Background
Section 8306 of the U.S. Troop Readiness, Veterans' Care, Katrina Recovery, and Iraq
Accountability Appropriations Act, 2007 (P.L. 110-028), modified the Buy American Act
(41 U.S.C. 10a) by adding a requirement for the head of each Federal agency to submit a report
to Congress on the amount of acquisitions made by the agency from entities that manufacture the
articles, materials, or supplies outside of the United States in each of the fiscal years 2007
through 2011. The report is to separately identify (1) the dollar value of any articles, materials,
or supplies purchased that were manufactured outside the United States; (2) provide an itemized
list of all waivers granted with respect to such articles, materials or supplies under the Buy
American Act (BAA); (3) the specific exception under this section that was used to purchase
such articles, materials, or supplies; and (4) a summary of the total procurement funds spent on
goods manufactured in the United States versus funds spent on goods manufactured outside the
United States.
Discussion
This report includes three sections: (1) all procurements from foreign entities and more
specifically, purchases of articles, materials, or supplies/manufactured goods from.suchforeign
entities; (2) waivers granted with respect to such articles, materials, or supplies under the BAA;
and (3) a comparison of procurement funds spent on goods manufactured in the United States
versus funds spent on goods manufactured outside the United States.
The information presented in this report addresses FY 2011 and is based on data from the
Federal Procurement Data System - New Generation (FPDS-NG), data compiled and distributed
by Department of Defense's (DoD) Defense Manpower Data Center, Statistical Analysis
Information Division, and data published by the Defense Security Cooperation Agency (DSCA).
The FPDS-NG data addresses contracting procedures, competition, financing, statutory
requirements, socioeconomic programs, and other information relating to DoD acquisitions.
Section 1 - Procurements from Foreign Entities
All procurements.
are for use outside the United States. Defense equipment constitutes approximately 18 percent
of the purchases from foreign entities. Fuel, services, construction, and subsistence account for
approximately 27 percent, 15 percent, 12 percent, and 13 percent, respectively, or approximately
67 percent of the total purchases from foreign entities.
Table 2 provides a detailed breakout of the $24 billion by category and percentage of
total.
Procurement of manufactured articles.
This section focuses on defense articles provided by foreign entities that are
manufactured outside the United States. Of the approximately $24 billion that was expended on
all purchases from foreign entities defined by the Defense Claimant Program (DCP), Table 3
notes that approximately $7.8 billion was expended on contractual actions for the procurement of
articles manufactured outside the Unites States.
Table 3 removes the data in Table 2 that are associated with petroleum, other fuels and
lubricants, subsistence, construction, and services (DCPs A8A, A8B, B2, C2, and SI) to derive
the $7.8 billion for articles manufactured outside the United States. Table 3 further refines this
data to exclude all activities/services included in the $7.8 billion in DoD procurements from
foreign entities that are not actually associated with manufactured goods. For example,
Column 1 in Table 3 reflects a total of $ 544,099,421.51 for DCP Al A. However, after removal
of costs associated with various aircraft related services including research and development and
maintenance, the adjusted figure for A1A is only $461,377,023.14 as reflected in Column 2.
Similar adjustments were made to the remaining DCPs, resulting in an adjusted total of
approximately $5.7 billion for procurement of articles manufactured outside the United States by
foreign entities.
Table 4 provides a detailed breakout of DoD purchases by foreign country, dollars, and
number of actions.
Table 5 refines the data even further to provide visibility into this information by DCPs,
country, dollars, and the number of actions.
Section 2 - Waivers of the Buy American Act Granted with Respect to Such Articles.
Materials, or Supplies
FPDS-NG data reflect that 2,645 waivers during FY 2011 were granted to Qualifying
Countries for a total dollar value of $1.1 billion dollars, representing 9.1 percent of the total DoD
purchases from foreign entities. DoD purchases from foreign entities during FY 2011 also
included 1,161 transactions for $256 million dollars were pursuant to the Trade Agreement Act
of 1979or other international agreements. This authorized exceptionto the BAA represents
2.1 percent of all DoD purchases from foreign entities.
Other authorized exceptions to the BAA represent 4,691 purchases for approximately
$874 million dollars, or 7.1 percent, of all purchases from foreign entities during FY 2011.
These exceptions provided in the law include: (1) manufactured outside the United States -
Resale; (2) manufactured outside the United States - Commercial Information Technology;
(3) manufactured outside the United States - Public Interest Determinations; (4) manufactured
outside the United States - Unreasonable Cost of Domestic End Product.
Finally, 39,055 of the DoD purchases from foreign entities for approximately $1.1 billion
dollars (82 percent) represent items manufactured and used outside the United States to which
the BAA does not apply.
Table 6 provides a detailed breakout of the actions and dollars by category and an
explanation of the authority for each of the categories.
Section 3 - Comparison of Procurement Funds Spent on Goods Manufactured in the
United States Versus Funds Spent on Goods Manufactured Outside the United States
This is the final report required by section 8306 of the U.S. Troop Readiness, Veterans'
Care, Katrina Recovery, and Iraq Accountability Appropriations Act, 2007 (P.L. 110-028),
which modified the BAA (41 U.S.C. 10a) and directed the Department to report on the amount
of acquisitions made by the agency from entities that manufacture the articles, materials, or
supplies outside of the United States in each fiscal year 2007 through 2011.
