NURFC Release and Encumbrance
Commission Resolution R‐10‐04 conditionally approved the release of $850,000 and conditionally approved
the execution of legal documents with the National Underground Railroad Freedom Center Inc. (“NURFC”).
The Controlling Board release and encumbrance of funds will need to be in the name of NURFC. If, prior to
disbursement of these funds, another entity takes ownership of the facility or negotiates with NURFC to be the
recipient of the state funds (subject to Commission approval), the agreement(s) will need to contain language
that directs NURFC to pay the amount to the third party after the state makes payment to NURFC. This is
because once the funds are encumbered to NURFC and we cross a fiscal biennium, we cannot change the
payee without legislative action to re‐establish the appropriation.

We have signed the Clifton MOU which meets the requirement so the approval does not expire so yes we would be at a
12/12, but we still need to sign the CUA and the NDE. I would say those will be signed within the next two weeks. We
will not sign NAHF prior to the 2/11 meeting and that will leave us at 7 signed and 6 unsigned, so you are correct. And
yes Cozad is the only one we plan to signt eh day of, NURFC MOU is a possibility but not a likely one.

be placed on your letterhead, signed and sent to my attention. Also we will need a copy of your insurance accord that meets the
requirements detailed in Article XI of the Management Agreement signed and executed on March 25, 2003. If you have any
questions please do not hesitate to ask. We have started the process of drafting the addendums, so if we could have the proof of
insurance and the Renewal Letter by April 1, 2009, that will ensure adequate time to complete the drafting, review, approval and
singing processes.

1. In the project summaries, please update the “State Interest:” line if they also have a CUA with us now, I have
done this for all of the projects through NURFC.

2. Let’s add a “Recommendation” Heading in a grey box above the submittal summary and staff recommendation
for renewal– see NURFC.

3. Also, Please make sure that the font sizes are consistent (Project Summary and Name in 16pt font, Headings in
grey are 12pt and remaining text is 11pt)

Also, I deleted the Project summary for Perry county and removed it from the lists in the resolution. We do not need
Commission approval for this one at this time.
