LEAVE AND LICENSE AGREEMENT
THIS AGREEMENT Made This 1st Day of July, Two Thousand Twelve BETWEENby faith Hindu, By Occupation- House wife, ---------------------------------------------------------------------------, residing_______________________________________, hereinafter called the LICENSOR (which expression shall unless excluded by or repugnant to the subject or context be deemed to mean and include their heirs executors , administrators ,legal representatives and assigns) of the ONE PART: AND ____________________son of _________________________l ,By faith-Hindu, _______________________________________________, hereinafter called the LICENSSEE (which expression shall unless excluded by or repugnant to the subject or context be deemed to mean and include their heirs, executors, administrators, legal representatives and assigns) of the OTHER PART:
A. The Licensor is the Owner of the 3rd Floor North West flat consisting of 2 Bed Rooms, 1
Drawing-cum-dining, 1 Kitchen, 2 Toilet, 1 Varandah on the 3 rd Floor at 103,Bangur Avenue, Block –A, Kolkata-700055 (hereinafter called the “SAID FLAT”).
B. The Licensee has approached the Licensor to give him the said flat for residential purpose for
him and his family members for a period of 11 months commencing from 1st day of July 2012 to 31st May 2013 on leave and license basis on the terms and conditions hereinafter mentioned.
2 C. The Licensor has accorded to the aforesaid request of the licensee to give the said flat for the
exclusive use for him and his family members for a period of 11 months commencing from 1st day of July 2012 to 31st May 2013 with option for renewal for further 11 months , subject to fresh terms & conditions and at the option of the first party.
D. The Licensee shall pay to the Licensor as and by way of License fee in respect of the said flat
fully described in the Schedule hereunder written at or for the sum of Rs.11,000/- (Rupees Eleven Thousand ) only per month of the said flat according to English Calendar month. The license fee shall be payable in advance Rs 33000/- (Rupees Thirty Three thousand ) only for 3 (Three) months for the period from 1st july 2012 to 30th Sept 2012 at the time of execution of this agreement.
E. The Licensee shall pay to the licensor as a Security Deposit Rs.10000/- (Rupees- Ten
Thousand Only) interest free shall be refunded after adjustment of dues, if any , by the licensor to the licensee at the time of vacate the said flat.
F. The maintenance charges of the said flat shall be paid by the licensee to the association of the
G. The Licensee shall quietly vacant and deliver peacefully to the licensor the said flat without
any claim, right, title, interest or demand whatsoever on or before 31st May 2013. To avoid future dispute between the parties it is expedient to have a Deed of Agreement embodying the terms and conditions agreed by the parties hereto. NOW THIS DEED OF AGREEMENT WITHNESSETH that in pursuance of this agreement the parties hereby covenant and with each other to abide by the follows. TERMS AND CONDITIONS
That the license is granted by the licensor to the licensee in respect of the said flat consisting 2 Bed Rooms, 1 Drawing-cum-dining, 1 Kitchen, 2 Toilet, 1 Verandah on the 3rd Floor ,103,Bangur Avenue,Block-A,Kolkata-700 055(hereinafter called the “SAID FLAT”) That the Licensor will provide Electricity from his own meter and the Licensee shall pay the electricity charges, whatever current consumed by him in the demised flat according to the reading of the power meter provided and shall pay within due period. his family members and not for any other purpose such as any business/commercial affairs or to install any kind of machinery etc. and the licensee shall not allow any other person to reside in the said flat and/or occupy the flat in question as described in the Schedule hereinafter under any circumstances.
iii) That the Licensee has taken the said flat exclusively for residential purpose for him and
iv) That the Licensee shall not use coal oven but will use the domestic gas for their cooking
That the Licensee shall keep the said flat in good order and condition and shall on the expiry of the 11 months period i.e. from 1st day of July 2012 to 31st May 2013 or on an earlier termination of this agreement, handover the said flat to the Licensor in same condition in which he has taken possession of the same reasonable wear and tear excepted and any loss or damages due to breakage, theft or any reason cause whatsoever, shall be borne by the Licensee at their own cost which include inter alia any fixture and fittings, Polishing of door/windows and floor tiles etc. The Licensee shall not make any material alteration to the flat unless approved and sanctioned by the Licensor and in any event such alteration if permitted shall be made by the Licensee at his cost, expenses and shall not be entitled to as for any contribution by the licensor.
3 vii) That the licensee shall affect only minor repairs at their cost.
viii) That the Licensee shall be allowed to install T.V Dish/Antenna on roof of the building.
ix) That during the period of License, the Licensor shall have exclusive right and control of
the premises and the Licensor and/or his authorized agent shall have the full right to enter into the said flat for inspection at all reasonable times on notice to the Licensee. x) That any breach of the terms and condition shall entitled the licensor to terminate the license and evict the licensee from the said premises and in that event the Licensee shall not be entitled to claim any damage or compensation whatsoever from the Licensor. either side and in that event, if there is any security deposit then it shall be refunded after adjustment of dues, if any, by the licensor to the licensee.
xi) The lease agreement can be terminate with two calendar month’s notice in writing from
