Fayette County Ordinance Sec. 8-260. Stop-Work Orders. “stop work orders shall apply to all activity on the site with the exception of the installation and maintenance of temporary or permanent erosion and sediment controls”

CITATIONS: • Are always an option • Are a good deterrent • Can take upwards of 45 day + to get into court • Are used in Fayette County as a last resort.

COMPLIANCE IS OUR GOAL! CITATIONS IN SOME CASES DO NOT SPEED UP COMPLIANCE ISSUES.

EXAMPLE OF CURRENT CITATIONS IN FAYETTE COUNTY: • A residential 23 acres parcel disturbing 13 acres • Has been issued 2 citations • A legal brief from the solicitor is due by November 23, 2010 • Currently the developer is working on compliance • If the site comes into compliance the charges will be dropped.

Here is an example of a violation Fayette County has file with the GAEPD Why was it filed with the GAEPD: • Violator was a repeat offender • Citations delayed in Court • Violator asked for extensions • Violator wanted a jury trial • His excuse was “If they can do it I can do it!!!”
