NOTICEIS HEREBYGIVENpursuant to Wis. Stat. § 200.29(I)(c)5., that the Metropolitan Sewerage Commission of the Milwaukee Metropolitan Sewerage District will hold a public hearing to gather public comment on the District's biennial review of its boundary on September 27, 2001, at 10:00 o'clock in the morning at the District's Headquarters Building, 260 West Seeboth Street, Milwaukee, Wisconsin 53204. The proposed biennial review will consider whether and how much of the City of Franklin should be included into the District's boundary on account of the construction of the Ryan Creek Interceptor. The proposed resolution, together with the legal description of the area to be considered for inclusion within the District boundary if the resolution is adopted, is as follows: "RESOLUTIONADOPTEDFOLLOWING BIENNIALREVIEWOF THE MILWAUKEE METROPOLITAN SEWERAGEDISTRICTBOUNDARY FOR THE CITYOF FRANKLIN WHEREAS, the Milwaukee Metropolitan Sewerage District, hereafter "District," was reorganized by Chapter 282, Laws of 1981, and was granted an initial boundary that was the same as the boundary established for the predecessor District pursuant to Wis. Stat. § 59.95(5) (1979-1980)[now Wis. Stat. § 200.29(I)(b) (20092010)]; and WHEREAS, the reorganization legislation mandated, in what is now Wis. Stat. § 200.29(I)(c)1., that the Metropolitan Sewerage Commission exclude all areas not likely to receive sewerage service from the District within the next 25 years from its initial boundary under Wis. Stat. § 59.95(5) (1979-1980), now Wis. Stat. § 200.29(I)(b), and permitted the Commission, pursuant to rules adopted pursuant to Wis. Stat. § 200.29(I)(c)3., to also exclude areas not likely to receive sewerage service from the District within the next 10 years; and WHEREAS, in 1983, the Metropolitan Sewerage Commission adopted a resolution pursuant to Wis. Stat. § 200.29(I)(c)4.a. to amend its original boundary for the City of Franklin, as provided
for in § 200.29(1)(c), followingreceipt of consent given by the City of Franklin, hereafter "City," to exclude certain areas; and WHEREAS,the Metropolitan Sewerage Commission is authorized to perform a biennial review of its boundary, pursuant to Wis. Stat. § 200.29(1)(c)S., to ascertain whether the need to provide sewerage service for any given area has changed since the last boundary establishment and, if the Commission finds that an area is likely to receive sewerage treatment services from the District within the next 10 years, the Commission is required to adopt a resolution adding the area to the District; and WHEREAS,in conducting its biennial review pursuant to Wis. Stat. § 200.29(1)(c)S., if the Metropolitan Sewerage Commission is required to adopt a resolution to include an area, such action need not comply with the provisions for additions to the District set forth in Wis. Stat. § 200.29(1)(d), which contains the statutory provisions for local municipal consent to any inclusion; and WHEREAS,the City and the District have entered into an Intergovernmental Cooperation Agreement providing for the construction of the Ryan Creek Interceptor to be completed in 2014 so that sewerage conveyed by such sewer can be treated by the District and providing for ownership of the Ryan Creek Interceptor by the District; and WHEREAS,the followingconditions are generally applicable to the area proposed to be within the District's boundary: A. Sewerage from the area is or may be captured in drains that run to the sewerage treatment plants of the District and unless captured such sewage would flow into Lake Michigan, which is the source of drinking water for many municipalities; The Metropolitan Sewerage Commission has authorized the addition to the sewerage system of all facilities needed to treat and dispose of sewage from these areas, including approval of an Intergovernmental Cooperation Agreement for the construction of the Ryan Creek Interceptor; and
The addition of this area to the District is consistent with the SEWRPCRegional Water Quality Management Plan; and
WHEREAS,a public hearing was held on September 27, 2011, which was preceded by publication of a class 2 notice; and WHEREAS,a report of such public hearing has been received by the Metropolitan Sewerage Commission, which report concludes that construction of the Ryan Creek Interceptor will provide the last sewerage facility necessary for the District to provide sewerage treatment services for the entire population of the City; now, therefore, be it RESOLVED,that District's boundary for the City of Franklin is hereby established to include the whole of the City, as is more completely described in the metes and bounds legal description appended hereto and incorporated herein by reference thereto and identified as Exhibit A; and be it further RESOLVED,that the Executive Director and the Commission Secretary are hereby authorized to record this resolution establishing the boundary change with the Registrar of Deeds of Milwaukee, Ozaukee, Racine, Washington, and Waukesha County and to send certified copies of this resolution to the Secretary of the Wisconsin Department of Natural Resources and the clerk of each city, village, and town within the District." Wntten comments as to this proposed resolution will be accepted by submission to the Secretary of the Milwaukee Metropolitan Sewerage District at its offices through the close of business on the day of the hearing.
