On 11-1-11 at 1231 hours, P.0 Larson and P.O. Day were dispatched to Valenti's Italian Restaurant located at 537 Division Street. Upon arrival, NTPD spoke with Valenti who reported that he wanted Ramos and Janiszweski off of his property. He stated that he fired Ramos and that she needed to leave. He also explained that she came into the restaurant today and sent home his waitress. Ramos told officers that she sent home the waitress for having a contagious disease from drug use and wanted her cleared from the Deptarment of Health prior to working. Ramos told officers that she drove home the waitress but told Valenti she would be back to pick up the marketing materials from him. She reported dropping off the waitress, Kelly Medella, and returning to Valenti's. Ramos said she pulled into the parking lot and Valenti came out yelling at her. She reported at that time both called Police. Ramos said she only called so that she could clarify with NTPD her warrants out of Florida because Valenti was holding them over her head. Upon NTPD's investigation and speaking with Frank Budwey it was determined that both are entitled to the restaurant. Valenti, Ramos, and Janiszweski are all on the lease. Further, Ramos has a business bank account in the restaurant's name, IRS paperwork and a certificate of business partnership. Valenti told officers that he would be contacting his attorney because the restaurant is in his corporation's name which he is the sale owner of. Ramos ·agreed to leave for the day and stated that she wanted to work things out for the restaurant. Valenti stated that he would be getting the paperwork completed so that she is off all of the paperwork.

On the above date' and time I, PO Mamot was dispatched to 537 Division St., Valenti's Restaurant, for report of an aggravated harassment complaint. On my arrival, I was met by Lori BrocugJio, who is the owner of Valenti's Restaurant. Lori stated that she has been receiving harassing phone calls from an ex-employee of hers named Jodllyn Shearer. Lori states that Jodilyn was calling the restaurant and threatening Lori and her husband, JodiJyn stated that she would "fuck us up," Jodilyn threatened to destroy their truck. Jodilyn also threatened to rob Lori when Lori deposits the money from the business at night. Lori states, Jodilyn knows the route and the times in which she goes
to the bank and deposits the money. Lori is afraid to drop the money offat night.

Jodilyn has been calling the restaurant non-stop, over 50 calls had been made to the restaurant, on the business line tying up the line so customers cannot get through to place orders. Lori was threatened by Jodi/yn when she would call. Jodilyn would then call and say nothing and she would call and just press buttons, not say a word. When I was taking the complaint, the business phone rang 8 times, no voice on the other end; I could hear the buttons being pressed. Jodilyn Shearer was arrested at her residence ••••••• ".

On the above date and time I, Po R. Wydysh was dispatched to 537 Division St. for an argument between the owners of Valenti's Restaurant and one of their exemployees, William Ripley, over the return of a company car. Upon arrival I spoke with Lori 8rocuglio who stated that she fired an employee earlier today. When he returned the company car, he started to argue with Lori in sight of the restaurant customers. Lori and Ripley went outside to talk. While Lori was arguing with Ripley, Lori stated that she was pushed from behind into Ripley. Lori stated that she lost her balance and fell into Ripley. When she turned around she saw Ripley's girlfriend "Debbie" standing there. "Debbie" then punched Lori in the chest causing pain. "Debbie" and Ripley then got into her car and left. During this time one of the restaurant employees had called for police. Lori stated that the only thing she knew about the female involved was that she is Ripley's girlfriend and her name is Debbie. Lori did not know Ripley's 008, however she obtained his social security number from work records . His address is listed as .,

Lori wishes to pursue charges against the female if her identity can be obtained. I called and left a message left for Ripley attempting to retrieve "Debbie's" information. Call not returned.

On 11-27-11 again attempted to contact Ripley via phone with no answer. I also attempted to contact him at his residence. I spoke with a Nathan Ray (spelling unknown) who stated that he has a child with Ripley's daughter. He was Lin'willing to give any more of his information. He did state that Ripley was not home at this time and that he had not been home all day. He stated that when he sees Ripley he wirJ have him contact NTPD: . - On 1f-27-11 at approx 2230hrs Ripley came to NTPD. He brought Debbie with him. She gave her full name as Debra K Larsen 08-17-58. I asked her about the incident and she stated that she did not put her hands on Lori. She stated that she did yell at her though. Debbie went on to say that when things got heated she and Ripley got into her car an attempted to leave, but lori got in the way and started to scream at (hem. Debbie was able to leave without further incident. ._ Lt. Daugherty and I feel that further investigation would be necessary to apply for a warrant due to the conflicting accounts of the incident.

On the above date and time, I, Officer Roberts, was dispatched to 537 Division St.. Valenti's Restaurant, for a criminal mischief investigation. Upon my arrival, I spoke to the complainant, Terry A. Valenti (12/13/1967). who stated that an unknown party backed a pickup truck in to a door at his business and broke the window. Mr. Valenti stated that, at 2248 hrs, a black Ford F-250 pickup truck backed in to the door on the East side of the business. causing an approximately 72"x30" pane of glass to shatter. The vehicle then sped off through the parking Jot, down Budwey Ln. and out on to Erie Ave. He was unable to obtain a license plate number. Mr. Valenti estimated the damage at $1000.00. He was advised to forward an estimate to the Oetectice Bureau when he is able to obtain one. Mr. Valenti can name no suspects and there are no other witnesses to the criminal mischief. Victim did receive information on victim's rights and services pursuant to NYS Law.

On the above date and time, I, Officer Roberts along with Officer Cake were dispatched to 537 Division St., Valenti's Restaurant, for a reported domestic. It was reported to dispatch that one of the parties was on the ground. NTFD was notified prior to our arrival. Upon our arrival, I saw a female on the ground next to the passenger side of NY Reg#FPS2511. The passenger side doors were open and she was laying on the ground next to them. She was advised that NTFD was on the way and that she should not move until they arrive. The vehicle listed above is owned by the victim, Terry A. Valenti (12/13/1967). The female was later identified as Lori L. 8rocuglio (7/26/1966). I then spoke to the victim, and he stated that he was attempting to leave the restaurant when Lori showed up in her vehicle, NY Reg #45386MB, a 2004 Ford F250 Supercab, black in color. He stated that Lori showed back up at the restaurant to start an argument with him. He had her son, Michael A. Ramos (11/20/1995), in the vehicle with him. They all live together and Terry was going to take Michael home. When Terry attempted to pull away because he did not want to argue with Lori, she jumped on the passenger side step of his truck and opened a door. When she did this, Terry hit the brakes because he was not sure what was happening. When he hit the brakes, Lad fell off the side of the truck. A witness, Michael A. Gurnett (1/1711962), corroborated the story that Terry told me. He was on scene because he is the alarm technician for the restaurant. I also asked Michaei Ramos what had happened and he also corroborated the witness's story as' well. Lori was checked out by NTFD and she was about to be transported to the hospital when she signed off and exited the ambulance. She declined all medical treatment. While being interviewed, Terry also advised patrol that Lori admitted to driVing her vehicle in to the door earlier on in the night and breaking the window (see 11-21930). Officer Cake interviewed Lori and obtained a 710.30 statement from her. Terry stated that he only wanted Lori to pay for the window, he did not wish to have her arrested. Certified Responded to the scene to impound the vehicle based on the earlier criminal mischief/LSA complaint. The vehicle had glass evidence and damage to the front bumper. Hold placed on the vehicle for possible processing by the Detective Bureau. Lori claims to be part owner of Valenti's and stated that she damaged her own property. Further investigation forwarded to the Detective Bureau. .' .--..----- ..

Frank Budwey came into NTPD on 01-10-12 to report he had received a check from his tenant (Valenti's Restaurant) that the bank informed him he could not cash due to insufficient funds. On Sunday 01-08-12 Lori L. Brocuglio the owner of Valenti's Italian Restaurant gave Frank a check for December's rent. On Monday Frank took it to M&T Bank to see if there was enough money to cover it. M&T Bank informed Frank that the check would not clear. Frank went back to the bank on Tuesday 1-10-11 to see if money was put into the account to cover the check, he was informed that there still was not enough money to cover the check. Frank obtained a letter of protest from the bank and came into NTPD to file a complaint. NTPD responded to the restaurant on 01-08-12 for an alarm (12-0333) that turned out to be a dispute between the restaurant owner's and Frank Budwey. Lori gave Frank the check in question and Frank agreed to let Lori keep the restaurant open for business. I, PO D. Truty spoke with Lori on 01-10-12 over the phone to advise her to make good on the check. She stated she did not give Frank the check and that her check book was in a car that her partner had. Then she wenton to say that was not her signature on the check and she told Frank not to take the check. She was questioned how she would know Frank had a check from a checkbook she states is missing. She clearly knew Frank had a check for the rent that could not be cashed. The fact that Lori stated the siqnature on the check was not hers indicated to me that she was aware the signature was bad on the check she gave to Frank. I spoke with both officers who were on the call when the check was passed. PO J. ShiesJey stated Frank Budwey told him he did not expect the check he received from Lori would be able to be cashed. Officer Shiesley did not see the actual check. PO T. Swartz stated he was in the back of the restaurant when Terry VaJenti (partner) gave Frank cash towards the bills. Lori came out and stated she was not going to give Frank cash she had a check for him. PO T. Swartz did not see the actual check either; however he did wait for Lori to give Frank the check in question.

Warrant was applied for and original check was placed into evidence.

To wit; the said defendant at the aforesaid date, time, and place, did: utter a check to the victim knowing there was insufficient funds in the accout to cover the check. On the above date and time, P.O, T. Hueyand I (P.O. L. Boisover) responded to 537 Division St. Valenti's Restaurant for a complaint of a plow truck that was blocking the entrance to the building. Upon arrival I witnessed an old plow truck up against the entrance to the restaurant. I saw the owner of the property, Frank Budwey walking across the front of the restaurant. P.O. T. Huey arrived on the scene. I yelled to Mr. Budwey to get his attention but he kept walking and entered the restaurant from the door facing Division S1. When I made it to the door Mr. Budwey was walking out of the restaurant. Outside I saw a group of people standing and a truck that was near the door running. I then saw several women attempting to enter the building. Mr. Budwey backed up and put his body in between them and the door telling them they are not allowed back in the restaurant. Debbie Reinig the person in charge of the restaurant was outside and was yelling at Mr. Budwey claiming that he can't keep them out of the building. Mr. Budwey had the Fuel company on scene and had turned the gas off before patrol arrived. Mr. -Budwey claimed that everyone has to exit the building due to a City Ordinance regard the building having the utilities shut off. P.O, T. Huey spoke with the building inspector who confirms that there is such a city ordinance. I called Lt. D. Mahon~y to respond to the scene. Terry Valenti the owner of the restaurant arrived on the scene very upset demanding that the trucks be moved and the restaurant opened. He hada receipt from National Fuel with the gas utility in his name. Lt. D. Mahoney spoke with Capt. R. Zgolak regarding the incident. Capt. R. Zgolak spoke with the city attorney and advised Lt. D. Mahoney that Mr. Budwey has to move the trucks and can't block them from conducting business. Lt. D. Mahoney and I walked over to frank Budwey's Office and advised him that he has to move the trucks. Mr. Budwey moved both trucks and gave the keys to the building to Mr. Valenti. Mr. E3udwey was advised that he has to go through the eviction process. National Fuel arrived on scene and turned the gas back on in Mr. Valenti's name. When we were getting .all the information on the workers Mrs. Reinig approached me and stated that she wanted to press charges on Mr. Budwey for pushing her out of the store. She stated that he entered the store demanded that she leave and after refusing he grabbed her arm and pushed her out the door. - Reference CR# 12-0525 regarding warrant is applied. At the above date/time " PO R. Cinquino (SOD), spoke with (VI)Lori L. Brocuglio, who carne to the NTPD to report an incident of harassment. Lori stated that she is one of the owners at Valenti's Restaurant and on 1/25/12 @ around 1030am she was in the parking lot, ready to take some items into the restaurant, when (S1)Frank Budwey approached her in a rage (Frank is the owner of the property and Valenti's Restaurant rents from him). According to Lori, Frank started yelling at her calling her a "fucking cunt" and yelling that he will "hunt you down and kill you", "fuck you in the ass", and "blow the building up". Lori told Frank to calm down and leave or she would call the police. Frank stated "go ahead, I own them" and "I have a lot of resources". Lori stated that Frank shut the power off to the building and she turned it back on. Lori left the area for fear that Frank would get physical with her. There is an ongoing history of incident's between the owner's of Valenti's and Frank Budwey, with this being the latest. Lori claims that this entire incident was videotaped by Frank's sister, who was in the passenger seat of his car. (WI1)Lisa Crane, employee at Valenti's and (WI2)Terry Valenti, owner of Valenti's witnessed this incident according to Lori.
