SUMMARY: On March 15,2011 at around 8:03 p.m., I was assigned by Sgt. Josh Brooks to do a public official investigation on Salem Police Officer Raul Ramirez. Officer Ramirez had been the subject of an internal investigation by Salem Police Sergeant Garrett for administrative purposes. During the course of Sergeant Garrett's investigation he came across potential criminal conduct by Officer Ramirez and he requested the Oregon State Police investigate. ACTION TAKEN: On March 15,2011 at around 8:03 p.m., I was assigned by Sgt. Josh Brooks to do a public official investigation on Salem Police Officer Raul Ramirez. Officer Ramirez had been the subject of an internal investigation by Salem Police Sergeant Garrett for administrative purposes. During the course of Sergeant Garrett's investigation he came across potential criminal conduct by Officer Ramirez and he requested the Oregon State Police take over the investigation. At around 8:35 p.m. Sergeant Brooks, Detective Olsen and I met with Sergeant Garrett at the Oregon State Police, Salem Patrol Offic~ant Garrett told us he opened an investigation on Ramirez when two female Salem Police~rought forth two separate complaints that they had received inappropriate text messages from Ramirez. He said he received the complaints from a

Sergeant Garrett told us the complaints were independent of each other, and similar in nature. Both complaints stated that Officer Raul Ramirez had been sending inappropriate comments to their cellular telephones via text message. While two complaints were brought to Sgt. Garrett's attention, one did not meet the criteria for a criminal investigation and was handled administratively by Salem Police Department's intemal affairs division. Sergeant Garrett told us durin~gation some of the cellular telephone text messages from Ramirez were retrieved fro~ cellular telephone with her consent. The text messages received on_cellular telephone began on February 21, 2011. While reviewing the received and sent text messages it appeared that the reason for 'the initial contact was to schedule a ride-along. Sergeant Garrett told us the ~ften take part in ride-alongs with officers and it is common practice for allllto put a letter or card into the in-box of an officer that they are interested in ri~th. If the officer has time and is willing to take the~ut on patrol they simply call the~d schedule the ride-along. . Sergeant Garrett provided us with a copy of the text messages recovered from~ll phone between her and Officer Ramirez, The texts received on February 21,2011, on_ telephone from Ramirez werebrief first talked about scheduling a ride-along. _received several text messages between the dates of February 21,2011 and March 15th, 2011. Sergeant Garrett told us they were able to recover several text messages received from Officer Ramirez; however several of the sent messages were not there. During a later interview with learned that once she has around 200 messages in her sent box, her phone slows down so she has to erase them. Refer attached SMS text message log for further information. Sergeant Garrett told us on March 15, 2011, he talked with_about theinappropriate text messages sent to her from Officer Ramirez. He said during the course of his administrative investigation he recorded a cellular telephone conversation between~d Officer Ramirez. The recorded call was conducted after several more text m~ been sent from Officer Ramirez to_ Sergeant Garrett told us the call was recorded consent at the Salem Police Department. According to the evenings patrol log and during the time of the recorded telephone call Officer Ramirez was on duty working as a Salem Police Officer. Refer to attached MDT traffic log, and Patrol logs for further information of Officer Ramirez's whereabouts during the text and telephone conversation.

Well, the fact that I've been flirting with you. • Officer Ramirez: I mean 'cause let, let's look at this realistically here. You' right?" o _"Yes." • Officer Ramirez: "Yeah, but yeah. During the conversation Officer Ramirez continually attempted to get_to open up about past experiences, ~ skinny-dipping, past sexual experiences, and sexual fantasies. Officer Ramirez asked if_would like to be ''taken'' and asks if she has ever been taken and controlled before. Officer Ramirez asked_if, "she takes care of herself," in reference to masturbation. Officer Ramirez asked how frequently she takes care of herself and what she thinks about when she does it. He concluded the conversation by telling _that she should let him know, prior to self pleasuring (masturbating) herself. Sergeant Garrett said following the recorded telephone call between Ramirez and~e believed this was now criminal in nature and he called the Oregon State Police Salem Major Crimes Section and asked us to take over the investigation. Since the recorded conversation that had been made earlier in the day was left open-ended, we ~if she would be willing to re-contact Officer Ramirez, via text message. Ms. ~end Officer Ramirez a text message, which she did at approximately 10:47 p.m. Officer Ramirez quickly replied and after a few texts back and forth, Officer Ramirez asked if she could talk on the telephone. A second telephone call was placed to Officer Ramirez _gave us consent to record the telephone call. At no time was or forced to say anything. It was explained to _that she could stop the conversation at anytime she wanted for any reason. Based on Salem Police Department MCT records, desk logs, and Sgt. Garrett who saw Officer Ramirez at Salem Police Department, I know that Officer Ramirez was at the Salem Police Department when the text messages and phone call were initiated. The Salem Police Department is located at 555 Liberty St, Salem, Marion County, Oregon.

Ramirez as well as the attached CD containing the recorded phone call for the complete conversation. INTERVIEW OF OFFICER RAMIREZ: On March 16,2011, at approximately 1:27 p.m., Detective Olsen and I conducted an interview with Officer Ramirez at the Salem Police Department located at 555 Liberty St. SE #130, Salem, Marion County, Oregon 97301. I told Officer Ramirez we were conducting a criminal investigation and in no way was he required to talk with us and he could stop the conversation at anytime. I told Officer Ramirez a complaint had been filed with Salem PoliceDepartment's Internal Affairs Division that was a separate administrative investigation. I explained the reason we were there was to determine if there was a criminal aspect to the complaint. I told Officer Ramirez the conversation was going to be recorded. A digital recorder was turned on and placed on the table in plain view, which Ramirez verbally acknowledged. I told Officer Ramirez again that he did not have to talk to us and that this had nothing to do with .the administrative side of it. I told him he was under no obligation to speak with us, that he was not being ordered to speak with us. I explained to Officer Ramirez that we were there to speak with him about a criminal matter and he has rights just like everyone else. I told him ifhe wanted to end the interview, he could get up and end it at any time he wanted to. I asked him ifhe understood that, and he said "Yes." During the course of the interview Officer Ramirez said he talked wi~n the cellular telephone the night prior. He said he had talked with her about scheduling a ride-along. Officer Ramirez said they joked around and there was a little flirting but that was the extent of it. He has never had contact with alone any kind of sexual relationship with her. It was in the back of his mind for when she turns~ut he was not going to go to jail over sex. Officer Ramirez told us he is married. When asked what his wife would think, he said he and his wife have a complex relationship that he'd rather not go into detail about. They have a great relationship, but he would rather not go into detail. He said the embarrassment of this was the greatest co~cem. I asked Ramirez ifhe thought anything he had done could be construed as criminal or misinterpreted as such. He told me no, absolutely not. When asked to describe flirting Ramirez explained it was just playful fantasy conversation. Detective Olsen asked what he would describe as flirting. He asked him to try and place it on a scale ranging from "You're cute" on one end to talking dirty or phone sex on the other end. Officer Ramirez said the conversation was allover the board. Officer Ramirez said he had no intention of ever following through with a physical relationship with _

When asked ifhe thought anything he was doing was wrong, within his agency, Officer Ramirez said he knew some people would take issue with it, so that crossed his mind, but no, because it was harmless in his mind. Detective Olsen asked him ifhe was saying there was nothing wrong with it, ifhe would engage in something like this again with someone who i~fficer Ramirez said, probably not.justbecause of the headache it's already causing. It's not worth the drama that it's stirred up. I asked Officer Ramirez what his concerns were with what's going on, ifhe thought this could ever happen, that the State Police would be talking to him. or that his agency would take any kind of issue with what's going on. He told me he thought he would get talked to by his agency if it came out they were having these conversations, that they were in contact on more than an officer-_ leveL He said he figured he would get talked to, but that was the extent of it, the whole concept of a criminal investigation was understandable, but it had him really put off. Officer Ramirez said he has not done anything illegal.
. I asked Officer Ramirez ifit ever crossed his mind to do anything wi~ n duty and he said he has fantasies, but he would not have done anything. He has a career to ose, and he would not do anything to jeopardize his career. He said the absolute worst thing he saw coming out of this would be he would get letter in his file, that it wouldn't even be something that was a terminal issue. He said he can't even imagine why it would even be that big of an issue, other than the parents having a concern, which is understandable. He said he was not trying to set up some master plan to have sex with a _girl, once she tumed~ere were things that sat in the back of his mind, but he wasn't going to do anything to go to jail.

I asked Officer Ramirez what the point of the conversations were. He told me to flirt a lot, it's just one of his things. I asked Ramirez ifhe has ever had any complaints in the past of anyone saying he acted inappropriately, or seemed overly flirty or anything like that. He told me no, his biggest issue is rudeness. I told Officer Ramirez we had records of all their conversations, text messages, and both phone calls, so I knew there was some pretty explicit sexual talk between the two of them. I asked him if

_Officer Ramirez said he didn't think it was wrong or illegal. When asked ifhe had
made any calls while on-duty Ramirez said, "Yes," then went on to explain it was common practice to make personal calls on-duty, He told me he made the calls on his personal cell and not his work cell. Officer Ramirez told me he was concerned with being railroaded over the phone calls on duty. He does not see it as any different than a guy talking to his wife or to a buddy about a barbecue, which every officer in his department does. Detective Olsen pointed out that not every other officer is talking to a~i. Officer Ramirez said his thing is with the context of the conversation, if we were talking about just having a conversation. Detective Olsen told him telling your wife you are going to be late for dinner and talking to a __ bout touching herself is different. Officer Ramirez asked, in substance, why one was different from the other. Detective Olsen told him the conversation with the wife is not criminal in nature, but talking to ••• about sexually explicit acts can be. Officer Ramirez asked what crime that would be because he was having a hard time wrapping his head around it. hold him I did not have my book in front of me, but there is a statute that covers it Officer Ramirez asked to take a break, we stopped the recorder. Ramirez said, "If I knew what I was doing with her was illegal I would not have let it go that far." I left the room and printed 0 f the statute for Luring a Minor. '.I returned and started the recorder again. I told him what the statute was and provided him with a copy. Officer Ramirez wanted me to explain subsection 2 to him. I told him it is not up to me to explain it to him, I'm not a lawyer. I asked Officer Ramirez what his thoughts were, ifhe felt like the statute didn't cover it. He told me if he is understanding subsection 2 and if it is for no other reason than basically as fantasy, then that's the defense.

Officer Ramirez asked ifhe was going to be arrested now. I told him no, I was not lying to him about that, we were still trying to get the entire picture and then we were leaving it up to the District Attorney to decide. INTERVIEW
On March 17,2011 at around 9:18 a.m. I interview~in an interview room at the Salem Patrol Officer. I if! could record the conversation and she said that was fine. During the interview me, in substance, the following: • • She was looking to go on a ride-along. She usually goes with 2 other Officers but they were us hooked her up with Officer Ramirez and she emailed him, and he emailed her back • gave her his personal cell phone number saying that was the easiest way to get a hold of

She started text messaging him to set up a ride-along and then his conversations got "creepy" . He started saying he wanted to flirt with her, and it would be easier when she was She told Becky Carpenter, her upervisor, and she told Sgt. Garrett and then wanted her to help him out with the phone call. She did not know what Officer Ramirez had said t~efore they reported it, she assumed he had been texting her too. During the pretext phone call Officer Ramirez was saying in a perfect fantasy world she would ask him to touch her and he would do that. He meant during a ride-along. In a text he asked her to meet him in 45 minutes, before the phone call. She told him she could not meet him because her grandparents were coming. He text messaged her a few times after the phone call. When she got home he sent her text messages saying it was nice talking to her and she should meet him at the station. When he first started text messaging her she was thinking it was sick and she could not believe an officer would try to do that with a_ When Officer Ramirez was text messaging her the first time she was on Facebook instant messaging_her ex boyfriend and she was telling him what Officer Ramirez said and he told her she should tell Becky. _knew Officer Ramirez because of an incident where they accidentally switched debit cards.

That night after we left she could not fall to sleep. She thinks his intent, his goal was to do something sexual to her. He talked a lot about licking and touching her and stuff, she doesn't know ifhe meant actual intercourse or not. She told_she was afraid she was going to get raped. He arranged for all of them to go talk to Becky. , _ t~ld him, Ramirez had asked her if s~e was sin~e, and how ol~ she was, and when him she ~as only a_he said something about her being too young. He was not friends with Ramirez but he was comfortable enough with him to give him the girls phone numbers and stuff. The day Ramirez asked him for _phone number he friended him on Facebook. He thought it was weird for an officer to friend him. Wh~old him the stuff Ramirez was texting her, he unfriended him. He has heard that Ramirez cheated on his wife, he didn't know if it was his first one or second one. He knew Ramirez and_butted heads, and Ramirez told him_ad started the rumor about him cheating on his wife. He knows quite a bit about what is going on, and that Ramirez is on administrative leave.

She has been ~ith the Salem Police Department since November of 2009. She has only ever ridden with Officer Donner. They fill out a form to do a ride-along and once it's approved by the_advisor Becky Carpenter they put a copy in the officer's box. She has not gotten any phone calls or text messages from any officers she didn't ride with. The only time an officer made her feel uncomfortable was once, one of the bathrooms at the office does not lock. She walked in once and a male officer was at the sink and told her "It's ok, you can come in" which was awkward, He was Hispanic, short, 40-ish and had facial hair. Other than that, no. . She has not heard any of the female. complain about any officers making them uncomfortable.

She knew she was there to talk to me about Officer Ramirez. The day before Valentine's Day she was decorating for her school dance and she got a text message from a number she didn't recognize that said, hey this is Officer Ramirez, I just got your ride-along request, sorry I didn't get back to you sooner. She said that's ok another officer took me. She needed to go on another ride-along that month so she asked him if she could go with him and he said she could. Then he asked her how her weekend had been going wid she said fine. Then he asked her if she had any wild plans for that night. She said no, she was helping decorate for her high school dance. He asked her how old she was and she said she was a~d he said, oh you're just a young pup. She told him she had to go because her teacher walked in, which wasn't true, she just wanted to get the conversation over with because it felt weird. She has been a~ith the Salem Police Department since October oflast year. She has been on 5 or 6 ride-alongs, She has gone with Officer Hernandez and Officer Galusha. It is not normal for the officers to text message to set up ride-alongs. Usually they go through Becky. She's never ridden with Ramirez before. She put a request in his box because another _ _ suggested Ramirez. ~oesn't really know Ramirez he just knew him from being on the same shift with him. She told_about the text messages and her saw the text messages and thought they were a little weird. She told her mom about the text messages that evening when she got home. Her mom had said it seemed a little strange and if he contacted her again to tell her immediately. She didn't know if it was that inappropriate, it felt like it was but she wasn't sure. her if she wound up going on a ride-along WithRamirez and she told him no. He asked her if Ramirez said anything to her and she said yeah, that they had a weird conversation. He said it had happened to another~d asked if she wanted to go talk to Becky, and she said she did. _did not say what was said to the other_ She found out from "what had been said between them. It was after they talked to Becky that she found out what Ramirez saidt~ ., ~r she had been lookin.i!>r an officer to ride with and Ramirez said he heard she ~and asked if she w~and she said not yet, and Ramirez said something like oh too bad or I would flirt with you. She didn't know the othe~as~til they showed up that day to talk to Carpenter. She does not have her text messages anymore. Once she gets over 200 text messages her phone will shut off, so she has to delete them. She saw in the paper this morning an article about Ramirez ..
