Whereas both the Government of India and the Government of West Bengal have repeatedly emphasized the need for keeping the region as an integral part of the State of West Bengal; And Whereas after several rounds of tripartite meetings at the ministerial and at the official levels, the G1M, while not dropping their demand for a separate State of Gorkhaland, has agreed to the setting up of an autonomous Body (hereinafter referred to as the new Body) empowered with administrative, financial and executive powers in regard to various subjects to be transferred to the said Body for the development of the region and restoration of peace and normalcy there at; And Whereas the objective of this Agreement

governing Body to administer the region so that the socio-economic,

infrastructural,

educational, cultural, and linguistic development is expedited and the ethnic identity of Gorkhas established, thereby achieving all round development of the people of the region;

Whereas all issues including iss~d relating to transfer of subjects to the new Body have been agreed in various tripartite meetings at the official level;

Whereas after several rounds of Tripartite discussions between the Government of India, the Government of West Bengal and the GJM, an agreement was reached in respect of all the issues; Now, therefore, the Government of India, the Government of West Bengal and the GJM, keeping on record the demand of the GJM for a separate State of Gorkhaland, agree as follows>

While under the provisions of the Constitution, transfer oflegislative powers to the new Body is not possible, the power to frame rules / regulations under the State Acts to control, regulate and administer the departments / offices and subjects transferred to the new Body will be conferred upon the new Body; The administrative, executive and fmanciaI powers in respect of the subjects

transferred will be vested in such a way that the new Body may function in an autonomous and effective way; The subjects alongwith all Departments / Offices to be transferred to the new Body is appended as Annexure - fA'. The area of the Gorkhaland Territorial Administration shall comprise the areas of the entire sub-divisions of Darjeeling, Kalimpong with extended areas of Kurseong. In regard to transfer of additional areas of Siliguri Terai and Dooars to the new Body, a High-Powered representatives ofGJM, Committee will be formed comprising four

There shall be a GTA Sabha for the GTA. There shall be a Chairman and Deputy Chairman to conduct the business of Sabha. The GTA Sabha shall consist of fortyfive elected members and five members to be nominated by the Governor to give representation to members of SC, ST, women and minority communities. The M.Ps, M.L.As, and Chairpersons of municipaIity(s) of the region shall be Exofficio Members to this GTA Sabha. The term of the GTA shall be five years. The Executive Body shall consist ofa Chief Executive who will nominate fourteen members out of the elected / nominated members as Executive Members. One of them shall be the Deputy Chiefto be nominated by the Chief Executive. Every member of the GTA shall before taking seat make and subscribe before the Governor or one of the elected members appointed in that behalfby him an oath or affirmation. The Chief Executive shall be administered an oath or affirmation by the Governor. There shall be a Principal Secretary of the GTA, who shall be of the rank of the Principal Secretary/Secretary to the State Government and who shall be selected by the Chief Executive from the panel sent by the State Government and shall be paid from the GTA Fund such salaries and allowances as may be fixed by the State Government. The Principal Secretary once deputed to the GTA shall not be transferred for a period of at least two years without the consent of the GTA. The Government of India and the Government of West Bengal will provide all possible assistance to the GTA for the overall development of the region. The Government of India will provide financial assistance of Rs. 200 crore (Rupees Two Hundred Crore) per annum for 3 years for projects to develop the socioeconomic infrastructure in GTA bver and above the normal plan assistance to the State of West Bengal. The allocation sanctioned in the budget of GTA and all funds sanctioned by the State or the Union Government which remain unspent at the close of the financial year shall be taken into account for the purpose of providing additional resources in the Budget of the following year or years and the fund requirements will be met on a yearly basis. The Government of West Bengal shall provide formula based plan fund with 60 per cent weightage on population and the balance weightage on area backwardness, hill areas and border areas in two equal installments development works. The Government of West Bengal shall provide Non-plan grant including provisions for bearing the additional Non-plan expenditure for existing employees payable in two installments in respect of the offices I departments transferred to GTA.. The fund received from the Government ofIndia shall not be diverted and the State Government shall release the fund in time. The GTA will have the power of creating Group B, C and D posts with the approval of Governor. The recruitment to Group B, C and D posts will be through a Subordinate Service Selection Board to be set up for this purpose. The State Public Service Commission shall be consulted for the recruitment of Group 'A' officers. The State Government will set-up a separate School Service Commission, College Service Commission; open an office of the Regional Pension and Provident Fund Directorate; and set up an office for Registration of land, building etc., marriage, society etc ..in the GTA area, subject to extant rules and regulations. The Governor of West Bengal shall obtain a report on the functioning of the GTA and cause that report to be laid on the table of the West Bengal Legislative Assembly annually.

The GTA, once established, will separately take up the issues relating to grant of incentives, subsidies, waiver of taxes and tariff and other benefits as appropriate to the region's backwardness, with the Central and State Governments. A three-tier Panchayat will be constituted by elections in the GTAregion, subject to the provisions of Part IX of the Constitution of India. Notwithstanding anything contained in the West BengalPanchayat Act, 1993, the GTA shall exercise Panchayats and the Municipalities. Act 1973, or the West Bengal Municipal general powers of supervision over the

The GTA youth would be considered for recruitment in the Police, Army and Para Military Forces subject to their suitability for such appointment. Sir, This letter is in refrence to the Memorandum submitted by GJM,Ref.No.GJWCC/I62/11 dated 31.10.11 to the High Power Committee. In the report some of the mouzas had not been mentioned by mistake in the earlier report. In the second chapter of the report,submission before the High Power Committee, the total number of mouzas mentioned is 168 mouzas at pages 3 and 5 respectively, but the total number of mouzas claimed should be 191. Minutes of the Fi.rst Meeting of. the HighPower Committee for determination of territorial areas ofGTA

The first meeting of the High Power Committee for determination of territorial areas of GTA was held on 30th August, 2011 at 5, Council House Street, Kolkata. List of participants is annexed herewith (Annex-I). 2.. The Chairman welcomed all members and briefed about the Government Notification No. 371 - HA dated 29th July, 2011 read with Corrigendum No. 409 - HA dated loth August, 2011 constituting the Committee and its broad purpose. Draft regulations and procedure pertaining to the functioning of this Committee were circulated, discussed and was finalized with consensus which may be seen at Annex - II. 3. It was decided that as per para (v) of the regulations, wide publicity win be given iII leading and local dailies inviting petitions/ representations from the person(s) interested! Association! Council etc. relating to the issue through public notice. It was suggested by the members and accepted that notice will be published particularly in the Himalaya Darpan, Sunakhri, Dainik Jagran, Uttar Banga Sangbad and the Telegraph dailies. 4. It was decided that the last date for receiving petitions in terms of para 3 above, will be 3 i51 October, 20] 1.. The Hill Affairs Department will make arrangements to publish the notice, after obtaining approval from the Chairman regarding its contents. 5. On such publication as in para 4 above, the petitions/ representations will be received by the offices of the District Magistrates of Darjeeling and Jalpaiguri, the Sub-divisional Offices of Siliguri and Malbazar besides the Committee's office at 5, Council House Street, Kolkata ~ 700 001. 6. While considering the question of constituting a survey team it was observed by the

Regulations and Procedure of functioning of the High Power Committee for determination of territorial areas of GTA

In exercise of the powers conferred under para 4 of Notification No. 371 - HA dated 29 July, 2011 read with Corrigendum No. 409 - HA dated 10th August, 2011, the High Power Committee constituted for the purpose. stated in the aforesaid Notification hereby frames the following regulations to regulate I formulate its procedure namely :th

The proceedings will be conducted in English. The Headquarter of the Committee shall be at 1st Floor, 5, Council House Street, Kolkata -700001. (iii) The office of the Committee shall be open between 10:00 a.m. to 5.:30p.m. with a recess from 1:30 p.m..to 2:00 p.m, on all days other than the holidays observed by the State Government. (iv) The Committee will ordinarily hold its meetings in one of the meeting rooms at 1st Floor, 5, Council House Street, Kolkata - 700 001 depending on the number of members of the Committee alongwith the other invitees to attend such meeting. The Committee if considered fit and proper may meet any member(s) of public for the purpose of proper determination of any question that may arise for consideration. (v) Public notice is to be published in all leading daily newspapers, including those in hill areas, inviting petitions I representations from the person(s) interested I Association I Council etc. relating to the issue. (vi) Meeting of the Committee can be held with a quorum of 5(five) members excluding Chairman. (vii) Notice for meeting of the Committee shall be issued by either of the Joint Convenor with the approval of the Chairman. (viii) Dates, timings and venue of the sitting of the Committee will be notified from time to time as may be decided by the Chairman. (ix) Procedure for hearing may be laid down by the Committee as may appear to be suitable according to the exigencies of the situation. . (x) Every representation may be typed in English or any other language accompanied by the English version of the same and signed by the person making such representation with his I their complete postal addresses. The representation on behalf of an association I organisation shall be signed by any of the office bearer who shall be duly authorised by the Committee or the Council with appropriate resolution which shall be enclosed. (xi) Every representation must be useful for, or relevant to the subject matter to be examined by the Committee and it must not contain any offensive or scandalous matters I remarks.

If any information mentioned in a representation is derived solely or in part from any document or record, the particulars of such document should be indicated clearly and authenticated photocopies thereof shall be annexed with the representation. (xiii) Every representation shall be submitted in triplicate and must contain specific proposal with proper justification. (xiv) All representations must be submitted personally or through authorised agents supported by a letter of authority in the office of the Committee at Kolkata as well as at the offices of the District Magistrate, Darjeeling and Jalpaiguri and the Subdivisional offices of Siliguri and Malbazar between J 2:00 noon to 4:00 p.m. on all working days excluding holidays notified by the State Government. The representation may also be sent by registered post with A.D./Speed post/Courier Services at the office address of the Committee mentioned earlier. (xv) All representations shall be addressed to the Chairman of the Committee. (xvi) Any petition after examination in office shall be submitted to Chairman who shan finally decide to place the same before the Committee for disposaL (xvii) The Committee shall set up a survey team comprising of suitable officers either from Central Government or from State Government or from both the Government to identify the compactness, contiguity, homogeneity, ground level situation and other relevant factors of the areas in question. The services of such officers may be utilised under the direction and control of the Committee with the concurrence of the respective Government. (xviii) The Committee or its representative(s) shall also make survey, if necessary. (xix) The Secretary, Deputy Secretary to the Committee have been authorised to sign letters, notices etc. on behalf of the Committee. Service of such noticeslletters may be effected according to the mode or may be considered proper according to the exigencies. The Committee shall decide whether any representation can be disposed of by (xx) their own or by interrogatory. The Committee, at his discretion, shall decide who are to be orally examined taking into account the survey report on the issue involved. (xxi) The Committee reserves its right, to alter, modify, delete or add to any of these regulation or procedure at any time during the examination of the petition as and when it considers necessary after due notice to the interested parties.

Chairman informed that the office of the High Power Commettee started functioning 8 November, 2011 except that first meeting

as individuals had been received and the process of recording of these petition had been started.

Mr. S.N. Pradhan mentioned that some petitions were returned back to Oarjeeling as

there was no officials present at the office of High Power Committee at 5, Council House Street. Kolkata - 700001 prior to commencement mentioned above. of functioning of office at the premises No.

His prayer was accepted without any objection and he was requested to deliver the same to the Secretary.

Chairman mentioned that some amendments and addition were required to be made

in the regulations and procedure of functioning of High Power Committee' already approved in the first meeting as follows -

Amendment of (XVI) (XVI) (A)Any petition after examination in office shall be submitted to the Chairman

who shall finally decide if the same be placed before the Committee or be disposed of by himself. However, if the Chairman on perusal of tne petition is of the opinion that the petition does! not disclose any ground or is not in compliance with clause XI mentioned herein

above, the Chairman may reject the said petition inlimine or he may in appropriate cases give opportunity to the petitioners to disclose the ground by submitting further petition which may be treated as supplementary to the original petition. However, it is made clear that only when a prima-facie case appears the petitioner will be called upon to appear. The Chairman may request any person to appear before him if he is of the view that his assistance in a matter may be useful.

Hon'ble Justice Shyamal Kumar Sen, Retired Chief Justice of Allahabad High Court, Chairman of the High Power Committee presides over the meeting. Shri G.D. Gautama, lAS. Addl. Chief Secretary, Home Department, Government of West Bengal and Shri Kitab Singh Rai, Representative of GJM are absent in the meeting. Add!. Chief Secretary, Home Department informed Secretary, High Power Committee over phone that he is busy with other important emergent work due to poisonous alcoholic disaster in Mograhat P.S. of South 24 Parganas district and will not be able to attend the meeting.

The minutes of the second meeting held on 29th November, 2011 stands confirmed

with some minor corrections.
