that Aldus

and an "Aldus Partner" had agreed in May 2004 to pay nearly $320,000 in sham placement

to Morris in exchange for Aldus being selected to manage $175,000,000 of NYCRF assets.

The SEC complaint further alleged that Aldus used the monies it was entrusted with managing

for the NYCRF to invest in other funds, not for the benefit of the NYCRF, but in order to pay

bogus placement agent fees associated with those investments to entities controlled by Morris.

74. On April 30, 2009, the SEC filed an amended complaint in New York against

Aldus, charging Meyer and Aldus directly with violations of the federal securities laws.
