The complaint you initiated on April 4
th
, 2009 was investigated by the Denver
Police Department, Internal Affairs Bureau and reviewed by the Denver District
Attorney's Office. The case was then forwarded to the involved officers'
commander for final review and recommendations.
Included in the case were statements obtained from you, an additional
complainant, officers present at the time of the incident, and independent
witnesses. There was also video footage which captured the arrest incident. The
information amassed during the course of this investigation did not support the
allegation that excessive force was used by the involved officers at the time of
this incident. Further, the loss of personal. property by you was also fully
investigated. There was n<2 indication that the involved knowledQfLQi
!he existence of a cell phone at the time that this irLqident to"ok place,:., The
investigation revealed that the phone could have unknowingly fallen into the
storm drain or been picked by a passerby without the knowledge of the officers.
I did however find that both Corporal R. Murr 95106 and Officer Devin Sparks
07068 were remiss in the preparation of official reports. Both officers will receive
appropriate discipline for this transgression.
