British Columbia Ferry Services Inc. (BC Ferries) has now had the opportunity to review your investigation report regarding our simultaneous disclosure practices. We are pleased that you found that simultaneous disclosure does not breach any of BC Ferries’ obligations under the FOIPP Act. We are proud to lead the way in British Columbia in proactive disclosure. We believe our practices, including our readily accessible and easily searchable online disclosure log where we post all freedom of information request summaries and response packages, to be the most transparent in British Columbia, bar none. We have considered your comments and your recommended best practice guidelines and have decided that we will delay posting of Freedom of Information response packages to the afternoon of the business day following release to the applicant (to set an exact 24 hour timeline is administratively difficult), and that the responses will remain posted for a minimum of 12 months. We will also look at the feasibility of having an indexed, searchable online archive for older requests, as well as the other practices recommended in your report.
