TURKISH CUSTOMS TARIFF (as of January 1 st , 2010)

Customs Tariff Guidelines

Turkish Customs Tariff comprises the rates of duty, Mass Housing Fund implementing for certain goods and the amount to be paid to the Fund in euro (equivalent in TL) as agricultural component, which are all determined by the Degree of Import Regime annexed to the Degree No. 2009/15710 which was published in the Official Gazette No: 27449 of 31.12.2009 (2. bis) and entered into force in 01.01.2010.

This work, which is not binding legally, is offered for the beneficiary of all users and it would provide to see the obligations of the customs duties that would be applied to the goods imported to Turkey.

Turkish Customs Tariff includes the following:

- Chapters 1 to 97 (comprising the Lists I to IV of the Import Regime)

- List V: Suspension List

- List VI: Civil Aircraft and Goods for Use in Civil Aircraft

- Product List

- Annex 1: Combination Table Indicating the Codes

- Annex 2:Agricultural Components

- Annex 3: Sector List

- Annex 4: Provisions for Products Originating in Montenegro

The explanations and their contents are mentioned below.

In the first column of Customs Tariff, ten digit codes are used. The first six digits indicate Harmonized System Nomenclature, 7-8th digits indicate Combined Nomenclature of the EC and the last 9-10th digits are used to display the subheadings created for national requirements.

The goods mentioned in List V are shown with 12 digits instead of 10 digits. The 11 th and 12 th digits indicate the statistical divisions.

The text in the second column corresponds to the description of the goods in compliance with the Harmonized System. The description of goods corresponding to the 7th and 8th digits of the tariff codes represent the Combined Nomenclature of the European Communities and 9th and 10th digits represent national subheadings.

Subsequent columns indicate the duty rates and differ in each chapter according to the list of which the current product belongs to. The Chapters 1 to 97 comprises the Lists I to IV. It is possible to examine each chapter without overlooking the Import Regime of the products. For example, Chapter 15 includes products from Lists I to IV, in this regard, that chapter comprises four different duty rate columns. The lists are as follows:

Products of List I, List II, List III and List IV are indicated in Chapters 1 to 97 by four different background colours that are used to indicate duty rate columns. In this respect:

In this context, the countries and country groups mentioned in the Lists (I, II, III, IV) are;

EU:

European Union (Turkey has Customs Union with EU) The countries of the European Union are: Austria, Belgium, Bulgaria, the Greek Cypriot Administration of Southern Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Irish Republic, Italy, Latvia, Lithuania, Luxembourg, Malta, the Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden and United Kingdom.

EFTA:

European Free Trade Area (Turkey has Free Trade Agreement with EFTA) EFTA Member States are: Iceland, Liechtenstein, Norway and Switzerland.

Other Countries:

Includes all the other countries except the countries mentioned by name in other columns of the Lists concerned.

GSP (Generalized System Of Preferences) COUNTRIES:

For the application of the preferential rates of duty included in these columns certificate of origin Form A is required for the given countries.
