1000 PRE-TRIAL MEMORANDUM

A. Plaintiffs Statement of the Evidence:

As a ,private citizen" Howard M. Brown volunteers one Saturday amontb-t IS an escort for

September,. 1992" prior to being hired by Catholic Charities. lit January of 2002" Mr. Brown was summoned to testify as a witness in an assault and battery action reprdfu8 an :altercation outside ofa PP'LM clinic. As a result ofbis testimonyin open rom1 in JlaDtmry o.f2002, persons who oppo.se aborti,on and aborti.on rights discovered 'that the he worked for Catholic Charities., With 1bis discovery, :personswho oppose ,abortion md abortion rights began a ~paign of threats, intimidation, and coercion apinst Mr. Brown and Catholic Charities, with the jOtU of interfering with secured rights mdertbe First Amendment and forciq: the end ofhis employment relationsmp vrith.CathoDe 'Charities. AlthollSh Catholic Charities responded initially to the harassment by publicly representing that it followed fedem1 and state guidelines in making employment decisions and that the Mr. Brown was· a qualified and Icompetentemployee; his duties as Director of Co~g Services be.gao. to be curtailed. B. Defendants' Statement of the Evidence:

The Defendants expect the evidence to show that they did not violate Mr. Brown's civil rights nor did they breach any alleged implied contract or covenant with the Plaintiff when he was laid off in May of2002.

III. AGREED UPON DESCRIPTION OF TIIE CASE

This is an action where the Plaintiff, Howard Brown, alleges he was tenninated in May of 2002 by the Defendants, the Catholic Charitable Bureau of the ArchdioceSe of Boston, Inc. and Joseph Doolin in violation of his civil rights and in breach ofan implied

contract. The Defendants deny the Plaintiff's allegations.
