Thank you for your review and analysis. After now having gone through details of the situation, as well as the complainant’s history of targeted requests/complaints along these lines, my own analysis is: 1) Similarly to yours, I believe that the complaint is misdirected in terms of there being a state agency issue involved.

2) While there could in theory be a reputational issue, I don’t believe that to be a substantive concern. 3) Additionally my review leaves me to conclude that, related to the complaint, appropriate Research and Technology Park personnel policies are in place and being followed. President Bresciani – The attached memo details my review of an issue that was brought to me by a citizen from Grand Forks, ND. As a means of quick summary, Mr. Marhula had concerns regarding Tony Grindberg receiving pay while in congressional session in violation of his contract. This was initially brought to us in late August, 2010. Recently, Mr. Marhula had also reported it through our Fraud Hotline amidst concerns it was not being addressed. The Fraud Hotline notification was communicated to Rick Johnson, Laura Glatt and me. In my initial conversations with Mr. Marhula, I informed him the NDSU Research and Technology Park is a separate not for profit entity which does not fall under the administrative oversight of NDSU or our internal audit function. However, I thought it prudent to review from a risk standpoint given your role as the President of the Research and Technology Park Board, and the public reputation risk we have when the NDSU name is licensed to a third party. Mr. Marhula requested a copy of the report under the North Dakota open records laws. After you have had a chance to review over the course of several days, the General Counsel’s Office, will most likely comply with this request. The memo provides you a summary of the issues reviewed, my recommendations and supporting documents in an appendix. In addition to the electronic file, I will keep a paper copy of the report with the files in my office. If you have any additional questions or would like further analysis, please do not hesitate to contact me.
