The Honorable J. Roland Smith Chairman, House Ethics Committee 519B Blatt Building Columbia, SC 29201 Dear Chairman Smith: Considering the magnitude and public attention regarding the matter of Rainey vs. Haley, it has become apparent to me that our committee is not in a position to complete a more thorough investigation. The perception that political forces are at play and that they are potentially impacting our ability to provide an unbiased review and judgment in this case is troubling. Especially since I know the amount of time and serious deliberation the committee has given to this issue. The House Ethics Committee has always had a strong record of performing its duties with integrity and honor, but considering the magnitude of this issue, our committee is not positioned to hire the team of criminal investigators and lawyers necessary to fully investigate this complaint. No one envisioned that the committee would be asked to judge constitutional matters of this size and scope. Although the complaint addresses Governor Haley’s activities while she was a legislator, I have some concerns with our committee investigating the Governor now that she is no longer a legislator. Considering the continuing public attention this case has garnered, I strongly suggest that we vote to refer this matter to the South Carolina Attorney General’s Office for their immediate consideration. As you know, the State Attorney General’s Office has the experienced investigators and staff necessary to address this matter in a fair and timely manner.

Please accept this letter as my written intention to take action on this matter at Thursday’s scheduled Ethics meeting. Having voted on the prevailing side of the original complaint, I plan to make a motion for reconsideration of Rainey vs. Haley and then move that the complaint be immediately forwarded to the Attorney General’s Office for his review.
