This sample opposition to motion for relief from the automatic stay in United States Bankruptcy Court is used when a party wishes to oppose a motion for relief from the automatic stay on the grounds that the moving party has not met their burden of showing that they are a real party in interest entitled to enforce a colorable claim against property of the bankruptcy estate, has failed to submit admissible evidence as well as failed to show any bad faith on the part of the Debtor. The sample is 12 pages and contains a memorandum of points and authorities with citations to case law and statutory authority, brief instructions, and a proof of service by mail. The author is a freelance paralegal that has worked in California and Federal litigation since 1995 and has used this sample for many years. Note that the author is NOT an attorney and no guarantee or warranty is provided.
