In your own words, what is required before a search can take place, or an arrest warrant may be issued? Is technological information gathering and surveillance protected by the Fourth Amendment? Why or why not?
It must be issued for one particular violation of the law. those cases wherein a crime has just been committed and he has probable cause to believe that such person he is to arrest is the one who committed it. These are the following: it must be based upon a probable cause personally examined by the judge strengthened by the oath of affirmation of the complainant and witnesses. The use of technology in obtaining information and surveillance is not among those protected by the Fourth Amendment. and must embody the specific place to be searched. however. There are. as it is not found anywhere therein – a result of the low technology there was when such Amendment was made. and when the person to be arrested has escaped in the penal institution he is in or while in transport on the same place. . some instances wherein a search or arrest warrant may be dispensed with wherein the seizing if the thing or person be made even with its absence. the particular thing or things to be seized and/or the particular person to be arrested.In order for the issuance of a search or arrest warrant be valid. Some cases where such is valid is when a person actually seen or heard the commission of the crime committed in his presence. certain requirements as provided in the Constitution is provided.
