Request for Investigation into Philadelphia Chief of Police Charles Ramsey RE: Dear Attorney General Kelly, I am respectfully requesting, as both an Officer of the Court and as a resident of the Commonwealth of Pennsylvania, that you initiate a formal investigation into Philadelphia Chief of Police Charles Ramsey for both misdemeanor and felony violations of Pennsylvania's Uniform Firearms Act, 18 PA.C.S. 6101, et. seq., as he has openly carried a firearm in the city of Philadelphia but is neither a certified police officer, nor does he have a license to carry firearms, pursuant to 18 PA.C.S. 6109. Furthermore, he wears a uniform and displays a badge, but is not a certified police officer, in violation of Municipal Police Officers' Education and Training Program, 53 PA.C.S. 2161 et seq. Accordingly, he is also not entitled to compensation, pursuant to 53 PA.C.S. 2167.

In relation to Pennsylvania's Uniform Firearms Act, an individual must obtain a license to carry firearms to conceal a firearm on or about his person or to carry a firearm in a vehicle. 18 PA.C.S. 6109.See also, 18 PA.C.S. 6106 making a violation of this section a felony of the 3rd degree or misdemeanor of the 1st degree. Furthermore, in a city of the first class, which Philadelphia is classified as, an individual must have a license to carry firearms, or be exempted, to openly carry a firearm. 18 PA.C.S. 6108. A violation of this section is a misdemeanor of the 1st degree. 18 PA.C.S. 6119. While I have not personally seen Chief Ramsey conceal a firearm on his person or enter a vehicle with a loaded firearm (although I would be extremely surprised to learn that he hasn't), I have seen him with a firearm openly displayed on his hip, on numerous occasions, while giving press interviews in Philadelphia. If you require copies of such interviews, please let me know at your earliest convenience, and I will procure copies. While I acknowledge there are exceptions, including for law enforcement, for the reasons stated below, Chief Ramsey is not a certified law enforcement officer.

In relation to the Municipal Police Officers' Education and Training Program and its related

commission, the Municipal Police Officers' Education and Training Commission (MPOETC), any officer must be certified by MPOETC. 53 PA.C.S. 2167. Specifically, 'All municipalities of this Commonwealth or groups of municipalities acting in concert and all colleges and universities shall be required to train all members of their police departments pursuant to this subchapter prior to their enforcing criminal laws, enforcing moving traffic violations under Title 75 (relating to vehicles) or being authorized to carry a firearm.' (emphasis added). Furthermore, with regards to compensation, it states, 'Any person hired as a police officer shall be ineligible to receive any salary, compensation or other consideration for the performance of duties as a police officer unless the person has met all of the requirements as established by the commission and has been duly certified as having met those requirements by the commission.'

MPOETC's Administrative Officer, Dr. E. Beverly Young, has stated, 'The minute they wear the badge or the gun or present themselves as a police officer...they must have certification.' Chief Ramsey has acknowledged that he is not MPOETC certified. See Id. Furthermore, in that same article, Chief Ramsey acknowledges being aware of the law since 2008 but merely put it off because of his belief that his predecessors did not comply. Id.

While there is now conflicting evidence of whether he has become MPOETC certified, such certification would not absolve him of his past violations of the law nor change the fact that he was not entitled to compensation from 2008 through the date of certification, which must be reimbursed to the Commonwealth. As the Philadelphia District Attorneys Office would be conflicted in any investigation, given the working relationship between the DA's Office and the Philadelphia Police Department, I am respectfully requesting that you open a formal investigation into Chief Charles Ramsey for the above stated violations of law.
