
center and thereafter, assess whether the same will arrive at the polling centers before
or after 12:00 noon of election day.
SEC. 2. Extension of voting hours. — If based on the joint assessment of the
Election Officer, City/Municipal Treasurer and the BET concerned, the official ballots,
accountable forms and other election paraphernalia for a particular precinct will arrive
at its designated polling center before 12:00 noon of October 25, 2010, voting
shall immediately start and continue up to 5:00 o'clock in the afternoon. Ifafter 5:00 o'clock in the afternoon, there are still voters present who have not yet cast
their votes, Section 23 of Comelec Resolution No. 9030 dated September 21, 2010 shall
apply.
Sec. 2. Postponement of election. — If the official ballots, accountable forms
and other election paraphernalia for a particular precinct will arrive at its designated
polling center after 12:00 noon of October 25, 2010, election shall be
postponed and reset to the following day, October 26, 2010, or if it is not
feasible, on the next day, October 27, 2010.
Voting, counting and canvassing shall continue in precincts not affected.
Notwithstanding the postponement of the elections in the affected precincts, the
Barangay Board of Canvassers (BBOC) may proclaim the winning candidates whose
election will not be affected by the number of votes to be cast in the precinct/s where
the voting has been postponed. If the number.of votes to be cast in the postponed
precincts will affect the result of the election, the BBOC shall suspend its proceedings
and reconvene at 6:00 o'clock in the evening of October 26, 2010 or if it is not
feasible, on October 27, 2010.
Sec. 3. Announcement of postponement of elections. ~ The Election Officer
shall announce the postponement of elections in the polling centers affected and the
date of resetting of elections.
Sec. 4. Reportorial procedure. — The Election Officer shall inform the Comelec
National Command Center at the Central Office of the precincts where elections have
been extended or postponed pursuant to this Resolution, not later than 6:00 o'clock in
the evening of election day. Within three (3) days from the conduct of elections, the
Election Officer shall submit a written report where elections have been extended or
postponed, to the Election and Barangay Affairs Department.
Let the Election and Barangay Affairs Department implement this Resolution.
