THE BASIC LAW OF THE HONG KONG SPECIAL ADMINISTRATIVE REGION OF THE PEOPLE’S REPUBLIC OF CHINA

Annex III: National Laws to be Applied in the Hong Kong Special Administrative Region
The following national laws shall be applied locally with effect from 1 July 1997 by way of promulgation or legislation by the Hong Kong Special Administrative Region: 1. Resolution on the Capital, Calendar, National Anthem and National Flag of the People’s Republic of China. 2. Resolution on the National Day of the People’s Republic of China. 3. Declaration of the Government of the People’s Republic of China on the Territorial Sea. 4. Nationality Law of the People’s Republic of China. 5. Regulations of the People’s Republic of China Concerning Diplomatic Privileges and Immunities. 6. Law of the People’s Republic of China on the National Flag. 7. Regulations of the People’s Republic of China concerning Consular Privileges and Immunities. 8. Law of the People’s Republic of China on the National Emblem. 9. Law of the People’s Republic of China on the Territorial Sea and the Contiguous Zone. 10. Law of the People’s Republic of China on the Garrisoning of the Hong Kong Special Administrative Region. 11. Law of the People’s Republic of China on the Exclusive Economic Zone and the Continental Shelf. 12. Law of the People’s Republic of China on Judicial Immunity from Compulsory Measures concerning the Assets of Foreign Central Banks. 91

[English Translation∗] Amendment to Annex I to the Basic Law of the Hong Kong Special Administrative Region of the People’s Republic of China Concerning the Method for the Selection of the Chief Executive of the Hong Kong Special Administrative Region (Approved by the Standing Committee of the Eleventh National People’s Congress at its Sixteenth Session on 28 August 2010)

1. The Election Committee to elect the fourth term Chief Executive in 2012 shall be composed of 1200 members from the following sectors: Industrial, commercial and financial sectors The professions Labour, social services, religious and other sectors Members of the Legislative Council, representatives of members of the District Councils, representatives of the Heung Yee Kuk, Hong Kong deputies to the National People’s Congress, and representatives of Hong Kong members of the National Committee of the Chinese People’s Political Consultative Conference 300 300 300

The term of office of the Election Committee shall be five years. 2. Candidates for the office of Chief Executive may be nominated jointly by not less than 150 members of the Election Committee. Each member may nominate only one candidate.
