ORDER AFTER HEARING Hearing Held. The parties are to submit a brief to the Court that would list issues that are to be resolved on remand. Which are: Was there spoliation, and if so when did it occur? If there was spoliation, was Rambus in bad faith? If Rambus was in bad faith, was Hynix prejudiced, and if so, in what way? Hynix should brief the issue of collateral estoppel. The parties should also discuss whether further evidence should be taken and if so what evidence is it specifically that Hynix wants to offer or to discover so that they can see whether they want to offer ir or not. Rambus to file there objections to the cost bill by 9/15/11. Hynix to file reply by 9/30/11. The parties are also required to file a statement by 9/30/11 to any elements of the cost bill that remain in dispute or those that have been withdrawn. On the bond issue, opening briefs (30 pages) due by 9/30/11 and responses (15 pages) due by 10/14/11. The Court will leave the bond as it is at the present time based on the literal reading of the stipulation. The Court set a Further Case Management Conference for 10/21/11 @ 10:30 AM.
