Chowdhury 768 Dean Inc. 1168 Fulton Street, 2nd Floor Brooklyn NY 11216 RE: Proposed Settlement Agreement Dear Mr. Chowdhury, Please be advised that Common Law, Inc. represents Ms. Mary Lee Ward in settlement negotiations. As we have previously discussed, we believe the foreclosure sale of the subject property 320 Tompkins Avenue, Brooklyn, NY 11216 (hereinafter 320 Tompkins) was improper. Moreover, the community of Bedford Stuyvesant has made it clear that it will not stand for the eviction of Ms. Ward. In order to reach a conciliatory result, we urge you to consider and accept the enclosed settlement agreement. Scope of the Settlement Agreement The settlement agreement provides the opportunity for Ms. Ward to remain in her home and for you to 1) help redress the improprieties that led to the unjust foreclosure of Ms. Wards home and 2) receive substantial financial benefits. Under this agreement, you will transfer the deed to 320 Tompkins to a 501(c)(3) tax-exempt not-for-profit organization and receive the entirety of the surplus funds from the March 26, 2008 foreclosure sale. By doing so, you will not only be able to claim the full market value of the property (estimated at $550,000) as a tax-deductible charitable contribution, but you will also help create affordable housing in Bedford Stuyvesant. Furthermore, the amount of the surplus funds from the foreclosure sale ($52,783.90) has grown significantly and is estimated to be upwards of $70,000 (currently held in an escrow account at Sovereign Bank). While we understand that this proposed settlement agreement does not fully compensate you for the purchase price of the property, we believe the agreement will nonetheless benefit your relationship with the community of Bedford Stuyvesant.
