1. The undersigned, Officer Rose J. Dell, being duly sworn, does depose and state that I am a member of the New Haven Police Department and have been for approximately four years. At all times mentioned herein, I was acting as a member of said department. I have received specialized training in motor vehicle accident investigations and am a member of the New Haven Police Department's Crash Reconstruction Team. I have investigated numerous fatal and serious crashes as well as DWIs. The following facts and circumstances are stated from personal knowledge and observations as well as information received from other police officers acting in their official capacity and from official police reports and statements made by prudent and credible witnesses. 2. On 11-19-11, at 9:49 am, Yale police officers reported that a U-Haul truck had struck three pedestrians in Lot D of the Yale Bowl. The New Haven Police Department's Crash Reconstruction Team responded to assist in the investigation. I observed that the U-Haul had struck two other vehicles and had four kegs of beer in the rear compartment. 3. One of the pedestrians struck, Nancy Barry, died as a result of her injuries sustained during the crash. Sarah Short, another pedestrian struck by the U-Haul, was transported to Yale-New Haven Hospital with serious, albeit non-life threatening injuries. The third pedestrian, Elizabeth Ann Dernback, was transported to the Hospital of St. Raphael with non-life threatening injuries. 4. On this date, Yale University was hosting the annual Yale-Harvard football game. This well attended event regularly attracts around 60,000 people. Lot D, which is located on Central Avenue between Cleveland Road and Route 34, is a large field where attendees of the event gather prior to the game. Hundreds of attendees gather in this field to drink and barbeque from the open "tailgate" of their vehicles.

5. Sergeant Mamie Robbins-Hoffman, of the Yale University Police Department, was assigned to Lot D to monitor vehicular and pedestrian traffic on the day of the game. Sgt. Robbins-Hoffman explained that she tried to direct pedestrians to the right of the driveway, to keep it clear for vehicles to enter. However, the pedestrian traffic continued to "spill" into the driveway, obstructing the path for the vehicles. 6. At approximately 9:49 am, Sgt. Robbins-Hoffman heard the engine of a stationary U-Haul truck loudly rev, as if the accelerator was being pressed. She attempted to get the operator's attention, because she saw numerous pedestrians in the direct path of his truck. 7. She saw that the operator (later identified as Brendan Ross) had his hands positioned on the steering wheel on the left and right, or as commonly referred to as the 3 o'clock and 9 o'clock position. Ross appeared angry with his face contorted and his mouth wide open as ifhe was yelling. He was staring straight ahead. 8. The truck operated by Ross then accelerated at a high rate of speed directly into the large crowd of pedestrians. Sgt. Robbins-Hoffman saw at least one, but possibly a second, pedestrian hit by the front grill of the truck. She saw another pedestrian run over by the truck's right front tire. The U-Haul truck then slammed into two parked trucks before it came to a stop. 9. Sergeant Sabrina Wood, of the Yale University Police Department, was also assigned as a Lot Dffailgate Supervisor for the Yale- Harvard football game. She also noted that the pedestrian traffic overflowed into the driveway portion of Lot D and restricted the vehicular traffic through the main gate, causing traffic to back-up on Central Avenue.

10. At approximately 9:49 am, she stood at the main gate on Central Avenue, directly in front of Lot D. She heard the engine of a truck revving loudly. She turned and saw a If-Haul truck positioned behind a large crowd of people, with the driver clearly engaging the accelerator on the vehicle. She saw the back tires spin and the truck make a fishtailing motion before the rear tires caught traction. 11. The truck then accelerated forward into the middle of the crowd of students. The U-Haul bounced off of the ground, as if it had struck someone or something, The vehicle continued accelerating until it struck a second UHaul truck, causing that truck to spin around and strike a third V-Haul truck. 12. Sergeant Von Narcisse, of the Yale University Police Department, was also a designated supervisor in Lot D of the Yale Bowl for the Yale-Harvard game. At around 9:49 am, he saw an orange and white, U-Haul truck moving at what he considered a very high rate of speed for an area with such a dense population of pedestrians. He estimated that there were several hundred people in Lot D at that time. 13. Sgt. Narcisse heard Sgt. Wood on the police radio calling for priority radio traffic only, which indicated that an emergency was in progress. He then saw a fast moving truck moving in the direction of two females. He saw the truck drive right over these two individuals. 14. He saw that the operator had two hands on the steering wheel and was staring intently forward with his eyes wide open. The U-Haul then struck another parked U-Haul truck.

15. Sgt. Narcisse ran to the stopped If-Haul truck and pulled open the driver's side door. He saw a white male, later identified as Brendan Ross, sitting in the driver's seat, with his hands on the steering wheel. He immediately yelled out, "I'm sober! I'm sober!"

16. Sgt. Narcisse instructed Ross to turn the vehicle off, because he could still hear the engine running. Ross fumbled with his hands down and toward the steering column area and said. "1 can't do it!" 17. Sgt. Narcisse looked at the gear gauge which was visible right above the steering wheel and saw that the truck was still in drive. Since the vehicle was not yet safe, he reached over, grabbed the gear shift and put the vehicle into park. He then turned the truck off and removed the keys. . 18. Officer Vallin, of the New Haven Police Department, then arrived on scene. Officer Vallin asked Ross if he was injured and he stated "No." Officer Vallin stated that Ross appeared disorientated and in a shaky voice stated; "Oh my God! What did I do? It was an accident.';

19. Ross was then transported to Chapel Street and Yale Avenue, the New Haven Police Department's command
post location during the game. A certified D.V.I. officer, Thomas Herbert, performed the standardized field sobriety tests. Ross was administered the Horizontal Gaze Nystagmus and the One-Leg Stand. Both tests were performed to standard.

20. Ross was then transported to the Detective Division at New Haven police headquarters. Officers Segui and Barrett read Ross his Miranda warnings. Ross then invoked his right to remain silent and consult with an attorney. The interview was then terminated,

21. Officers Segui and Barrett then conducted an audio/video taped statement of Jonathan Barclay. Mr. Barclay stated that he was a front seat passenger in the U-Haul truck operated by Brendan Ross. The vehicle had four individuals in the front seat and around 20-30 people in the rear compartment when they traveled from their fraternity house to the Yale Bowl. The individuals in the rear compartment exited the vehicle prior to the crash. 22. Barclay stated that they stopped at the entrance to the tailgate area. A huge crowd, of about fifty people, were in front of this entrance. Another passenger, Patrick Dolan, exited the truck to tell people to get out of the way, because the car was coming through. Ross then began to inch the truck forward. The truck then lurched forward and was uncontrollable. Barclay said that it more than lurched, it "shot forward." Barclay stated that Ross yelled, "I've got my foot on the brake. I'm not pressing the accelerator." Barclay said that the engine was loud, but Ross did not rev the engine. 23. Officers Segui and Barrett also conducted an audio/videotaped statement of Daniel Qiu, another front seat passenger in the truck operated by Brendan Ross. He stated that they stopped for three to four minutes at the gate of Lot D in front of a large crowd of students. 24. All of a sudden, the U-Haul began to accelerate and then run over the students. Everyone in the U-Haul was shouting and Ross was terrified and "freaking out." Ross lost control of the vehicle and didn't know how to stop it.

25. Qui said that after they went through the students, they kept going another 30 or 40 feet. He thought, "What, why aren't we stopping?" They hit one U-Haul truck and then still kept going. They hit another U-Haul truck, pushed that one and then stopped. 26. Qui also said that it didn't seem like Ross was in control of the vehicle at all. The U-Haul kept going faster and didn't even slow down when they crashed into the rest of the If-Hauls, 27. On the drive to the Yale Bowl, Ross said that there was something wrong with the automatic steering, and the vehicle was hard to tum. 28. In an e-mail to Attorney William Dow, Qiu reiterated that Ross commented on the operation of the V-Haul while they travelled to the Yale Bowl. He said that the U -Haul was difficult to steer and that he needed to press hard and early on the brakes to put the vehicle at a full stop. During the accident, Qiu thought to himself, "why aren't we stopping, why are we speeding up?" He said that even after they had run through the crowd of students, they proceeded to move faster . 29. Detective Roman and Officer Perry conducted a recorded interview with Patrick Dolan, who had rented the UHaul driven by Brendan Ross. Prior to the crash, he stepped out of the V-Haul to obtain an identification bracelet.

30. He saw the U-Haul briefly lurch forward, and then he was clipped by the truck in his shoulder area. He looked into the cab at Ross and saw him looking down. The line of pedestrians waiting for their wristbands moved out of the way of the truck.

The undersigned, being duly sworn deposes and says:

31. Then the U-Haul suddenly accelerated and traveled forward. He saw at least two people underneath the truck. The truck sounded and looked like it was speeding up. 32. Dolan ran over to Ross. Ross was visibly shaken, and stated to Dolan that he did not touch the gas. 33. Dolan rented the truck from the U-Haul on Dixwell Avenue in New Haven. When he drove the truck from VHaul back to the fraternity house, located at 31 High Street, Dolan said it was hard to drive. It seemed slightly unresponsive. He attributed this to the fact that he wasn't used to driving a U-Haul. 34. On the morning of the crash, Dolan moved the U-Haul from the driveway of the fraternity house onto the street. He said that the gear shift got stuck between neutral and drive. 35. Dolan was deposed on 12-6-11 at the Law Offices of Lynch, Traub, Keefe & Errante. He said that he rented the truck the day before the Yale-Harvard game. The engine was particu1arly loud, and the acceleration and brakes seemed slightly unresponsive. He considered returning the truck to U-Haul for an exchange, but did not. He said that he never feared for his safety while driving the truck but feared losing control or otherwise just not having control of the If-Haul. 36. Officer Barrett spoke to Sarah Short, one of the pedestrians struck by the U-Haul. She explained that she walked with Nancy Barry across the entrance to cross to the other side when she heard the revving of an engine. She stated that she looked back, because the revving of the engine got closer and louder. She stated that the truck

The vehicle involved in the crash was a 1999 Ford E-350 U-Haul cargo truck; bearing Arizona plate AA~ 68039, color Orange and White, with Vin# IFDWF36S5XEE59875. The vehicle is owned by U-Haul Company of Arizona, 2727 North Central Avenue, Phoenix, Arizona. This vehicle has an automatic transmission. 38. Attorney Holly Doyle, Assistant General Counsel of'Ll-Haul International., Inc., provided Officer Coppola with the rental contracts for the customers who rented the truck prior to Brendan Ross. 39. On 11-17-11 and on 11-18-11, the 1999 Ford E-350 If-Haul cargo truck, bearing Arizona plate AA-68039, was rented by two separate customers. Neither customer complained of any mechanical malfunctions of the truck. 40. Pasquale Capone, who rented the truck on 11-17-11, posted an online review of the truck. He stated, "The truck (was) in good operating condition which is to be expected but in the 'old days' not always the case." 41. On 2-22-12, I spoke with Mr. Capone about his experience with the rented U-Haul. He said that the truck appeared to have no mechanical issues. The engine was not loud. The brakes worked well, and the throttle did not stick.

42. On scene, I observed four distinct tire thread impressions in the grass. These marks indicated the path of travel of the U-Haul and are indicative of acceleration. I noted that there were no skid marks which are normally associated with brake application. In the tire thread impression closest to the fence, I observed two areas that indicate that the vehicle experienced an increase in acceleration. 43. On 12-7-11, John Williams, a certified mechanic for the New Haven Police Department, conducted a mechanical inspection of the U-Haul. Mr. Williams is also a Ford certified mechanic. He examined the overall mechanical components of the vehicle. He found no issues with the gas pedal, cable or throttle body. The brake system was in good working order. The truck was run in idle and was normal. 44. Wherefore: the undersigned states, that based upon probable cause, I believe that Brendan Ross drove a 1999 U-Haul cargo truck into Lot D of the Yale Bowl, located on Central Avenue, on November 19th 2011, at about 9:49 am. That Lot D was congested and contained several hundred people as well as parked vehicles. Ross stopped his vehicle in front of a large crowd of people waiting to enter the tailgating area. Ross accelerated into the crowd striking three pedestrians and then a parked vehicle. 45. That as a result of this crash, Nancy Barry was killed and Sarah Short and Elizabeth Ann Demback were injured. The tire impression evidence on scene indicated that Ross continued to accelerate and applied no brakes as he traveled through the crowd. A mechanical inspection of the vehicle revealed no deficiencies in the vehicle that could have contributed to the crash. A previous driver of the same truck said that he experienced no mechanical issues when he operated the truck two days prior to the crash. Wherefore, Brendan Ross failed to maintain control of his vehicle, and, instead, accelerated into a crowd of people. His actions caused the death of
