For example, by limiting the choice of arbitrators to a group pre-

disposed against athletes in disputes with sports organizations and

training its own arbitrators, USADA has retained essentially the

exclusive right to select a panel of biased arbitrators in this matter.

Likewise, because USADA can unilaterally modify its arbitration

provisions, any obligations in arbitration are purely “illusory.”

Furthermore, the USADA arbitration will not provide remedies

equal to those available in court in that Armstrong will be

deprived of substantive rights available in Court.
