Dear Mr. Klonick: We write today to bring the commission’s attention to a situation that calls into question the impartiality of several elected Judges serving at the municipal, county and New York State Supreme Court levels. The attached printed versions of pdf files show the inflammatory text and anti-lgbt biased messages and name calling that the election campaign committees of these Judges has financially sponsored on the web site politicny.net. This is clearly a violation of a Judges vow of impartiality and calls into question any court decision that involves lesbian, gay, bisexual and transgendered New Yorkers. I call into question the ability of New York State Supreme Court Judge Patrick NeMoyer, Erie County Family Court Judge Patricia Maxwell, and Buffalo City Court Judges Hon. David Manz, Hon. Robert Russell, Hon. Joseph Fiorella, Hon. Sharon LoVallo and Hon. Susan Eagan, to preside over court cases that involve any individuals that are self identifying or perceived to be lesbian, gay, bisexual and transgendered. Based upon the blatant anti-gay messages these Judges should be required to remove themselves from any case work involving lgbt people, lgbt owned commercial entities and any issues that their strong anti-lgbt bias would preclude the assumption of impartiality.
