This letter appeals the NRC's response of 21 May 003 to my


FCIA request (F02-0001) of 29 September 2001 for copies f:
John lfcLucaa, "l'iDal a-port o~ the DDO," 1973.
IIana Nark, "l'iDal a.poz:ot o~ the DJUtO," October 1979

The NRO has denied the request in its entirety on t e grounds


that any responsive records are part of the NRC's operati nal files,
and therefore "not subject to searcll." A copy of the de ial letter
is attached.
I believe that use of the operational files exempti n to deny
my request, without search and review, is completely ina ropriate.
NRC operational files are defined as "files • •.• that do ument the
means by which foreign intelligence or counterintel igence ia
collected through scientific a~d technical systems."
The requested documents are historical documents t at concern
a variety of matters, including organizational. At least one of the
documents (McLucas) is also likely to contain significa t data on
already declassified and/or obsolete (as specified by t e DCI and
NRC) cpllection systems - including the U-2 and Corona.
Reports by earlier DNRO's have already been releas d in part,
in response to earlier FOIA requests. Those documents a e enclosed
to illustrate the nature of such reports. For example Brockway
McMillan's 1965 report to the Secretary of Defens contains
information on the A-12 and SR-71, as well as a discussion of the
1965 NRC Agreement, the job of the DNRO, and org nizational
problems.

Finally, I · would note that the "NRO and the FOIA" section of
the NRO's web site states that "The goal of the FOIA of ice of the
NRO is to release as much information as possible, cons stent with
the need to protect information" and "where discretiona releases
can be made without causing harm, the Chief Information Access and
Release Center, as the initial denial authority, and t NRO Chief
of Staff, · as the appeal authority, use their discretion to release
information even where an exemption may be available." T refuse to

Dear Sirs:

I hereby appeal the decision to withhold in full ami to declare -exempt from search the records I
relating to NRO Comity Agreements and Memoranda of Understanding, case number F03-0033

Under the Intelligeng:..Autlrorization Act of 2003, Section 502, operational flles of the NRO
from the provisions of the Freedom of Information Act.

However, these records do not appear to be "operational files" under the criteria set forth in the

files' means files of the National Reconnaissance Office (hereafter in this section referre to
as 'NRO') thal document the means by which foreign intelligence or counterintelligence is

This is not that type of material.

The reason for the existence of this "operational ftles" exemption is that there are certain reco that
implicate intelligence concerns. By applying the exemption to records that so clearly fall outsi e the
purview of these concerns. the agency is jeopardizing this extraordinary protection required by tual
intelligence records. The requested administrative and management records fall outside any ra ·onal
description of "operational files". Moreover, there are procedures and exemptions that would dress any
foreseeable harm identifiable with regard to these records.

While internal NRO procedures may inadvertantly include the Comity Agreements and MOU'
of " operational flies" such procedures carry little or no weight with respect io contravening ~
and agency regulations.

I ask as an-administrative remedy that this request be remanded for initial process~g.

To clarify, details regarding both cases are as follows:


Case F07·0061 consisted of 5 reports titled "Report to the President's Foreign Intelligence
· National Reconnaissance Program." Each report had different dates. This was a request
Wenger.

Case F0&-0057 consisted of a single document titled, "NRO-CIA Relationships, 1960-1966 You confirmed you
. recieved this document and cover memo via e-mail on 2 April 08.

!!! I don't have a correct phone number for you. I think we have a disconn ct here
regarding POPPY. At any rate • I don't know who in you organization is awa that we now
hold the POPPY documents and that 'fact of' and many facts about POPPY a e releasable.

We are still wortdrig on the POPPY declassification manual and should have it finished very
soon. As soon as it is completed, we will be sending it to you and NSA for yo r coordination
and approval.

It is my understanding that you will send a NRL subject matter expert to our o 1ce to review the
POPPY records once we have completed our review and redactions of the r: rds.

While the plan is clear from the 25 year declassification aspect, we will still rec ive Freedome
of lnfonnation Act (FOIA) requests in the interium. (It is unavoidable).

FOIA is a Jaw and we just can't say "he does not want this document released . There are
many ways we can protect information under FOIA but the above response wil not keep us out
of federal court.

When we get a FOIA case we are required to go through the 'FOJA door' . Is
aware of the recent events with POPPY?
